AN ORDINANCE AMENDING CHAPTER 3 "BUILDING REGULATIONS" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS, AS AMENDED, BY THE ADDITION THERETO OF A NEW SECTION 13 "HANDICAPPED PARKING STANDARDS AND BUILDING ACCESSIBILITY"; REQUIRING HANDICAPPED ACCESSIBLE PARKING SPACES IN ALL PARKING AREAS; PROVIDING FOR DESIGNATION OF SAID PARKING SPACES; PROVIDING A PENALTY FOR VIOLATION; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Article 6675a-Se.l, Tex.Rev.Civ.Stat.Ann., allows cities to require provision of parking spaces for disabled persons on privately owned parking areas; and WHEREAS, the City Council of the City of Richland Hills, Texas, finds that the interest of the community would be best served by requiring parking spaces accessible to physically disabled persons in each privately owned parking facility within the city. • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Chapter 3 "BUILDING REGULATIONS" of the Code of Ordinances, City of Richland Hills, Texas, as amended, be hereby amended by the addition thereto of a new Section 13 "HANDICAPPED PARKING STANDARDS AND BUILDING ACCESSIBILITY", which new section shall hereafter be and read as follows: SECTION 13: HANDICAPPED PARKING STANDARDS AND BUILDING ACCESSIBILITY The owner or operator of any off-street parking facility required by the zoning ordinance of the City shall provide stalls or spaces in the off-street parking facility for the exclusive use of vehicles which display a distinguishing license plate, specially designed symbols, tags or other devices issued pursuant to Articles 6675a-Se and 6675a-Se.l, Tex.Rev.Civ.Stat.Ann., to disabled persons. Such stalls or spaces shall be designated by posting immediately adjacent to and visible from each stall or space a sign displaying the International Symbol of Accessibility. For every parking lot required or provided for employees or visitors, or both, accessible spaces, complying with (A), (B), (C), (D) and (E) hereof shall be provided in each such parking area in conformance • with the following: ORDINANCE NO. 6 7 0 PAGE 1 • TOTAL PARKING IN LOT RE UIRED 1V~l~iIMUM NUMBER OF Q ACCESSIBLE PLACES 1 to 25 1 26 to 50 2 51 to 75 3 76 to 100 4 101 to 150 5 151 to 200 6 201 to 300 7 301 to 400 8 401 to 500 9 501 to 1000 2 % of total 1001 and over 20 plus 1 for each 100 over 1000 EXCEPTION: The total number of accessible parking spaces may be distributed among parking lots, if greater accessibility is achieved. (A) One in every eight accessible spaces, but not less than one, shall be served by an access aisle 96" wide minimum and shall be designated "van accessible". All such spaces may be grouped on one level of a parking structure. • (B) Parking spaces for disabled people that serve a particular building shall be the spaces located closest to the nearest accessible entrance or an accessible route. In separate parking structures or lots that do not serve a particular building, parking spaces for disabled people shall be located on the shortest possible circulation route to an accessible pedestrian entrance of the parking area. (C) Parking spaces for disabled people shall be at least 96" wide and shall have an adjacent access aisle 60" wide minimum. Two accessible spaces may share a common access aisle. Parked vehicle overhangs shall not reduce the clear width of an accessible circulation route. Parking spaces and access aisles shall be level with surface slopes not exceeding 1:50 in all directions. (D) Accessible parking spaces shall be designated as reserved for the disabled by a sign displaying the International Symbol of Accessibility. Such signs shall not be obscured by a vehicle parked in the space. Such signs shall be of such size to be legible from the traffic aisles of the parking area. Spaces complying with van accessible standards shall have an additional sign displaying the words "van accessible" mounted below the symbol of accessibility. (E) Where parking is provided for all residents of accessible multi-family housing, one accessible parking space shall be provided for each accessible unit. Where parking is provided for visitors, 2% of the visitor spaces, or at least one, shall be accessible. • ORDINANCE NO. 6 ~ 0 PAGE 2 • (F) The penalty provisions contained in Section 10 of Article 6675a-Se.l, Tex.Rev.Civ.Stat.Ann., are hereby adopted and made applicable to parking areas located on private property, and to parking spaces designated for disabled persons located in parking areas on private property. II. Penalty Clause. Any person violating or failing to comply with the provisions of this Ordinance, as listed above, shall be deemed guilty of a misdemeanor and each day any violation or noncompliance continues shall constitute a separate and distinct offense and upon conviction thereof such person(s) shall be fined not less than one ($1.00) Dollar nor more than five hundred ($500.00) Dollars. III. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or • unconstitutional phrase, clause, sentence, paragraph or section. IV. Saving Clause. That Chapter 3 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. V. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
