HomeMy Public PortalAboutOrdinance 00:54Councilman Presents the following Ordinance Seconded by Councilman AN ORDINANCE CREATING A CARTERET REDEVELOPMENT AGENCY WHEREAS, IT ORDAINED by the Mayor and Council of the Borough of Carteret that there shall be created a Carteret Redevelopment Agency for the purpose of fostering the economic advancement of the community. BE, IT FURTHER ORDAINED that there be added to the Borough Code of the Borough of Cartemt a new chapter designated Chapter 5 and titled "Carteret Redevelopment Agency" which shall read in its entirely: CARTERET REDEVELOPMENT AGENCY 5-1. Enactment. 5-6. Conflict of Interest. 5-2. Commissioners. Terms. Appointment. 5-7. Removal. 5-3. Authority. 5-8. Training. 5-4. Compensation. 5-5. Quorum. Voting. Organization. By-Laws. 5-1. Enactment. Acting pursuant to Chapter 79 of the Laws of New Jersey 1992, N.J.S.A. 40A:I2A-1 to 40A:12A-49 inclusive, and the acts amendatory thereto and supplemental thereto, there is hereby created a public body corporate to be known as the "Carteret Redevelopment Agency." Such Agency shall constitute a Redevelopment Agency contemplated and provided for in said Act and shall have the power and authority as provided by said Act and the acts amendatory thereof and supplemental thereto. 5-2. Commissioners; Terms. Appointment. A. There shall be seven (7) Commissioners of the Carteret Redevelopment Agency, appointed by the Mayor with the advise and consent of the Borough Council. Commissioners shall each serve for a term of five (5) years, except that the first set of Commissioner appointees shall be designated to serve for the following tmxns: one (1) for a term of one year, one (1) for a term of two (2) years, two for (2) terms of three (3) years, one (1) for a term of four (4) years and two (2) for terms of five (5) years. No more than two (2) Commissioners shall be officers or employees of the Borough of Carteret. Not more than two (2) of the Commissioners shall be members of the Borough Council. A Commissioner who is a member of the Borough Council shall serve for a term of one (1) year. A certificate of the appointment of a commissioner shall be filed with the Borough Clerk and shall serve as conclusive evidence of the proper appointment of that commissioner. B. Each Commissioner shall hold office for the term of his/her appointment and until his/her successor shall have been appointed and qualified. Any vacancy occuring in the office of a Commissioner, from any cause, shall be filled in the same manner as the original appointment but for the unexpired term. NO. O0-%& PAGE 2 5-3. Authority. The Carteret Redevelopment Agency shall have the responsibility to maintain, upgrade and create new affordable housing in the Borough and to plan, coordinate, monitor, evaluate and administer programs and activities designed to increase and improve the economic 6pportunities within the city and to operate programs to maintain, increase and foster commercial and industrial development, redevelopment and job promotion for the Borough. 5-4. Compensation. Commissioners shall receive no compensation. Commissioners shall be entitled to reimbursement for actual expenses necessarily incurred in the discharge of their duties, including reasonable travel expenses. 5-5. Quorum. Voting. Organization. By-Laws. Four (4) Cormmssioners shall constitute a quorum for the purpose of conducting - business and exercising powers; and for all other purposes. Action may be taken by the Agency upon the affirmative vote of the majority present, provided not less than four (4) Commissioners are present and voting, unless the Agency by-laws or statute requires a larger number. The Agency shall select a chairman and vice-chairman from among the Commissioners, and shall employ an executive director who shall be its secretary. The Agency shall adopt such by-laws as it deems necessary and appropriated for the conduct of business. 5.6. Conflict of Interest. No Commissioner or employee of the Agency shall acquire any interest, direct or indirect, in a redevelopment project or in property included or planned to be included in a project; nor shall they have any interest, direct or indirect, in any contract or proposed contract for materials and/or services to be furnished or used in connection with the project. In the event any Commissioner or employee of the Agency shall own or control any interest, direct or indirect, as described herein, he shall immediately disclose said interest, in writing to the Agency. Said disclosure shall then be entered into the Agency's minutes. Failure to make said disclosure shall as required herein shall constitute misconduct in office. A Commissioner or employee required to make disclosure described herein shall not participate in any action by the Agency affecting the property with which disclosure. NO. 00-54 PAGE 3 5.7 Removal. A Commissioner may be removed for inefficiency, neglect of duty or misconduct in office by the governing body which appointed him, provided that the Commissioner to be removed has been given a copy of charges, in writing, at least ten (10) days prior to the hearing thereon and has had the opportunity to be heard in person or by counsel. 5.8.
