CALL TO ORDER CITY COUNCIL TEMPLE CITY, CALIFORNIA REGULAR MEETING MINUTES OCTOBER 2, 2012 AGENDA ITEM 7.A.3 Mayor Pro Tern Sternquist called the City Council Regular Meeting to order at 7 :32 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember-Blum, Chavez, Vizcarra, Sternquist ABSENT : Councilmember-Mayor Yu ALSO PRESENT: City Manager Pulido, C ity Attorney Vail, Deputy City Clerk Bonus, Parks & Recreation Director Burroughs , Administrative Services Director Hause, Assistant to City Manager Haworth , Community Development Director Masura . Councilmember Blum moved to excuse Mayor Yu for cause, seconded by Councilmember Chavez. 3. INVOCATION Pastor David Palmer of First United Methodist Church , provided the Invocation . 4. PLEDGE OF ALLEGIANCE Pastor Palmer led those present in the Pledge of Allegiance to the Flag. 5 . CEREMONIAL MATTERS A. PRESENTATION City Council recognized the exchange students from Austral ia. Exchange Students: Sally Armsworth, lan Hansen, Kristi Warren, Danni de Ke izer, Tom Holdforth, Chantelle Mares. B. PRESENTATION City Council Minutes October 2, 2012 Page 2 Stephanie Wiggins, Executive Officer of Congestion Reduction Initiative with Los Angeles County Metropolitan Transportation Authority (Metro) gave a brief presentation on the Metro Express Lane Program . 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Peggy Miller, Temple City resident, commented that from the article in the City's Connect magazine, it looks like the City is endorsing the school's bond Measure F . Marv Kokayko. Temple City resident, commented that because three of the five Council attended a school district's bond measure event, it gives a perception that the City is endorsing the school's bond Measure F. 7. CONSENT CALENDAR Councilmember Blum pulled item 7E and 7F. Councilmember Vizcarra moved to approve the remainder of the Consent Calendar, seconded by Councilmember Chavez and unanimously carried . A. APPROVAL OF MINUTES The City Council is requested to review and approve : 1) Minutes of the Special City Council Meeting of September 12, 2012 ; 2) Minutes of the Regular City Council Meeting of September 18, 2012 ; and 3) Minutes of the Special City Council Meeting of September 26, 2012 Recommendation : Approve . B. PARKS & RECREATION COMMISSION ACTIONS -MEETING OF SEPTEMBER 19, 2012 The City Council is requested to review the Parks & Recreation Commission Actions of September 19, 2012. Recommendation : Receive and file. C. APPROVAL OF PERMITS FOR USE OF LOS ANGELES COUNTY PARKING LOT, LOCATED AT 5939 GOLDEN WEST AVENUE FOR THE 2012 FALL FESTIVAL AND 2013 CAMELLIA FESTIVAL For many years, the City has used the parking lot adjacent to the Los Angeles County Library, located at 5939 Golden West Avenue in connection with the Fall Festival and the Camellia Festival. The parking lot is used for the collector car show during the Fall Festival and for City Council Minutes October 2 , 2012 Page 3 carnival rides during the Camellia Festival. The City has requested use of the parking lot from 7 a.m . to 7 p.m . on October, 20, 2012 and from 8 a .m. February 20 through midnight February 24 , 2013 . City Council is requested to approve the permits for use of the Los Angeles County Library parking lot for the 2012 Fall Festival and the 2013 Camellia Festival and authorize staff to execute the permit. Recommendation: Approve permits for use of the Los Angeles County Library parking lot and authorize staff to execute the on-line permit process. D. 2013 GENERAL MUNICIPAL ELECTION The California Elections Code requires that certain resolutions be adopted in order to hold the City 's General Municipal Election on March 5, 2013. Under the provision of the City of Temple City Charter, elective officers of the City are elected to four year terms by the registered qualified voters of the City, on an at large basis, at a general or special municipal election held for that purpose. General municipal elections are conducted on the first Tuesday after the first Monday in March of odd-numbered years. The City Council is requested to adopt Resolutions No. 12-4856 through 12-4858 as well as to approve a Professional Services Agreement with Martin & Chapman Company . Recommendation : 1) Adopt Resolution No . 12-4856 (Attachment "A") calls the election, establishes the purpose for the election, authorizes the City Clerk to conduct the election, establishes precinct officer compensation, and sets the voting hours as 7:00a.m. to 8:00 p.m .; 2) Adopt Resolution No . 12-4857 (Attachment "8") is the City 's official written request for election services to the County Board of Supervisors. The City needs voter registration records, precinct information, and equipment available from the County of Los Angeles Registrar Recorder's Office . State law requires the City to submit a resolution to the County requesting election services; 3) Adopt Resolution No . 12-4858 (Attachment "C") outlines regulations for the candidates ' statements that are included in the sample ballot pamphlets and mailed to all registered voters of the City . As in the past, it is recommended statements submitted by candidates not City Council Minutes October 2, 2012 Page 4 exceed 200 words . Again in 2013, the City Clerk will print all translations of candidates' statements in the voter pamphlet in English, Chinese, and Spanish to comply with the Voting Rights Act; and 4) Approve an agreement Professional Services Agreement with M & C for the 2013 General Municipal Election and authorize the City Manager to sign the agreement in an amount not to exceed $40,000. G. ADOPTION OF RESOLUTION NO . 12-4859-APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No . 12-4859 authorizing payment of bills. Recommendation : Adopt Resolution No. 12-4859 E. BUDGET ALLOCATION FOR THE ROSEMEAD BOULEVARD SAFETY ENHANCEMENT AND BEAUTIFICATION PROJECT During the past two and a half years, the City has been diligently working to redesign Rosemead Boulevard from Callita Street (north) to the south side of the Union Pacific Railroad (UPRR) railroad tracks (south) in Temple City. This will transform Temple City's segment of Rosemead Boulevard from a regional highway into a pedestrian friendly corridor. Based on the current construction estimates provided by Gruen Associates, additional resources are necessary at this time to ensure that the construction budget remains consistent with the current design . The City Council is requested to approve the following budget amendments in order to increase funding for the construction portion of this project from $12,707,579 to $14,652,644 by using these funding sources: • Unallocated Gas Tax Fund Balance of $650 ,000; • Earmark Fiscal Year 2013-14 Proposition C funds (taxed passed used for transportation funding) of $448 ,000 ; • Earmark Fiscal Year 2013-14 Measure R funds of $336 ,440; and • Economic Development Reserve or Unappropriated General Fund Balance for $510,625. Staff answered Council 's questions regarding the project's budget. City Council Minutes October 2, 2012 Page 5 Gino Bernago, Temple City resident, asked if this project would have an impact to the business owners along Rosemead Boulevard . Councilmember Blum moved to approve the budget allocation to fully fund the Rosemead Boulevard Project, seconded by Councilmember Vizcarra and unanimously carried. F. SERVICES AND LICENSE AGREEMENT WITH CIVIC PLUS FOR A NEW CITY WEBSITE The City website was developed in-house nine years ago using the now defunct Microsoft FrontPage platform. Although its functionality may have been adequate then, technology and constituent demand for public information has significantly changed. In fact, the current website is antiquated by internet standards and does not include even the basic features of today's government websites. As one of the organization's most important tools for sharing information, the City website, especially in the last few years, has become a heavily utilized resource that provides readily available information to the public seven days a week, 24 hours a day. The City Council is requested to authorize the City Attorney to finalize a service and license agreement with CivicPius to design, develop and implement a new City website and authorize the City Manager to execute the agreement with CivicPius. Assistant to City Manager Haworth gave a brief summary of his staff report. Jerry Jambazian, Temple City business owner, expressed concerns about the security and cost effectiveness of the new Website. Councilmember Blum moved to approve to authorize the City Attorney to finalize a service and license agreement with CivicPius to design, develop and implement a new City website and authorize the City Manager to execute an agreement with CivicPius at a cost not to exceed $35,082, seconded by Councilmember Vizcarra and unanimously carried . 8. UNFINISHED BUSINESS A. SECOND READING AND ADOPTION OF ORDINANCE NO . 12-962, AN ORDINANCE AMENDING SECTION 9296 REDUCING THE SIZE OF NON-RESIDENTIAL PARKING, CREATE STANDARDS FOR COMPACT PARKING, AND ADD STANDARDS FOR BICYCLE AND MOTORCYCLE PARKING IN TITLE 9, CHAPTER 1, ARTICLE J OF THE CITY'S City Council Minutes October 2, 2012 Page 6 MUNICIPAL CODE; AND MODIFYING SECTION 9291 REMOVING REQUIRED PARKING FOR OUTDOOR DINING IN TITLE 9, CHAPTER 1, ARTICLE J OF THE CITY'S MUNICIPAL CODE Over the past year, the City Council, Planning Commission and Public Safety Commission have expressed interest in the need to review and update the City's parking codes and standards, due in part to on-going issues with the shortage of parking in the City's downtown, as well as parking challenges in other commercial centers in the City . The proposed modifications to reduce the size of non-residential off street parking, allow compact parking , establish standards for motorcycle and bicycle parking , and remove the parking requirement for outdoor dining would provide additional opportunities for the City to address parking shortages, attract national tenants, and create more pedestrian friendly environments . Community Development Director Masura and Adam Gulick gave an overview of the staff report . Marv Kokayko: Question regarding outdoor dining and the removal of parking. Councilmember Blum made a motion to waive further reading and adopt Ordinance No. 12-962 by title only, an ordinance amending section 9296 reducing the size of non-residential parking, create standards for compact parking, and add standards for bicycle and motorcycle parking in title 9 , chapter 1, article j of the city 's municipal code; and modifyi ng section 9291 removing required parking for outdoor din ing in title 9 , chapter 1 , article j of the city's municipal code seconded by Councilmember Chavez and unanimously carried . 9. RECESS TO SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY MEETING At 8:27 p.m ., the City Council recessed to the Successor Agency Meeting . RECONVENE AS CITY COUNCIL The City Council meeting was reconvened at 8:29p.m. with all Councilmembers present. City Council Minutes October 2, 2012 Page 7 12. ACTION ON REQUEST BY SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY-None 13. UPDATE FROM CITY MANAGER The City will begin the recruitment for the Public Art Commission. Applicants must live or work in Temple City and must be 18 or older. The Application will be available Friday. The position serves two year terms without compensation. Holiday donation drive begins next week and donated items are distributed to various locations. 14. MATTERS FROM CITY OFFICIALS-None 15. COUNCIL REPORTS REGARDING AD HOC OR COMMISSION MEETINGS Councilmember Chavez reported on the CityfTCUSD Standing Committee meeting, the Public Arts Advisory Group meeting and the Youth Committee meeting . Councilmember Vizcarra added that the idea of fountains in the park was discussed during the Public Arts Advisory Group meeting. 16. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER BLUM Announced that $70,000 was granted to our City by Supervisor Antonovich to plant trees citywide. Commented that preventative measures must be taken at the Rosemead/Las Tunas Gateway Project to reduce dust kick up from the Santa Ana winds. B. COUNCILMEMBER CHAVEZ Would like periodic construction updates from staff regarding the Rosemead/Las Tunas Gateway Project. He thanked Director Cathy Burroughs and Administration Coordinator Debbie Ingram for the Sister Cities plaques. C. COUNCILMEMBER VIZCARRA Announced that the Public Arts Advisory Group has been discussing relocating the current mural and are formulating ideas for a new mural. The public is encouraged to submit any designs and ideas pertaining to Temple City and California. City Council Minutes October 2 , 2012 Page 8 D. MAYOR PROTEM STERNQUIST Commented that for the selection of the Public Arts Commissioners, she would like to allow for a bigger pool of applicants and for the commissioners to be chosen by other Public Arts Commissioners from neighboring Cities . ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Mary Kokayko, Temple City resident, commented that she is thankful for the Cooling Center which provided cooling for 13 residents. Jerry Jambazian, Temple City business owner, commented about funds from Proposition C and Measure R ear marked for the Rosemead Boulevard Safety Enhancement and Beautification Project. Asked if this would be taking away money from future projects . Jim Cliff, Temple City resident, spoke about the school's bond Measure F and how the City is presenting the information to the Public.
