Mayor Smith called the meeting to order at 6:06 p.m.
1. Regular Meeting: Roll Call
2. Approval of Agenda:
Trustee Cwiklin moved, and Trustee Naill seconded the motion to approve the Agenda.
Motion carried: 7-0.
3. Executive Session: For a conference with Special Counsel for the purpose of receiving
legal advice on specific legal questions under C.R.S. Section 24-6-402(4)(b) and for the
purpose of determining positions relative to matters that may be subject to negotiations,
developing strategy for negotiations, and/or instructing negotiators, under C.R.S. Section
24-6-402(4)(e) regarding Byers Peak Ranch and to include Special Counsel Ferguson,
Town Manager Durbin, Public Works Director Nordin, Town Planner Trotter and Finance
Manager Havens.
Open: 6:07 p.m.
Trustee Cwiklin moved, and Trustee Sumrall seconded the motion to enter into
executive session. Motion carried: 7-0.
Exit: 7:14 p.m.
Trustee Naill moved, and Trustee Sumrall seconded the motion to exit executive
session. Motion carried: 7-0.

I. Petition for Annexation for Byers Peak Ranch for the Annexation of
Territory to the Town of Fraser;

111. Application for an Amendment to the Official Zone Map for PDD Zoning
and Approval of PDD Plan for Byers Peak Ranch
IV. Application for Approval of Vested Rights as set forth in the Annexation
Agreement;
V. Application for Approval of Development Permit for Colorado Adventure
Park;
VI. Application for Approval of a Subdivision Exemption;
VII. Approval of Amendments to Service Plan for the West Mountain
Metropolitan District.
VIII. Approval of Grading and Excavations Plan
Trustee Surnrall moved, and Trustee Shapiro seconded the motion to open the
continued public hearing on Byers Peak Ranch. Motion carried: 7-0.
SC Ferguson briefed the audience on the annexation petition and subsequent
agreements.
Public comments were taken.
Trustee Surnrall moved, and Trustee Cwiklin seconded the motion to continue the
public hearing on April 3, 2013. Motion carried: 7-0.
