Kr. Al.Coatsworth petitioned for permission to operate a loud-
speaker on Tybrisa Pavilion, offered to give the Town advertising,
and pay 2.50 per week license. No action was taken at this time.
Councilman Tant moved that the following persons be appointed
managers for the election to be held on Monday, July llth,
Councilman `Mayer seconded and the motion passed unanamously;

Mrs. 'Sarah L.Oirry.
Councilman Tant moved that the following resolution be adopted,

RESOLJTION
WHEREAS, on the tenth (10th) day of June, 1938, an election was
called bybthe Mayor and Councilmen of Savannah Beach, Tybee
Island, for the issuance of bonds. 6aid election to be held on
the eleventh (11th) day of July, July, 1938, and
WHEREAS, Charter of Town of Savannah "Beach, Tybee Island, requires
said election be supervised and managed by three (3) freehcilders,
all of whom must be duly qualified voters of said Town and shall
be named by the Mayor and Councilmen of said Town at least ten
(10) days prior to date of election.
NOW THEREFORE, be it resolved by the Mayor and Councilmen of
Savannah Beach, Tybee Island, in Council assembled and it is hereby
resolved by authority of the same that the Mayor and Councilmen
of Savannah Beach, Tybee Island, does now name the three freeholders,
Mitchell R.Young, Mrs. Margaret Southard, Mrs Sarah L. Cu rry, all
of whom are duly qualified voters of Said Town to manage and su-
pervise the bond election, which will be held on the eleventh
(11th) day of July, 1938, between the hours of ten (10) o'clock
in the forenoon and five(5) o'clock in the afternoon.
A comparative statement of finances of the Town showed that for
the same period, 1938 was behind 1937, $ 2678.00, it was suggested
back licenses and taxes be collected, Councilman Haar suggested
reducing the license on trade vending machines.
It was decided to take a recess until 5:00 p.m. July llth on
motion made by Councils Mayer, seconded by Councilman Tant, and
passed.

The recessed meeting of July 6th was resumed to -day at 6:00
p.m. in the Council Chamber, and cgs attended by Mayor McMillan,
who presided, and Councilman Kreitzer, May, Myer, Farrell, Haar,
Tant, Town Attorney Dutton, and the the three managers of the
election Mitchell R.'oung, Mrs. Margaret Southard, Mrs. Sarah
L. Curry.

Councilman'Kreitzer moved that the following resolution be adopted,
Councilman Haar;deconded, and the motion passed unanambusly;
RESOLUTION.
WHEREAS, on the 10th day of June, 1938, the Town Council of the
Mayor and Councilman of the Town of Savannah ijeach, Tybee island,
passed a resolution and an order ordering an election to be held
in the Town of Savarnah Beach, Tybee Iclaand for the purpose of
submitting to the qualifed voters of the said munici:: ality on the
llth day of July, 1938, the question of determining whether or not
bonds in the tbtal sum of thirty thousand (30,000) dollars should
be issued by said municipality, and
WHEREAS, on the llth day of July, 1938, said election was held
in the Town of Savannah Beach, Tybee Island, in accordance with
provisions of the constitution of Georgia and in accordance with
the laws of the State of Georgia, of the Town of Savannah Beach, Ty-
bee Island controlling and regu,1ating;said election and,
WHEREAS, the returns odr said election show prima facie that said
election was in favor of incurring such debt by issue of bonds. The
results of said election Ming as follows:

WHEREAS, on the 12th day of July, 1938, in accordance with a
resolution', passed and adopted by the Mayor and Councilmen of the
Town of Savannah Beach, Tybee Island the Honorable Samuel A.
Cann, Solicitor General of the Eastern Judicial Circuit of
Georgia, was notified to bring a petition as required by law in
the Superior Court of Chatham County, Georgia, fLr the validation
of said bonds, and,
;WHEREAS, the Honorable Samuel A.Cann, Solicitor General of the
Eastern Judicial Circuit of Georgia was served with said notice and
he prepared and tendered to the Honorable John Rourke, jr., Judge
of the Superior Court, Chatham County, Georgia, two separate petie
tions for the validation of said bonds, one petition for bonds in
the sum of twenty -eight thousand 1 28,000) dollars, the proceeds
of which shall be used by the Town of Savannas. Beach, Tybee Island
to correct and prevent erosion to be used for the improvement of
the beach and to stop erosion; second petition for bonds in the
sum of two thousand (2,000) dollars the proceeds of which are to
be used by the Town of Savannah Beach, Tybee Island for the erection
of new Town Hall, and,
WHEREAS, the Honorable John Rourke, jr., Judge of Superior Court
of Chatham County, Georgia, has the said validation proceedings un-
der consideration, and,
WHEREAS, it will be necessary for the Town of Savannah `each, Tybee
Island, to have the proceeds form said bonds immediately in order
that they can match funds with the Works Progress Administration
in beginning the work as outlined in the Notice to the public the
election, which was passed by the Mayor and Councilmen of the
Town of Savanah Beach, Tybee Island, on the 10th day of June, 1938.

NOW, THEREFORE, be it resolved by the Mayor and Councilmen of the °
Town of Savannah Beach, Tybee Island, in Council assembled, that bids
be advertised Once a week for two weeks in the Savannah :evening
Press, a newspaper in which Sheriff's advertisements are inserted
and published for the sale of tine said bonds, subject to the vali-
dation by the Judge of the Superior Court, and that the bids be sealed
and opened in the presence of the I Mayor and Councilmen of the
Town of Savannah 'each, Tybee Island, on the 26th day of July, B1938,
at the Council Chamber at Savannah Beach, Tybee Island, and the
bonds be sold to the highest bidder. The Mayor and Councilmen of
the Town of Savannah 'leach, Tybee Island, reserve the right to
reject any and all bids.
Councilman Mayer moved that the following resolution be adopted,

The Mayor and Councilmen of the Town of Savannah
Beach, Tybee Island, a municipal corporation in Chatham County,
Georgia, and of the State of Georgia desiring to incur a bonded
debt, as prescribed in paioragraphs One and Two of Section 7,
Article 7, of the Constitution of the State of Georgia, held an
election on the llth day of July, 1938, in accordance with.the pro-
visions of the Constitution of Georgia and in accordance with the
laws of the State of Georgia and of the Town of Savannah Beach,
Tybee Island, controlling and regulating such election, add the
return of said election show prima facie that such election was
in favor of incurring such debt by issuing bonds.

Beach, Tybee Island, being the officers of said Town, charged by
law with the duty of declaring the result of the election, with -

WHEREAS, on the 10th day of June, 1938, the Mayor and Councilmen

ficers charged by law with levying taxes, contracting debts, and

managing the affairs of the Mayor and Councilmen of the town of
Savannah Beach, Tybee. Island, a municipal corporation in Chatham
County, Georgia, passed a resolution and order calling for an
election to be held in said town of Savannah Peach, Tybee Island,
as provided by law, on the llth day of July, 1938, for the purpose
of submitting to the qualified voters of said town of Savannah
3each, 'ybee Island, the questionof determining whether or not
the Mayor and " ouncilmen of the town of'- avannah Beach, Tybee
Island,would issue bonds as fouls;
1. BONDS, the proceeds of nhich shall be used by the
town of Savannah Beach, Tybee Island, to correct and prevent
erosion, to be used for the improvement of the beach and to s`

AND WHEREAS, the said Mayor and Councilmen of the town of Sav-

in the Savannah Evening Press on June 11, 18, 25, and on July
2, 1938, a space of thirty (30) days next preceeding the date of
said election, that being the newspaper published in Chatham
County, Georgia in which the Sheriff's advertisements are pub -
lished, notifying the qualified voters of the said town that on
the day arced, to -wit; Julyp.11, 1938, an election was held
to determine the question of whetter the said bonds should be
issued by said town, the said notice dontaining all the specifies
cations and information required by law.
AND WHEREAS, said election was held on the said llth day of
July, 1938, in accordance with said resolution and order and
notice, as required by law, each proposed issue of bonds being voted
upon separately;
AND WHEREAS, the several managers of said election brought in
the returne from the precinct„ as required by law, which returns
have been made to the Mayor and Councilmen of the Town of Savannah
Beach, Tybee Island, they being the officers calling and ordering
said election; and
IT APPEARING to the Mayor and Councilmen of the Town of Savannah
Beach, Tybee Island and to the managers of said election who brought
up said returns, as provided by law, in joint assembled, who in
the presence of andttogether wfth each other canvassed and conso-
lidated said returns, that said election was in the regulare voting
presinct in said town and that said election was held by the
same persons and in the same manner and under the same rules and
regulations that elections for officers of said town are held:
AND WHEREAS, the said Mayor and Councilmen of the town of Savannah
Beach, Tybee Island and the several managers in said election who
brought in the returns in the presence of together with each other,
consolidated said returns and the said result of the said election
to be as follows:

AND IT FURTHER APPEARING, from the registration list of said town
ascertified by the Clerk of Council and as furnishbd to and used
by the managers of said election, which registration list was
filed with said returns of said managers that the total number
of registered voters of said town are

aforesaid that bore than two- thirds of the registered voters
of said town voting at said election voted for said bonds and
each issue thereof, and that two - thirds of those so voting
were a majority of all the registered voters of said town:

AND IT FURTHER APPEARING that said officers calling and ordering
said electign,namesly, the Mayor and Councilmen of the Town of
Savanah Bea h, Tybee Island, in the presence of and together
with the said several managers of said election did declare the
said election to be in favor of issuing said bonds, to -wit:
1. BONDS, THE PROCEEDS OF WHICH SHALL BE USED BY THE
Town of Savannah Beach, Tybee Island, to correct and prevent ero-
sion, to be used fo the improvement of the beach and to stop
erosion in the sum of $ 28,000.00.
2. BONDS, the proceeds of which shall be used by the
Town of Savannah Beach, Tybee Island, for the erection of a
new Town Hall in the sum of $ 2,000.00.
THEREFORE, IT IS ORDERED, that said election is in favor of the
issuance of said bonds and each issue thereof.
AND IT IS FURTHER ORDERED, that the consolidated returndsof the
said election and this resolutio# be entered upon the minutes of
Council of the mayor and Councilmen of the Town of Savannah Beach,
Tybee Island.
