ORDINANCE NO.
AN ORDINANCE ADOPTING A CURB AND GUTTER
REPLACEMENT PROGRAM POLICY FOR THE CITY OF
RICHLAND HILLS, TEXAS; PROVIDING A SEVERABILTTY
CLAUSE; AND PROVIDING AN EFFECTT~7E DATE.
WHEREAS, the City Council of the City of Richland Hills, Texas, has
determined that a program for replacement of curbs and gutter facilities within the
city would be in the best interest of the citizens of the City of Richland Hills,
Texas; and
WHEREAS, the City Council finds an determines that the attached Curb and
Gutter Replacement Program Policy will best serve those interests.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
I.
That the document attached hereto and entitled "Curb and Gutter Replacement
Program Policy -City of Richland Hills" is hereby adopted by the City Council as
• the curb and gutter replace program policy for the City of Richland Hills, Texas.
II.
Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
III.
Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Richland Hills City Charter and the
laws of the State of Texas.
PRESENTED, GNEN FIRST READING AND APPROVED at a regular meeting
of the Richland Hills City Council on the 11th day of January , 1994, by a vote
of 5 ayes, 0 nays, and 0 abstentions.

CURB AND GUTTER REPLACEMENT PROGRAM POLICY
• CITY OF RICHLAND ffiLLS
The purpose of this directive is to set forth City policy as it relates to the Curb and Gutter
Replacement Program.
STATEMENT OF POLICY
The City Council may from time to time allocate funds for a Curb and Gutter Replacement
Program. This program shall be executed in accordance with this policy.
GENERAL
1. The City Engineer is assigned the responsibility for coordination and implementation
of this policy.
2. Upon inclusion of funding in a given year's budget, the City Engineer will begin to
develop a recommended priority list of locations for replacement. This list shall be
developed from the previous year's City Council approved priority listing of locations
not constructed as a base line list (the initial year's program shall use a March 1993
consultant study regarding street condition as a base line list). Then citizen requests
on file and Public Services Department recommendations shall be reviewed for
• inclusion.
3. The City Engineer shall develop and maintain a procedure for receiving and
documenting citizen requests for inclusion in the program.
4. During the development of the recommended priority list, the citizens shall be notified
of the process via the newsletter and given opportunity to comment. This period shall
not be less than 30 days from the distribution date of the newsletter.
5. The City Council shall approve the year's final priority list.
6. Drive approaches shall be replaced only where proper drainage requirements dictate
the need as determined by the City Engineer and only to the extent necessary to match
existing infrastructure grades. The remainder of the drive approach within the City
right-of-way, upon request of the property owner, may be replaced by the City as a
part of the same contract at the sole cost of the property owner for the additional
improvements.
7. Based upon the City Council approved final priority list and available funding as
approved by the City Council in an annual budget, the City Engineer shall prepare bid
documents for advertisement.
