HomeMy Public PortalAboutOrdinance No. 708-94 01-11-1994 ORDINANCE NO. 7 ~ ~ - ~ a AN ORDINANCE AMENDING SECTION 4 "CRIlVIE PREVENTION ADVISORY BOARD" OF CHAPTER 13 "ADVISORY BOARDS" OF THE CODE OF ORDINANCES OF THE CITY OF RICHLAND HILLS, TEXAS, AS AMENDED, TO REDUCE THE NUMBER OF MEMBERS OF SAID CRIlVIE PREVENTION ADVISORY BOARD TO FIVE (5) MEMBERS; MODIFYING APPOINTMENT PROCEDURES; PROVIDING A SEVERABILTTY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Richland Hills Crime Prevention Advisory Board is presently composed of ten (10) members; and WHEREAS, the Committee has been unable to conduct its business in recent months because of its inability to assemble a quorum of its members for its regular meetings; and WHEREAS, the Chairman of the said Crime Prevention Advisory Board has recommended that the membership of the Board be reduced from ten (10) members to five (5) members in order that the Advisory Board may perform the duties and tasks assigned to it. • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Subsection B "Composition, Appointments and Terms of Members" of Section 4 "Crime Prevention Advisory Board" of Chapter 13 "Advisory Boards" of the Code of Ordinances of the City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: B. COMPOSITION APPOINTMENTS AND TERMS OF MEMBERS (1) The Crime Prevention Advisory Board shall be composed of five (5) members who shall hold designated places 1-5. Each councilmember shall be entitled to nominate persons to serve on said board in the numbered place corresponding to the numbered place on the City council held by said councilmember. All nominations shall be approved unless rejected by the affirmative vote of four (4) councilmembers. Members of the board shall serve terms of two years, corresponding to the term of the councilmember whose place corresponds to the numbered place held by the individual member. (3) Due to the sensitive nature of the information provided to the board and of the matters considered by said board, applicants for membership shall be subject to background checks prior to their appointment. II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 13 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as • amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
