AN ORDINANCE AMENDING SECTION 5 "PLUMBING CODE"
OF CHAPTER 3 "BUILDING REGULATIONS" OF THE CODE
OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS, AS
AMENDED, TO ADOPT THE 1991 VERSION OF THE
UNIFORM PLUMBING CODE; ADOPTING CERTAIN PERMIT
FEES AND INSPECTION FEES; PROVIDING A PENALTY FOR
VIOLATION OF UP TO $500.00 PER DAY; PROVIDING A
SEVERABILTTY CLAUSE; PROVIDING A SAVINGS CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Richland Hills, Texas, has
previously adopted the Uniform Plumbing Code, 1985 Edition; and
WHEREAS, a 1991, updated edition of the Uniform Plumbing Code has been
promulgated; and
WHEREAS, the City Council of the City of Richland Hills, Texas, finds and
determines that the health, safety and general welfare of its citizens will be best
served by the adoption of the updated, 1991 version of the Uniform Plumbing Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
I.
That Subsection A "Uniform Plumbing Code Adopted" of Section 5 "Plumbing
Code" of Chapter 3 "Building Regulations" of the Code of Ordinances of the City of
Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as
follows:
A. UNIFORM PLUMBING CODE ADOPTED
The Uniform Plumbing Code, 1991 Edition, including Appendices A, B, C,
D, E, H and I, is hereby adopted as the Plumbing Code for the City of
Richland Hills, Texas, and such Code is hereby incorporated herein by
reference as if set forth at length. A copy of said Uniform Plumbing
Code shall be available for public inspection in the office of the Building
Official.
II.
That Subsection B "Amendments to Uniform Plumbing Code" of Section 5
"Plumbing Code" of Chapter 3 "Building Regulations" of the Code of Ordinances of
the City of Richland Hills, Texas, as amended, be hereby amended by the inclusion
of a new Paragraph 1 therein, which paragraph shall hereafter be and read as
follows:
(1) Table Number 3-A "PLUMBING PERMIT FEES" as contained in the Uniform
Plumbing Code adopted hereby is hereby amended to hereafter be and read as
follows:

III.
That Section 5 "Plumbing Code" of Chapter 3 "Building Regulations" of the
Code of Ordinances of the City of Richland Hills, Texas, as amended, be hereby
amended by the addition thereto of anew Subsection C "Registration Fee and
Requirements", which new Subsection shall hereafter be and read as follows:
C. REGISTRATION FEE AND REQUIREMENTS
All plumbing and irrigation contractors shall register with the City
annually, and shall pay a registration fee therefor of $30.00 per calendar
year.
All plumbers and irrigators who shall desire to perform work within the
City shall hold a valid and current state license and a copy of same shall
be presented to the City of Richland Hills at the time of registration.
No homeowner permit will be allowed after the effective date of this
ordinance.
IV.
Penalty Clause. Any person, firm or corporation who shall violate any of the
provisions of the Uniform Plumbing Code adopted by this section, or who shall do or
attempt to do plumbing work without first securing the permit prescribed herein for
such work, or who shall in any other manner violate the provisions of this section
shall be guilty of a misdemeanor, and upon conviction thereof shall be fined in an
amount not to exceed $500.00, and each day or fraction of a day that an offense
hereunder is committed or permitted to exist shall constitute a separate offense
and be punishable as such hereunder.
V.
Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
VI.
Saving Clause. That Chapter 3 of the Code of Ordinances, City of Richland
Hills, Texas, as amended, shall remain in full force and effect, save and except as
amended by this ordinance.

VII.
Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Richland Hills City Charter and the
laws of the State of Texas.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting
of the Richland Hills City Council on the llthday of January, 1994, by a vote
of 5 ayes, 0 nays, and 0 abstentions.
