RESOLUTION AUTHORIZING USE OF STORM RECOVERY RESERVES
PURSUANT TO N.J.S.A. 40AA -62.1
WHEREAS, an emergent condition developed throughout March of 2020 as a result
of the spread of coronavims (COVID-19) in the State of New Jersey; and
WHEREAS, on March 9, 2020 Governor Phil Murphy issued Executive Order No. 103
declaring a Public Health Emergency and State of Emergency throughout the State of
New Jersey; and
WHEREAS, on March 16, 2020 Governor Phil Murphy issued Executive Order No. 104
imposing numerous restrictions throughout the State pursuant to the prior declaration of a
state of emergency; and
WHEREAS, N.J.S.A. 40AA -62.1 permits the Borough to authorize the use of funds in
its storm recovery reserve for any purpose necessary to protect the safety, security,
health, and welfare, of its citizens from the damage caused by the declared emergency.
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of
Carteret that the use of funds in the Borough's storm recovery reserve is hereby
authorized for any propose necessary to protect the safety, security, health, and welfare,
of Borough citizens from the damage caused by the declared emergency.
BE IT FURTHER RESOLVED that pursuant to N.J.S.A. 40A:4 -62.1, any
reimbursement of these expenditures shall be deposited back into the reserve.
BE IT FURTHER RESOLVED that the Mayor and Appropriate Borough Officials are
hereby authorized to undertake such acts as are reasonable and necessary to accomplish
the purposes of this Resolution.
