Acct. #: C- 04 -16- 108 -201 NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from Maser Consulting for professional planning and surveying services with regard to the NJDEP ONRR Grant, River Walk Phases 2.0 & 3.0, additional permitting/approvals and additional engineering design & construction does at a total cost not to exceed $10,000.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:11- 5(1)(a) awarded pursuant to the Borough's Fair and Open process as authorized by law. 3. A copy of this Resolution be forwarded to the Borough's Purchasing Department, Director of Engineering and Maser Consulting. These additional services were not included in our original proposal (dated April 25, 2017, revised May 31, 2017) authorized by the Borough of Carteret. Our original proposal (copy attached) was based on a concept of the northern section of the River Walk provided by the Borough. Subsequent to that proposal, the concept changed impacting design and permitting efforts. Specifically, two piers and an elevated walkway were added over the water that impacted design and permitting. Also, the observation deck (T &M plans) needed to be incorporated into our plans which required more work. This proposal is divided into four sections as follows: Section I — Scope of Services Section II — Business Terms and Conditions Section III — Technical Staff Hourly Rate Schedule and Reimbursable Expenses Section IV — Client Contract Authorization The following scope of services has been separated into phases so that it may be more easily reviewed. The order in which the phases are presented generally follows the sequence in which the project will be accomplished; however, depending on the project, the various authorized services contained in this proposal may be performed in a sequence as deemed appropriate by Maser Consulting to meet project schedules. Reiman, Mayor MC Proposal No. 17001048P Revised August 20, 2019 Page 2 of 5 SECTION I — SCOPE OF SERVICES We are requesting approval of the following additional services, some of which are in progress and others to be performed: PHASE 2.0 ADDITIONAL PERMITTING(APPROVALS 2.1 U.S. Army Corps of Engineers Permit — Observation Deck, elevated walkway and piers Phase 2.0 of our original proposal did not include submission to the U.S. Army Corps of Engineers ( USACE). The original scope had all improvements upland of the main high water line and as a result, only NJDEP approval was required at that time. Under Section 10 of the Rivers and Harbors Act of 1899, USACE regulates all structures located below the mean high - water line in navigable waters of the United States. The Arthur Kill is classified as a navigable water. Therefore, a Section 10 permit will be required from the USACE for the construction of the two piers, observation deck, and elevated walkway. Our office has prepared and submitted an application for a Section 10 permit in accordance with USACE standards. Phase 2.0 Lump Sum Fee $4,650.00 PHASE 3.0 ADDITIONAL ENGINEERING DESIGN & CONSTRUCTION DOCUMENTS 3.1 Structural Engineering Design & Construction Documents Our office has prepared design drawings for the following structural elements that were not in the original scope of work outlined in our original proposal. These items are now part of the planned improvements for River Walk, Phase 2 — Northern Section, Carteret: • Walkout Loop over water of elevated walkway (approx. 450', this section extends out over water) • Two (2) piers extending out into the water (approx. 130' long) • Ramp systems as required for piers • Miscellaneous site structural Included are structural drawings of the above elements with preliminary sizing and layout as required to illustrate at the permit -level phase, and as were included in the submission for waterfront permits. Our structural drawings supplement the civil drawings of the project. Daniel J. Reiman, Mayor MC Proposal No. 17001048P Revised August 20, 2019 Page 3 of 5 The project's intention is to construct a new elevated timber walkway that would traverse along (and above) the waterfront slope that abuts Arthur Kill. Further, the project includes several offshoots from the walkway including two piers. The grade change between the elevated main walkway and the deck and piers will be quite large and will require an extensive ramping system to meet barrier free requirements. Included is a code - compliant layout of the walkway systems that blends with the waterfront environment while achieving all of the goals the Borough has for the walkway. Permit -level drawings include required plans, sections and details. The designs are preliminary, and if permit approval is granted, all structural design elements for these additional items will be finalized. 3.2 Revised Permitting Plans per T &M Associates Observation Deck, and Grading Plan changes Maser Consulting had completed the permit plans for submission to the NJDEP when changes were required of the plans. The first change was to incorporate the observation deck and ferry terminal plans prepared by T &M Associates. This included changes to the plans to incorporate the design provided by T &M into the Maser Consulting plans as well as to update the prepared NJDEP and USACE reports for submission. In conjunction with inclusion of the T &M plan, Maser Consulting was provided with a revised final grading plan by Geosyntech and approved by the Borough. This raised portions of the site by as much as 16" and required a regrading of the Riverwalk, revising of the ADA access and updating the prepared profiles. Phase 3.0 Lump Sum Fee SCHEDULE OF FEES $5,350.00 For your convenience, we have broken down the total estimated cost of the project into the categories identified within the scope of services. PHASE 2.0 ADDITIONAL PERMITTING /APPROVALS $ 4,650.00 PHASE 3.0 ADDITIONAL ENGINEERING DESIGN & CONSTRUCTION DOCS 5,350.0 TOTAL LUMP SUM FEE $10,000.00 This Contract is based upon the previously accepted Maser Consulting's Business Terms and Conditions which was provided. Therefore, any service associated with the following items is specifically excluded from the scope of professional services within this agreement: • Services not specifically outlined above in Section 1; • Boundary and Topographic Surveys; • ALTA/ACSM Land Title Survey; • Construction Administration/Observation; • Property Title Search; • Easement Preparation • Geotechnical Services; • Environmental Remediation Services; • Architectural Services; • offsite utility design; • Exploratory or testing work, interpretations or conclusions related to determination of potential chemical, toxic, radioactive or other type of contaminants on the site; • Subdivision or lot consolidation plans; • Application fees and escrow deposits to any regulatory review agencies; and, • Changes or revisions beyond our control or changes in basic concept after design service has been accomplished; If an item not listed herein, or otherwise not specifically mentioned within our scope, is deemed necessary, Maser Consulting may prepare an addendum to this proposal for your review, outlining the scope of additional services and associated professional fees with regard to the extra services. SECTION II — BUSINESS TERMS AND CONDITIONS This Contract is based upon the previously accepted Maser Consulting's Business Terms and Conditions which was provided in our original proposal dated April 25, 2017 and Revised May 31, 2017 .
