AN ORDINANCE AMENDING CHAPTER 10 "TRAFFIC
REGULATIONS" OF THE CODE OF ORDINANCES, CITY OF
RICHLAND HILLS, TEXAS, BY THE ADDITION THERETO OF
A NEW SECTION 40 "H.E.A.T. PROGRAM; FEE
AUTHORIZED' ; AUTHORIZING THE IMPOSITION OF A $2.00
USER FEE FOR PARTICIPATION IN THE H.E.A.T.
PROGRAM; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVING CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, automobile theft is a growing problem in the Dallas/Fort Worth
Metroplex and the State of Texas; and
WHEREAS, a growing number of automobiles stolen in the Dallas/Fort Worth
Metroplex area are taken across the international border into Mexico for sale, often
within a few hours of the theft; and
WHEREAS, the Texas Department of Public Safety has established the Texas
H.E.A.T. (Help End Auto Theft) Program, a voluntary statewide automobile
registration program in which decals are affixed to the owner's vehicle indicating the
owner's written consent for a police officer to stop the vehicle when found occupied
on the streets anywhere in Texas between 1:00 a.m. and 5:00 a.m.; and
WHEREAS, the City Council of the City of Richland Hills, Texas, has
determined that the Texas H.E.A.T. Program should be made available to the
citizens of Richland Hills through the Richland Hills Police Department; and
WHEREAS, the City Council of the City of Richland Hills, Texas, has further
determined that a nominal fee of $2.00 per vehicle should be collected by the
Richland Hills Police Department from each registrant in order to cover the cost of
the decals necessary for operation of the Texas H.E.A.T. Program, with the provision
that payment of such fee entitles the registrant to participate in the program for a
four-year period.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
I.
That Chapter 10 "TRAFFIC REGULATIONS" of the Code of Ordinances, City of
Richland Hills, Texas, as amended be hereby amended by the addition thereto of a
new Section 40 "H.E.A.T. PROGRAM; FEE AUTHORIZED", which new section shall
hereafter be and read as follows:
SECTION 40 H.E.A.T. PROGRAM; FEE AUTHORIZED
• The Richland Hills Police Department shall collect a fee of $2.00 per vehicle
from each registrant in the Texas H.E.A.T. (Help End Auto Theft) Program
administered within the City of Richland Hills. Said fee shall be retained and

used for purchase of supplies and to defray other costs of administering the
Texas H.E.A.T. Program within the City of Richland Hills. Payment of said
$2.00 fee allows the registrant's vehicle to be placed in the program for a period
of four years.
II.
Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
III.
Saving Clause. That Chapter 10 of the Code of Ordinances, City of Richland
Hills, Texas, as amended, shall remain in full force and effect, save and except as
amended by this ordinance.
IV.
• Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Richland Hills City Charter and the
laws of the State of Texas.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting of
the Richland Hills City Council on the 1 nth day of September 1994, by a vote
of 5 ayes, 0 nays, and ~ abstentions.
