PROFESSIONAL SERVICES CONTRACT FOR
ENGINEERING SERVICES - SPRING PAVING PROJECT
WHEREAS, there exists a need for Professional Services to prepare
plans and specifications for a spring paving project as set forth in the
attached~e A; and
WHEREAS, pursuant to N.JS.A. 40A:11-5 (1) (a) Professional
Services are exempt from the requirements of competitive bidding;
and
WHEREAS, the local Finance Officer has certified that funds are
available;
NOW, THEREFORE, BE IT RESOLVED that Mayor and Council
of the Borough of Carteret does hereby approve the appointment of
Killam & Associates at a maximum cost of not to exceed $27,000.00
billable per attached contract;
BE IT FURTHER RESOLVED, that the Mayor and Borough Clerk
are hereby authorized to execute said contract;
IT IS FURTHER RESOLVED, that the contract is awarded without
competitive bids in accordance with NJ. SA 40A:11-5(1) )a) due to the
specialized and professional nature of the services provided.

· Shorecrest Park (Skate park surface)
· Shorecrest Park (B,~sketba~l court)
Plans and specifications will be prepared to allow receipt of bids for this project on May
21~ 1998.
Authorization is further requested for providing the required engineering ser,,tces during
construction, including:
preconstruction meeting
preparation of progress payment estimates
· shop drawing reviews
contractor coordination
· on-site resident observation during construction activities
The recon'wnended budget for the er~.gineering se.,'vices during construction for this project
is $23,500.
Post Boulevard
Authorization by Resolution is requested for the prep~aticm and completion of final plans
and specifications fl)r the proposed Post Boulevard resur~'~cing project for the Lump Sum
arrmunt of $13,000.

As per Resolution Number 98-126.
THE CONTRACTOR does hereby agree to perform the following
PROFESSIONAL SERVICE FOR PLANS & SPECIFICATIONS FOR SPRING
PAVING PROJECT NOT TO EXCEED $27,000.00.
THE INDEMNIFICATION AGREEMENT ON THE REVERSE OF THE PURCHASE ORDER SHALL BE LIMITED
TO THE VENDOR'S NEGLIGENT OR WRONGFUL ACTS.
According to the terms set forth in Resolufion~ and Purchase Order 98-1332.
THE BOROUGH does hereby agree to pay the Contractor the sum set
forth in Resolution.
