A RESOLUTION OF THE CITY OF RICHLAND HILLS, TEXAS,
AUTHORIZING THE CITY ATTORNEY TO BRING A CONDEMNATION
ACTION FOR THE PURPOSE OF OBTAINING TITLE TO LEASEHOLD
INTEREST IN PREMISES CURRENTLY HELD BY ARCHIE'S DONUT
SHOP, LOCATED AT 6600 GRAPEVINE HIGHWAY, TR 3AOlA, A953,
MAHALY LYNCH SURVEY ADDITION TO THE CITY OF RICHLAND
HILLS, FOR USE BY THE CITY FOR ECONOMIC DEVELOPMENT
PURPOSES OR OTHER PUBLIC PURPOSES PERMITTED BY LAW.
WHEREAS, the City of Richland Hills is a home n.ile city acting under its charter adopted
by the electorate pursuant to Article XI, Section 5 of the Te~LLas Constitution and Chapter 9 of the
Local Government Code; and
WHEREAS, it is necessary for the City of Richland Ilills, Texas, to obtain title to certain
land and improvements so that such land may be aced f~:;r economic development purposes,
specifically, for sale toBarclay/Texas Venture Capital, I,LC, ''or the purpose of constructing a retail
shopping mall with a major chain grocery retailer a~ the anchor retailer; and
WHEREAS, Barclay/Texas Venture Capital, LLC and the owners of the property have been
able to reach an agreement on the acquisition of this land and improvements with the exception of
• the leasehold interest of Archie's Donut Shop, but agreement cannot be reached with the owner of
the leasehold interest in Archie's Donut Shop regarding the value of such leasehold interest; and
WHEREAS, the City Council now deems it necessary to authorize the City Attorney to
initiate condemnation proceedings in order to acquire title to the leasehold interest of Archie's Donut
Shop, in order to facilitate needed economic development in the City;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
RICHLAND HILLS, TEXAS:
SECTION 1.
AUTHORIZATION FOR EMINENT DOMAIN
The City Attorney is hereby authorized to bring a condemnation lawsuit for the purpose of
acquiring title to the leasehold interest currently held in the name of Archie's Donut Shop in the
following described land and the improvements thereon:
TR 3AOlA, A953, Mahaly Lynch Survey Addition to the City of Richland Hills, commonly
referred to as 6600 Grapevine Ilighway,
for economic development purposes, or other public purposes permitted by law.

• SECTION 2.
PUBLIC PURPOSE
The City Council finds that such acquisition in this condemnation action is necessary in order
to serve the public health, safety and welfare.
SECTION 3.
EFFECTIVE DATE
This Resolution shall be effective upon its adoption.
