PROCEDURE TO ADDRESS CITY COUNCIL: If you wish to address the City Council, please complete a Speaker Request Form, indicating the agenda item number and submit it to the City Clerk. There will be a maximum twenty (20) minute period for comments on any subject with a five (5) minute time limit on each speaker, unless waived by Council. You have the opportunity to address the City Council at the following times: AGENDA ITEM - at the time the Council considers the agenda item. NON-AGENDA ITEM - at the time for PUBLIC COMMENTS. Please note that while the City Council values your comments, pursuant to the Brown Act, the Council cannot take action on any item not listed on the agenda. The listing of any item on the agenda includes the authority of the Council to take action on such item and to approve, disapprove, or give direction on any item. If members of the City Council or persons in the audience wish to discuss any matters listed on the Consent Calendar, please address them at this time. Recommendation: Approve Items A through J per recommendations. A. APPROVAL OF MINUTES The City Council is requested to review and approve the Minutes of the Regular City Council Meeting of November 20, 2012. Recommendation: Approve. B. PARKS & RECREATION COMMISSION ACTIONS – MEETING OF NOVEMBER 21, 2012 The City Council is requested to review the Parks and Recreation Commission actions of their meeting of November 21, 2012. Recommendation: Receive and file C. AWARD OF CONTRACT FOR PRINT AND MAIL SERVICES CONNECT magazine is the City’s quarterly, 36-page publication that was produced in April 2012 as a revamp from the City’s former 16-page newsletter and recreation guide. Originally designed as a 28-page magazine, the publication expanded last summer to its current page count allowing staff to address upcoming City projects in detail while providing standard format for citizens to reference recreational activities and citywide events. Due to the challenges with the previous contractor, staff issued the RFP to ensure that the community receives the quarterly issues within a reasonable time frame, while keeping costs low to produce the 36-page publication. The proposed contract with PGI meets this objective as their services include final press, printing, binding and bulk mailing coordination of CONNECT magazine-all within a seven–day turnaround time. The contract will also include a two-year option, in which both the city and PGI can extend the contract for an additional two years at one year intervals, upon mutual agreement by both parties. Recommendation: It is recommended that the City Council authorize the City Manager to execute a City Council Agenda December 4, 2012 Page 3 professional services agreement with the Pacific Graphics, Inc. (PGI) to provide printing and mail coordinating services for the City’s quarterly magazine CONNECT in an amount not to exceed $ 37,706.56 (i.e., $ 9,426.64 per issue) for a one-year term with a two-year option. D. TEMPLE CITY CHAMBER OF COMMERCE LEASE AGREEMENT The City Council is requested to approve the Temple City Chamber of Commerce lease agreement which include key provisions as follows: with the proposed term of three years with a two year option; unchanged rent amount of $1.00 per month; terms that hold Chamber responsible for day to day maintenance; public liability and property insurance policies naming the City as additionally insured; and ensures all indemnities are up to date pursuant to industry standards. Recommendation: 1) Approve a three-year lease agreement between the City of Temple City and Temple City Chamber of Commerce for the property at 9050 Las Tunas Drive; and 2) Authorize the City Manager to execute said agreement with the Temple City Chamber of Commerce. E. CONSULTANT SERVICES AGREEMENT WITH GEO-ADVANTEC, INC. The proposed agreement with Geo-Advantec, Inc. provides construction inspection services during the Rosemead Projects 16 to 18 month duration. With the construction set to begin next month for the Rosemead Blvd Project, inspection services are necessary to ensure the projects built per specifications and all applicable building codes Recommendation: 1) Approve a $243,000 consultant services agreement with Geo- Advantec, Inc. for inspection services associated with the Rosemead Boulevard Safety Enhancements and Beautification Project; and 2) Authorize the City Manager to finalize and execute said agreement with Geo-Advantec. AUTHORIZATION TO APPLY FOR ADDITIONAL GRANT FUNDS FOR THE LAS TUNAS DRIVE SAFETY ENHANCEMENT AND BEAUTIFICATION PROJECT AND AWARD OF A PROFESSIONAL SERVICES AGREEMENT TO AVANT-GARDE TO PREPARE MULTIPLE GRANT APPLICATIONS FOR THE 2013 MTA CALL FOR PROJECTS The 2013 MTA Call for Project is a program where a significant amount of grant funds could be awarded for the purpose of converting Las Tunas Drive form an auto oriented thoroughfare into a sophisticated pedestrian friendly downtown with all of the amenities and safety enhancements available today that will have a lifespan of 50 years. Over the past few months, Avant-Garde, Inc., has been working with the City manager to identify potential funding sources as well as developing a funding strategy for the Las Tunas Drive Project. In order to secure more grant funds to fully fund this project, the City needs to retain the services of a grant writing consultant (i.e., Avant-Garde, Inc.). Recommendation: 1) Authorize the City Manager to submit up to three grant applications for the Las Tunas Drive Safety Enhancements and Beautification project through the 2013 Los Angeles County Metropolitan Transportation Authority (MTA) Call for Projects that are due to MTA by January 18, 2013; and 2) Award a professional services agreement to Avant-Garde, Inc. (in an amount not to exceed $30,000 for grant writing services for the submittal of multiple grant applications to the 2013 MTA Call for Projects for the Las Tunas drive Safety Enhancement and Beautification Project and the Urban Greening Communities Program. G. FIRST QUARTER BUDGET AMENDMENT The City Council is requested to review approve the following amendments to the Community Development Block Grant Fund; Sewer Reconstruction Fund; and the General Fund. Recommendation: The City Council is requested to approve the first quarter budget amendments and amend the adopted Fiscal Year 2012 City Budget accordingly. FIRST QUARTER TREASURER’S REPORT, REVENUE AND EXPENDITURE SUMMARY REPORTS AND CAPITAL IMPROVEMENT FINANCIAL REPORT The City Council is requested to review, receive and file the First Quarter Treasurer’s Report, Revenue and Expenditure Summary Reports and Capital Improvement Financial Report. Recommendation: Receive and file I. PETTY CASH AND VISA CARD REPORT The City Council is requested to review, receive and file the Petty Cash and Visa Card Report. Recommendation: Receive and file J. ADOPTION OF RESOLUTION NO. 12-4877- APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 12-4877 authorizing the payment of bills. Recommendation: Adopt Resolution No. 12-4877 8. UNFINISHED BUSINESS A. SECOND READING AND ADOPTION OF ORDINANCE NO. 12-964, AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING ARTICLE C (“SECOND-HAND SMOKE CONTROL ORDINANCE”) OF CHAPTER 2 (“PUBLIC HEALTH CODE”) OF TITLE 3 (“PUBLIC SAFETY”) OF THE TEMPLE CITY MUNICIPAL CODE During the past months, the City has enacted several amendments (i.e., Property Maintenance, Shopping Cart Containment, and Vacant Property Registration) to the Temple City Municipal Code (TCMC) aimed at maintaining and enhancing the City's quality of life. Staff's review and analysis of the City’s Public Health Code, as well as laws adopted by the State of California, has demonstrated that existing laws have not been adapted to adequately respond to growing concerns by City officials and the public regarding the control of second-hand smoke. Although the California Legislature has enacted limited laws to protect persons from the adverse effects of second-hand smoke, additional regulations are left to local authorities to protect the children, adults, and seniors who do not receive the protections provided by the State. Under City Council Agenda December 4, 2012 Page 6 the existing California law and pursuant to the City’s general and Constitutional police powers, local authorities have great flexibility in adopting smoking laws that do not otherwise conflict with State regulations – including the ability to enact a complete ban on smoking. The neighboring cities of Baldwin Park, Pasadena, and Glendale are among the cities proactively enforcing smoke-free public spaces. The City Council is requested to adopt Ordinance No. 12-964 to enact a comprehensive and consolidated set of regulations to better address the exposure from second-hand smoke to residents and guests of the City. SECOND READING AND ADOPTION OF ORDINANCE NO. 12-965, AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING ARTICLE D (“TOBACCO RETAILER PERMIT ORDINANCE”) OF CHAPTER 2 (“BUSINESS PERMITS”) OF TITLE 5 (“BUSINESS LICENSE AND REGULATIONS”) OF THE TEMPLE CITY MUNICIPAL CODE. During the past months, the City has enacted several amendments (i.e., Property Maintenance, Shopping Cart Containment, and Vacant Property Registration) to the Temple City Municipal Code (TCMC) aimed at maintaining and enhancing the City's quality of life. Staff's review and analysis of State law and the TCMC has demonstrated that the City's existing laws have not been adapted to adequately respond to growing concerns by City officials and the public, regarding responsible tobacco retailing as it pertains to discouraging the sale and distribution of tobacco and nicotine products to minors. The City Council is requested to adopt Ordinance No. 12-965 to encourage responsible tobacco retailing which will assist in the prevention of the illegal sale and distribution of tobacco and nicotine products to minors throughout the City and the greater San Gabriel Valley.
