HomeMy Public PortalAboutOrdinance No. 750-95 07-25-1995 ORDINANCE NO. 750-95 • AN ORDINANCE AMENDING SECTION 15 "MECHANICAL CODE" OF CHAPTER 3 "BUILDING REGULATIONS" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS, IN ITS ENTIRETY, TO ADOPT THE 1994 EDITION OF THE UNIFORM MECHANICAL CODE; ADOPTING PERMIT FEES, INSPECTION FEES AND REGISTRATION FEES; PROVIDING FOR PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE, EXCEPT THAT THE PENALTY SHALL BE THAT FIXED BY STATE LAW WHERE A DIFFERENT PENALTY HAS BEEN ESTABLISHED BY STATE LAW FOR SUCH OFFENSE AND EXCEPT THAT FOR ANY OFFENSE WHICH IS A VIOLATION OF ANY PROVISION GOVERNING FIRE SAFETY, ZONING OR PUBLIC HEALTH AND SANITATION, INCLUDING THE DUMPING OF REFUSE AS THAT TERM IS DEFINED BY SECTION 2.09 OF THE TEXAS LITTER ABATEMENT ACT, ARTICLE 4477-9A, VERNON'S ANNOTATED CIVIL STATUTES, AS AMENDED, THE PENALTY SHALL BE A FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; APPOINTING A BOARD OF APPEALS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Be it ordained by the City Council of the City of Richland Hills, Texas: I. That Section 15, "Mechanical Code" of Chapter 3, "Building Regulations" of the Code of Ordinances, City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: SECTION 15: MECHANICAL CODE A. UNIFORM MECHANICAL CODE ADOPTED The following documents, copies of which are on file in the office of the Building • Official of the City of Richland Hills, Texas, being marked and designated as: Uniform Mechanical Code, 1994 edition, published by the International Conference • of Building Officials, including Appendix Chapters A and C; Are hereby adopted as the mechanical code of the City of Richland Hills, Texas, regulating the and controlling the design, construction, installation, quality of materials, location, operation, and maintenance or use of heating, ventilating, cooling, refrigeration systems, incinerators and other miscellaneous heat-producing appliances within the City of Richland Hills, providing for issuance of permits and collection of fees therefor; and each and all of the regulation, provisions, conditions and terms of such Uniform Mechanical Code, 1994 Edition, including Appendix Chapters A and C, are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance. B. AMENDMENTS TO 1994 UNIFORM MECHANICAL CODE 1. Section 504.3.1. Moisture Exhaust Ducts. Said Section is hereby amended to read as follows: "Moisture exhaust ducts for domestic clothes dryers shall terminate on the outside of the building and shall be equipped with aback-draft damper. Screens shall not be installed at the duct termination. The termination device shall have across-sectional area equal to or greater than the cross-sectional area of the connected duct. Ducts for • exhausting clothes dryers shall no be connected or installed with sheet metal screws or other fasteners which will obstruct the flow or collect lint. Clothes- dryer moisture exhaust ducts shall not extend into or through ducts or plenums." 2. Section 504.3.2. Length Limitation. Said Section is hereby amended to read as follows: "When a space for a domestic clothes dryer is provided, a minimum 4-inch diameter moisture exhaust duct of approved material shall be installed in accordance with this section. Unless otherwise permitted or required by the dryer manufacturer's installation instructions and approved by the building official, domestic gas dryer moisture exhaust ducts shall not exceed a total combined horizontal and vertical length of 14 feet (4267 mm), including two 90-degree elbows. When it can be determined that only electric clothes dryers can be installed, the total length may be increased to 25 feet, including two 90-degree elbows. Two feet (610 mm) shall be deducted for each 90-degree elbow in excess of two." 3. Table Number 6-F Alternate Supports for Factory-Made Air Ducts is hereby amended as follows: • ORDINANCE NO. 750-95 Page 2 TABLE NO. 6-F ALTERNATE SUPPORTS FOR • FACTORY-MADE AIR DUCTS MAX. Registration Fee and Requirements • All mechanical contractors shall pay a registration fee of fifty dollars ($50.00) per calendar year, in order to be entitled to perform such mechanical contracting work within the city. All mechanical contractors shall hold a valid and current state license, a copy of which shall be presented to the City of Richland Hills, Texas, at the time of registration. No person, firm or corporation shall perform mechanical work within the city as defined under the Uniform Mechanical Code, after the effective date of this section without having first registered with the city and paid the appropriate fee therefor. D. Board of Appeals The members of the Richland Hills City Council are hereby appointed as the Board of Appeals as provided in Section 110 of the 1994 Uniform Mechanical Code, 1994 Edition, and any changes in membership of said City Council shall likewise be reflected in the membership of said Board of Appeals. • ORDINANCE NO. 750-95 Page 3 II. • Penalty Clause. Any person, firm or corporation who shall violate any of the provisions of the Uniform Mechanical Code adopted by this section, or who shall do or attempt to do mechanical work covered by said code without first securing the permit prescribed herein for such work, or who shall in any other manner violate the provisions of this section shall be guilty of a misdemeanor, and upon conviction thereof shall be fined in an amount not to exceed five hundred dollars ($500.00) except that the penalty shall be that fixed by state law where a different penalty has been established by state law for such offense and except that for any offense which is a violation of any provision governing fire safety, zoning or public health and sanitation, including the dumping of refuse as that term is defined by section 2.09 of the Texas Litter Abatement Act, Article 4477-9A, Vernon's Annotated Civil Statutes, as amended, the penalty shall be a fine not to exceed the sum of two thousand dollars ($2,000.00), and each day or fraction of a day that an offense hereunder is committed or permitted to exist shall constitute a separate offense and shall be punishable as such hereunder. III. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such • invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. IV. Saving Clause. That Chapter 3 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. V. Effective Date.
