HomeMy Public PortalAboutOrdinance No. 752-95 07-25-1995 • ORDINANCE NO. 7 5 2- 9 5 AN ORDINANCE AMENDING FOOTNOTE "E" OF SECTION 16 "SCHEDULE OF DISTRICT REGULATIONS" OF CHAPTER 12 "ZONING" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS, AS AMENDED, TO CLARIFY AND PROVIDE EXCEPTIONS TO THE 11~iIIVIUM MASONRY REQUIREMENTS FOR BUILDINGS UPON LAND ZONED "RESIDENTIAL" WITHIN THE CITY; PROVIDING A SEVERABILTTY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Richland Hills Planning and Zoning Commission has considered and has recommended clarification of and certain exceptions to the zoning ordinance provisions concerning percent masonry requirements for buildings located in residential zoning districts within the City; and WHEREAS, it is the desire of the City Council to adopt the changes recommended by the Planning and Zoning Commission to the existing masonry requirements. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: • I. That Footnote E, concerning acceptable types of masonry for building exteriors, of Section 16 "SCHEDULE OF DISTRICT REGULATIONS" of Chapter 12 "ZONING", of the Code of Ordinances, City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: E. Masonry. 1. Residential. All residential buildings and structures located in districts zoned R-1L, R-1, R-2, R-3 and R-4 shall be of exterior fire resistant construction having the minimum percentage specified of the total exterior walls above grade level and below the top plate line constructed of brick or stone veneer. The area of doors and windows shall not be included when calculating the exterior surface. Exception: Alternate materials may be considered in place of brick or stone for exterior wall construction upon receiving a recommendation from the Planning and Zoning Commission and approval of the City Council. Submittals must include an architectural rendering of the proposed structure along with details of the material to be used in place of masonry. Any deviation from the plans approved by the City Council must be resubmitted to the Planning and Zoning Commission for a recommendation and the City Council for approval. Alternate materials must meet all of the • following criteria: a. The proposed material must be of similar durability and longevity to brick and stone. ORDINANCE NO. 7 5 2- 9 5 PAGE 1 • b. The proposed structure must have similar fire resistive characteristics as a building constructed with a brick or stone veneer exterior wall. (e.g. the installation of a fire sprinkler system) c. The proposed material shall require low or no maintenance. d. The design of the structure must be compatible with surrounding developed properties and must be a bonafide architectural design that does not utilize brick or stone. Examples of bona fide architectural designs are Gingerbread, Victorian and English Tudor styles. 2. Commercial. Masonry requirements shall mean a brick, stone or masonry exterior surface or similar material veneer attached to an outside wall in the minimum percentage specified. The area of doors and windows shall not be included when calculating the exterior surface. II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of • this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 12 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
