HomeMy Public PortalAboutOrdinance No. 756-95 08-22-1995 • ORDINANCE NO. 7 5 6- 9 5 AN ORDINANCE AMENDING SECTION 23 "COST OF COPIES OF PUBLIC INFORMATION" OF CHAPTER 1 "GENERAL PROVLSIONS" OF THE CODE OF ORDINANCES OF THE CITY OF RICHLAND HILLS, TEXAS, TO PROVIDE A FLAT FEE OF $2.50 FOR COPIES OF THE ANNUAL BUDGET DOCUMENT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, has previously passed Ordinance No. 739-94, codified as Section 23 of Chapter 1 of the Richland Hills Code of Ordinances, providing fees for copies of public records; and WHEREAS, the City Council of the City of Richland Hills, Texas, has found and determined, pursuant to Section 552.267 of the Texas Government Code, that a reduction in the cost of a copy of the annual budget document would be in the public interest because furnishing such information can be considered as primarily benefitting the general public; and WHEREAS, the City Council has determined that a flat fee of $2.50 is a reasonable charge for a copy of the annual budget document. • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That paragraph (1) of Subsection A of Section 23 "COST OF COPIES OF PUBLIC INFORMATION" of Chapter 1 "GENERAL PROVISIONS" of the Code of Ordinances, City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: A. The charges to be imposed and collected for readily available information shall be as follows: (1)(a) Standard-size copy: The charge for standard-size (up to 8 1/2" x 14") paper copies reproduced by means of an office machine copier or computer printer is $0.10 per page. (b) Notwithstanding the foregoing, the cost for copies of the annual budget document in the City shall be $2.50. II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this • ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality ORDINANCE NO. 7 5 6- 9 5 PAGE 1 • shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 1 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
