ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE NO. 755-95,
WHICH AMENDED CHAPTER 13 OF THE RICHLAND HILLS
CODE OF ORDINANCES TO ESTABLISH A WASTEWATER
SYSTEM ADVISORY BOARD; IlVIPOSING ADDITIONAL
RESTRICTIONS FOR MEMBERSHIP ON SUCH BOARD;
REVISING THE POWERS AND DITTIES OF SAID BOARD;
PROVIDING A SUNSET PROVISION; PROVIDING A
SEVERABILTTY CLAUSE; PROVIDING A SAVING CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Richland Hills, Texas, has heretofore
passed Ordinance No. 755-95, amending Chapter 13 of the Richland Hills Code of
Ordinances to establish a Wastewater System Advisory Board; and
WHEREAS, it is the desire of the Richland Hills City Council to impose
additional restrictions for membership on said board, to revise the powers and duties
of said Board, and to provide for a sunset provision to review the necessity for
continued existence of said Board upon the first anniversary of the first meeting of
said Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
• OF RICHLAND HILLS, TEXAS:
I.
That Ordinance No. 755-95, previously passed by the City Council of the City of
Richland Hills, Texas, establishing in Chapter 13 of the Richland Hills Code of
Ordinances a Wastewater System Advisory Board, be hereby amended by the
revisions as set forth below of the terms contained in Subsection A. "CREATION;
QUALIFICATIONS OF MEMBERS", and in Subsection H "POWERS AND DUTIES";
and by the addition of a new Subsection J "SUNSET PROVISION", such revised and
additional sections to hereafter be and read as follows:
A. CREATION• QUALIFICATION OF MEMBERS
There is hereby created the Richland Hills WASTEWATER SYSTEM
ADVISORY BOARD. Members of the Board shall be registered voters on
the date of their appointment. No member may serve on more than one
other Richland Hills board, commission or committee, including service as
executive director of any such board, commission or committee. All
members shall serve without compensation. No debts of any kind or
character shall be made or incurred by the board or by anyone acting in its
behalf.
H. POWERS AND DUTIES
• The powers and duties of the board shall be as follows:
1. To evaluate the wastewater system in conjunction with city staff;

• 2. In consultation with City staff, to determine and recommend to the
City Council maintenance and capital improvement priorities on a
city-wide basis; and
3. To recommend wastewater system maintenance policies to the City
Council.
J. SUNSET PROVISION
As soon as practicable after the expiration of one (1) year from the date of
the first meeting of the Wastewater System Advisory Board, the City
Council shall review the functions of this Board and the work produced by
the Board to date and shall thereupon determine whether the continued
existence and operation of said Wastewater System Advisory Board shall
be in the best interests of the City. If, upon such review, the City Council
determines, in its sole discretion, that the continued existence and
operation of the Wastewater System Advisory Board shall not further the
best interests of the citizens of Richland Hills, the existence of said Board
shall thereupon officially cease.
II.
Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
• ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
III.
Saving Clause. That Chapter 13 of the Code of Ordinances, City of Richland
Hills, Texas, as amended, and Ordinance No. 755-95 shall remain in full force and
effect, save and except as amended by this ordinance.
N.
Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Richland Hills City Charter and the
laws of the State of Texas.
PRESENTED, GNEN FIRST READING AND APPROVED at a regular meeting of
the Richland Hills City Council on the 22nd day of August, 1995, by a vote of 5 ayes,
0 nays, and 0 abstentions.
