HomeMy Public PortalAboutOrdinance No. 758-95 09-12-1995 ORDINANCE NO. ~ 5 8 - 9 5 AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 735-94, AND THE FISCAL YEAR 1994-95 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; AS AMENDED BY ORDINANCE 737-94; INCREASING CERTAIN FUND APPROPRIATIONS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted. Ordinance No. 735-94 on September 27, 1994, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 1994-95; and WHEREAS, changed conditions resulted in the adoption of Ordiance No. 737-94 on October 25, 1994, amending the budget adopted by Ordinance 735-94; and WHEREAS, changed conditions and circumstances, which could have not been foreseen through the use of reasonably diligent thought and attention, have necessitated certain amendments to Ordinance No. 735-94 and the budget adopted thereby as amended; and WHEREAS, a public hearing on the following amendments to the fiscal year 1994-95 budget contemplated hereby has been held as required by law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Section II of said Ordinance No. 735-94, as amended, be amended to increase the general fund appropriation from $3,410,385 to $3,545,240 with such increase allocated and appropriated as follows: $30,000, such sum the surplus from the 1994 Personal Property Finance Contractual Obligations issue, for transfer to the 1994 Contractual Obligations • Interest and Sinking Fund as required by said issuance ordinance for repayment of debt; and • $104,855 for transfer to the Drainage Utility Fund for future capital improvements in accord with prior Council action directing the adjustment of the 1994-95 Budget for said purpose. II. That Section X of said Ordinance No. 735-94, as amended, be amended to increase the appropriation out of the Calloway Branch Improvement Fund from $450,000 to $1,232,982 in order to fully record all project expenses, including reimbursables from the United States Army Corps of Engineers, paid directly by the City. III. That Ordinance 735-94, as amended, be amended to add a new section XI- 1, appropriating $28,442 out of the 1993 Contractual Obligations Acquisition . Fund for the purchase of capital assets approved in the 1993 Personal Property Finance Contractual Obligations Issue Order. IV. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurdisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. ORDINANCE NO. 758-95 • v. Saving Clause. That Ordinance No. 735-94, as amended by Ordinance 737-94, of the City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. VI. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
