HomeMy Public PortalAboutOrdinance No. 769-95 11-09-1995 ORDINANCE NO. 769-95 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS, CANVASSING THE ELECTION RETURNS OF THE NOVEMBER 7, 1995 SPECIAL ELECTION. WHEREAS, the City Council of said City ordered an election to be held in said City on November 7, 1995, on the PROPOSITIONS hereinafter stated; and, WHEREAS, said City Council has investigated all matters pertaining to said election, including the ordering, giving notice, officers, holding and making returns of said election; and, WHEREAS, the election officers who held said election have duly made the returns of the result thereof, and said returns have been duly delivered to said City Council. WHEREAS, it is hereby officially found and determined that the meeting at which this Ordinance was passed was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551, Texas Government Code. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS: • 1. That the City Council officially finds and determines that said election was duly ordered, that proper notice of said election was duly given, that proper election officers were duly appointed prior to said election, that said election was duly held, that due returns of the result of said election have been made and delivered, and that the City Council has duly canvassed said returns, all in accordance with law and the Ordinance calling said election. 2. That the City Council officially finds and determines that a total number of 1,068 votes were cast at said election, and the following number of votes were cast on the submitted PROPOSITIONS by the resident, qualified electors of said City, who voted at the election: PROPOSITION NO. 1 PROPOSED RESOLUTION NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richland Hills, that the City Council hereby states its intent to honor the Interlocal Agreement with the State of Texas and the Texas Department of Transportation, dated March 28, 1994, and agrees to participate in street and drainage improvements to that portion of Handley-Ederville Road, north of Texas Highway 121, and south of Texas Highway Business 183, in the city limits of Richland Hills, Texas; and, ORDINANCE NO. 769-95 PAGE 2 BE IT FURTHER RESOLVED, that the City Council hereby commits such funds as are required to satisfy the City's twenty percent (20~) share of the estimated expenditure for completion of said project. 552 VOTES: FOR THE RESOLUTION ) 480 VOTES: AGAINST THE RESOLUTION ) PROPOSITION NO. 2 384 VOTES: FOR ) THE ISSUANCE OF $865,000 STREET IMPROVEMENT TAX BONDS FOR HANDLEY-EDERVILLE ROAD 649 VOTES: AGAINST ) 3. That the City Council officially finds, determines and declares the result of said election to be that PROPOSITION NO. 1 so submitted received a favorable majority vote in all respects and has carried; and that PROPOSITION N0. 2 so submitted did not receive a favorable majority vote in all respects and has failed. PRESENTED, GIVEN FIRST READING AND APPROVED at a special meeting of the Richland Hills City Council on the 9th day of November, 1995, by a vote of 3 ayes, 0 nays, and 0 abstentions. APPROVED: C. F.
