AN ORDINANCE PROVIDING FOR THE CREATION OF A
ROAD AND STREET IMPROVEMENT FUND OF THE CITY
OF RICHLAND HILLS, TEXAS; PROVIDING THAT
CERTAIN MONIES RECEIVED AS PART OF THE T'S
STREET IMPROVEMENT PROGRAM BE PLACED
THEREIN; PROVIDING THAT THE MONIES BE UTILIZED
FOR ROAD AND STREET IMPROVEMENTS; PROVIDING
A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the citizens of Richland Hills elected to annex into the Fort Worth
Transportation Authority (dba The T) in May 1992; and
WHEREAS, the City Council of the City of Richland Hills, Texas, heretofore has entered
into annual agreements with the T to participate in the T's Transit Street Improvement Program
at an annual payment of fifteen (15) percent of estimated sales tax revenues received under the
public transportation one-half cent sales tax; and
WHEREAS, the City of Richland Hills, Texas, has received the amounts of $80,000 in
1993, $79,577 in 1994, and $75,930 in 1995, and anticipates receiving similar funds each year;
and
WHEREAS, the City of Richland Hills has expended to date $100,000 for Midway Road,
$27,200 for interlocal agreements regarding Handley-Ederville Road, and Booth-Calloway and
Glenview Drive, and has expended $48,000 for engineering for the Booth-Calloway/Glenview
Drive intersection improvements; and
WHEREAS, the City Council of the City of Richland Hills, Texas, now desires to
establish a Road and Street Improvement Fund to set Street Improvement Program monies apart
from those monies of the General Fund;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS;
I.
That a Road and Street Improvement Revenue Fund be created to receive revenues from
the T"s Street Improvement Fund.

That a Road and Street Improvement Expenditure line item be created to allow
expenditures from the Road and Street Improvement Fund for road and street improvements as
designated by the City Council.
III.
That a sum of $60,307 be transferred from the General Fund to the Road and Street
Improvement Fund beginning January 9, 1996, and that all future funds received from the T be
placed in the Road and Street Improvement Fund.
IV.
That all future revenues received by the City as part of the T's Street Improvement
Program be placed in the Road and Street Improvement Fund.
V.
Severability Clause: That it is hereby declared to be the intention of the City Council that
the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if
any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase,
clause, sentence, paragraph or section.
VI.
Effective Date. This ordinance shall be in full force and effect from and after passage
and publication as provided by the Richland Hills City Charter and the laws of Texas.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting of the
Richland Hills City Council on the 9th day of January , 1996, by a vote of 5 ayes,
