A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD,
ESTABLISHING THAT THE CITY ATTORNEY'S OFFICE SHALL MANAGE AND
SUPERVISE ALL LEGAL AFFAIRS OF THE CITY, INCLUDING ALL SPECIAL
LEGAL COUNSEL HIRED BY THE CITY, DETERMINE WHICH COUNSEL
SHALL STAFF ALL OF THE CITY RELATED AGENCIES, AND SOLELY
PROPOSE DEFENSE COUNSEL, WITH THE APPROVAL OF COUNCIL, TO
THE THIRD -PARTY ADMINISTRATOR AND TO THE RISK MANAGEMENT
AND INSURANCE PROVIDER
WHEREAS, the Third -Parry Administrator ( "TPA ") Adminsure Inc. has
agreed that, "in coordination with the City" it shall confer with defense attorneys
during all stages of litigation to assist attorneys in preparing cases and to ensure
optimal return on legal effort;
WHEREAS; the City Council wishes to identify a point person, the office of
the City Attorney, to coordinate with the TPA and the City's risk management and
insurance provider, on the City's behalf, regarding the assignment and
management of attorneys employed by the City; and
WHEREAS, for economy, efficiency, and streamlining purposes, Council
wishes to consolidate the supervision of the legal affairs of the City:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD
DOES HEREBY FIND, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. That the City Council approves a policy establishing that, in
addition to the Risk Manager and the City Manager, the City Attorney will initially
review any complaints, subpoenas, or legal documents received, and the City
Attorney solely will make the necessary suggestion to the Third Party Administrator
and to the City's insurer, ICRMA, regarding the legal staffing of the case, and will
present to Council for approval of that recommendation; the City's Attorney shall
manage and supervise all legal affairs of the City, including all special legal
counsel hired by the City; and the City Attorney shall determine which counsel
shall staff all of the City- related agencies;
Section 2. This Resolution shall become effective immediately upon its
adoption.
Section 3. The City Clerk shall attest to the adoption of this City Council
Resolution.
