RESOLUTION NO.2016.169
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
ESTABLISHING A GENERAL TAX CITIZEN OVERSIGHT ADVISORY COMMITTEE
WHEREAS, City staff has advised the City Council and Lynwood community of
the City's ongoing structural deficit. A combination of circumstances has resulted in
projected deficits far beyond the City's capacity to absorb them; and
WHEREAS, the City's flat revenue growth continues to be offset by rising
operating costs; and
WHEREAS, the City seeks to establish a citizen oversight committee to review
the expenditures from the tax measure proceeds and their compliance with the ballot
question and City Council intent:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD. DOES
HEREBY FIND, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. That the City Council approves the establishment of a citizen
oversight committee ( "General Tax Citizen Oversight Advisory Committee ") to review
the expenditures from the tax measure proceeds and their compliance with the ballot
question and City Council intent
Section 2. The General Tax Citizen Oversight Advisory Committee shall meet,
function, and operate as follows:
• 1 - Established.
A committee known as the 2016 General Tax Citizen Oversight Advisory Committee is
created and established in conformance with Lynwood Municipal Code ( "LMC ")
Section 2 -12, Commissions, Boards and Committees Generally. The committee shall
last as long as the 2016 general transactions and use tax is in effect.
• 2 - Organization.
The committee shall consist of five members.
• 3 -Appointment; eligibility; removal.
A. The appointment of committee members shall be made in the manner
established in LMC Section 2 -12.

The City shall develop an open selection process, actively recruit, and appoint five
(5) Committee members who shall be residents of the City of Lynwood possessing
the following credentials:
a. One member who is or was a member, retired or active, of the Chamber of
Commerce for at least three years.
b. One member who is a Lynwood Block Watch Captain.
c. One member who is a clergy leader in the City.
d. Two members from the public at- large, with priority for anyone who is a
Certified Public Accountant (CPA) and experienced in financial audits
B. Unless specifically provided otherwise in LMC Section 2 -12 or this Section, all
other procedures set forth under the law shall apply to this committee. Specifically,
committee members shall comply with the financial disclosure and conflict of
interest requirements of the Political Reform Act of 1974.
4 - Compensation.
Members of the committee shall serve without compensation.
5 - Officers.
The officers of the committee shall consist of a chairperson, vice chairperson, to be•
elected by the committee by a majority vote, and such other officers as the committee
may from time to time designate. The term of said officers shall be fixed by LMC
Section 2 -12.
6 - Rules and regulations.
The committee shall make its own rules and regulations and fix the procedure for
calling, holding and conducting meetings; provided that the committee shall meet at
least quarterly to review the expenditure of revenues generated by the 2016 sales and
use tax and to make recommendations to the City Council regarding those
expenditures, and that such rules and regulations are not in conflict with the provisions
of any laws of the state of California, City of Lynwood, or laws or ordinances of any
political subdivision thereof.
7 - Powers and duties.
The committee shall have the following duties:

A. To oversee expenditure of the proceeds of the sales and use tax
approved on November 8, 2016.
B. To review, make recommendations, and report, at least once annually,
upon the tax expenditures to the city council.
C. To perform any other functions as directed by the city council from time to
time.
8 - Meetings; time; quorum.
A. The committee will hold one formal meeting annually, with additional
meetings scheduled as needed by the committee.
B. All committee meetings shall be properly noticed and held in compliance
with the Brown Act.
C. Three members of the committee shall constitute a quorum'for the
transaction of business.
9 — Conditional Effect.
If the tax measure is not approved by the voters at the November 8, 2016 election,
this resolution shall be of no force or effect.
Section 3. This Resolution shall take effect immediately upon its adoption.
Section 4. The City Clerk shall certify as to the adoption of this City Council
Resolution.
