AN ORDINANCE AMENDING SECTION 9 "PLANNING AND
ZONING COMMISSION" OF CHAPTER 13 "ADVISORY
BOARDS" OF THE CODE OF ORDINANCES, CITY OF
RICHLAND HILLS, TEXAS; ADDING ADDITIONAL
QUALIFICATIONS FOR MEMBERSHIP ON SAID CONIlVIISSION;
PROVIDING FOR STAFF SUPPORT; PROVIDING FOR
CERTAIN RECORD KEEPING BY THE CITY SECRETARY;
REDEFINING QUORUM REQUIREMENTS; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND
HILLS, TEXAS:
I.
That Section 9 "PLANNING AND ZONING COMMISSION" of Chapter 13
"ADVISORY BOARDS" of the Code of Ordinances of the City of Richland Hills,
Texas, as amended, be hereby amended in the following specified particulars:
A. Subsection A "CREATION; QUALIFICATIONS OF MEMBERS" of said
Section 9 shall be hereby amended to hereafter be and read as follows:
A. CREATION• QUALIFICATIONS OF MEMBERS
There is hereby created the Richland Hills Planning and Zoning
Commission. Members of the commission shall be registered
voters and citizens of the city on the date of their
appointment. No member may serve in any capacity on more
than one other Richland Hills standing board, commission and
committee, or any special committee exceeding six month's
duration; or serve as city representative to a local, state or
national organization. All members shall serve without
compensation. No debts of any kind or character shall be made
or incurred by the board or by anyone acting in its behalf.
B. Subsection B "COMPOSITION, APPOINTMENTS AND TERMS OF
MEMBERS" shall be hereby amended by the addition of the following
language to the end of said Subsection as it currently exists:
Appointment of commission members should be accomplished by the
City Council to coincide with election of Councilmember by places 1
through 5; provided, however, that this provision will take effect in
May of 1996. When the City Councilmembers take office and
appointments are made in the month of May, the seating of new
members of the Planning and Zoning Commission should occur during
the first regular meeting following that appointment.

C. Subsection D "OFFICERS" of said Section 9 shall be hereby amended by
the addition at the end of said subsection of the following sentence:
A staff representative will be assigned to a Planning and Zoning
Commission meeting where a replatting or zoning matter requires a
vote of the commissioners. Each board shall be responsible for
setting up their own needs. In the event additional staff support is
needed, it should be coordinated through the City Manager's office.
A chairman, vice chairman and secretary shall meet the minimum
office requirements for each board, commission and committee.
D. Subsection I "APPLICATIONS" of said Section 9 shall be hereby amended
by the addition of the following language to the end of said Subsection as
it currently exists.
"The City Secretary shall maintain previously filed applications
indefinitely of an appointed board, commission or committee
member if said member is to be considered for reappointment by the
City Council and said member has expressed a desire to continue
serving on said board, commission or committee."
E. Subsection E "MEETINGS, RULES OF PROCEDURE AND QUORUM" of
said Section 9 shall be hereby amended by the deletion of the last sentence
of said Subsection E and by the addition of the following language in place
• of said deleted last sentence:
A majority of the currently appointed members shall constitute a
quorum for the transaction of business. (A quorum is one more than
half the currently appointed members).
F. Subsection F "MINUTES AND ATTENDANCE REPORTS SUBMITTED TO
THE COUNCIL" of said Section 9 shall be hereby amended to hereafter be
and read as follows:

COUNCIL
The secretary (staff representative) shall keep minutes of all
official meetings where there are plats and zoning requests and
shall submit said minutes, following each meeting, to the City
Secretary. Meetings with no plats or zoning requests are to be
taped and written minutes shall be submitted by the elected
secretary of the commission for those meetings. City staff is
only required to attend those Planning and Zoning Commission
meetings where official action is taking place. The minutes
shall become a part of the City Council's informational report.
The secretary shall also keep attendance records on each
member for submission to the City Council along with the
commission's minutes and will make specific notation if a

member misses two consecutive meetings. Members must
attend at least seventy-five percent (75%) of all meetings of
the commission based on a twelve-month period beginning June
1 of each year.
II.
Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
III.
Saving Clause. That Chapter 13 of the Code of Ordinances, City of Richland
Hills, Texas, as amended, shall remain in full force and effect, save and except as
amended by this ordinance.
IV.
• Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Richland Hills City Charter and the
laws of the State of Texas.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting of
the Richland Hills City Council on the 13th day of February , 1996, by a vote
of 3 ayes, 2 nays, and 0 abstentions.
