HomeMy Public PortalAboutOrdinance No. 792-96 02-13-1996 • ORDINANCE NO. 792-96 AN ORDINANCE AMENDING SECTION 8 "GRIEVANCE COMMITTEE" OF CHAPTER 13 "ADVISORY BOARDS" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS; CREATING A NEW RICHLAND HILLS GRIEVANCE COMMITTEE; PROVIDING QUALIFICATIONS FOR MEMBERS OF SAID COMMITTEE; PROVIDING FOR STAFF SUPPORT; PROVIDING FOR CERTAIN RECORD KEEPING BY THE CITY SECRETARY; DEFINING QUORUM REQUIREMENTS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Section 8 "GRIEVANCE COMMITTEE" of Chapter 13 "ADVISORY BOARDS" of the Code of Ordinances of the City of Richland Hills, Texas, as amended, be hereby amended in the following specified particulars: • A. Subsection A "CREATION; QUALIFICATIONS OF MEMBERS" of said Section 8 shall be hereby amended to hereafter be and read as follows: A. CREATION: OUALIFICATIONS OF MEMBERS 1. The Richland Hills Grievance Committee is hereby established. It shall be composed of a standing board of five (5) employee members and two (2) citizen members. Only regular, full time employees may vote on the election of employee members. For the purpose of determining employee membership, and to achieve a fair and equitable apportionment of employee representation, one person from each of the following departments shall be elected by those respective departmental members to serve on said board: (a) Fire Department; (b) Police Department; (c) Public Services Department; (d) Library; and (e) City Hall/Administration. • • Only regular, full time employees shall be eligible for election to a committee from these departments, and department heads are ineligible to be elected. The City Council shall have the authority to appoint the two citizen members of the Grievance Committee by a majority vote on an at-large basis. Such citizen members shall be registered voters on the date of their appointment, and may not serve in any capacity on more than one other Richland Hills standing board, commission and committee, or any special committee exceeding six month's duration; or serve as city representative to a local, state or national organization. 2. Members of the Grievance Committee shall serve terms of two (2) years. Appointed members shall be seated in even numbered years and elected members shall be seated in odd numbered years; provided, however, that the initial Grievance Committee members under this ordinance shall be appointed and elected as soon as reasonably practicable after the final passage of this ordinance. Members shall be appointed in January, or as soon as reasonably practicable thereafter. B. Subsection C "VACANCIES; UNEXPIRED TERMS" shall be hereby amended to hereafter be and read as follows: . C. VACANCIES; UNEXPIRED TERMS Any vacancy occurring in the membership of the committee shall be filled by appointment and approval of the City Council or by election by fellow departmental employees in the same manner as provided hereinabove for appointment of members for full terms, such appointments to be for the remainder of the unexpired term of the member whose place become vacant, subject, however, to eligibility requirements stated in this section. C. Subsection D "OFFICERS" of said Section 8 shall be hereby amended to hereafter be and read as follows: D. OFFICERS The officers of the committee shall be a chairman, who shall be elected by a majority vote of the members at their first organizational meeting, and thereafter when the incumbent shall leave office for any reason. The remaining officers shall be a vice chairman and secretary, who shall be elected by a majority vote of the members. Each board shall be responsible for setting up their own needs. In the event staff support is needed, it should be coordinated through the City Manager's office. A chairman, vice chairman and secretary shall meet the minimum office requirements for each board, commission, and committee. • ORDINANCE NO. 792-96 PAGE 2 • D. Subsection E "MEETINGS, HEARING, RULES OF PROCEDURE AND QUORUM" of said Section 8 shall be hereby amended by the deletion of the first sentence of said section and by the replacement of said first sentence with the following language: The Committee shall hold meetings as required by the personnel policies of the City of Richland Hills, as same may from time to time be amended by ordinance. E. Subsection I "APPLICATIONS" of said Section 8 shall be hereby amended by the addition of the following language to the end of said Subsection as it currently exists. "The City Secretary shall maintain previously filed applications indefinitely of an appointed board, commission or committee member if said member is to be considered for reappointment by the City Council and said member has expressed a desire to continue serving on said board, commission or committee." II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this . ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 13 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
