HomeMy Public PortalAboutOrdinance No. 794-96 05-14-1996 • ORDINANCE NO. 794-96 AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE N0.759-95, AND THE FISCAL YEAR 1995-1996 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; AS AMENDED BY ORDINANCE 775- 95; INCREASING CERTAIN FUND APPROPRIATIONS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 759-95 on September 12, 1995, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 1995-1996; and WHEREAS, changed conditions resulted in the adoption of Ordinance No. 775-95 on December 12, 1995, amending the budget adopted by Ordinance 759-95; and WHEREAS, changed conditions and circumstances, which could have not been foreseen through the use of reasonably diligent thought and attention, have necessitated certain amendments • to Ordinance No. 759-95 and the budget adopted thereby as amended; and WHEREAS, a public hearing on the following amendments to the fiscal year 1995-1996 budget contemplated hereby has been held as required by law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Section II of said Ordinance No. 759-95, as amended, be amended to decrease the general fund appropriation from $3,180,721 to $3,098,721 with such decrease allocated and appropriated as follows: $82,000 reduction of General Fund Street Department Street Reconstruction line item. II. • That Section II of said Ordinance 759-95, as amended, be amended to decrease the general fund revenues from $3,095,344 to $3,013,344 with such decrease as follows: ORDINANCE NO. 794-96 Page 2 • $82,000 decrease in revenue for transfer to the Road and Street Improvement Fund for future capital improvements in accord with prior Ordinance No. 779-95 adopted January 9, 1996. III. That Ordinance 759-95, as amended, be amended to add a new section XII-I, appropriating $63,000 out of the Road and Street Improvement fund for the payment ofright-of--way acquisition and engineering fees. IV. That Ordinance 759-95, as amended, be amended to add a new section XII-2, appropriating $235,507 from the General Fund non-department account and effecting an equity transfer of the $235,507 to the Road and Street Improvement Fund. V. That Ordinance 759-95, as amended, be amended to increase the enterprise fund appropriation from $2,190,871 to $2,225,871 for the following public purpose: • 1) $35,000 to repair the Trinity Well as part of the water distribution system. VI. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, pazagraph or section. VII. Saving Clause. That Ordinance No. 759-95, as amended by Ordinance 775-95, of the City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. • ORDINANCE NO. 794-96 Page 3 • VIII. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
