HomeMy Public PortalAbout2016.163 (07-19-16)RESOLUTION NO. 2016.163 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO CONSOLIDATE A SPECIAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 8, 2016, WITH THE STATEWIDE GENERAL PRESIDENTIAL ELECTION TO BE HELD ON THAT DATE PURSUANT TO § 10403 OF THE ELECTIONS CODE WHEREAS, the City Council of the City of Lynwood called a Special Municipal Election to be held on November 8, 2016, for the purpose of submitting to the voters the question relating to the establishment of a transactions and use tax and a "rainy day fund" measure; and WHEREAS, it is desirable that the Special Municipal Election be consolidated with the Statewide General Presidential election to be held on the same date and that within the City the precincts, polling places and election officers of the two elections be the same, and that the county election department of the County of Los Angeles canvass the returns. of the Special Municipal Election and that the election be held in all respects as if there were only one election. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That pursuant to the requirements of § 10403 of the Elections Code, the Board of Supervisors of the County of Los Angeles is hereby requested to consent and agree to the consolidation of a Special Municipal Election with the Statewide General Presidential election on Tuesday, November 8, 2016. Section 2. That a measure is to appear on the ballot as follows: wood Public Safety and Vital City Services Protection Measure protect and maintain vital city services including emergency response, YES ghborhood police patrols, sheriffs deputies and gang detectives, gang, g and youth violence prevention programs, fire protection, street and hole repair and parks and recreation programs; and other essential feral services, shall the City of Lynwood establish a one cent sales tax, uiring independent annual financial audits, citizen's oversight and public NO iew of expenditures, with all funds remaining in Lynwood with said tax iring after 10 years? Section 3. Also, another measure is to appear on the same ballot as follows: o help maintain vital city services including emergency response, YES eighborhood police patrols, sheriffs deputies and gang detectives, gang, rug and youth violence prevention programs, fire protection, street and othole repair and parks and recreation programs; and other essential eneral services, during economic recessions that cause temporary budget hortfalls, shall the City of Lynwood establish a budget stabilization ( "rainy ay ") fund as part of the General Fund to provide short-term funding for Lich general services into which ten percent of any new general tax NO ;venues shall be deposited and spent only to balance the budget in cases t City fiscal hardship as declared by 4/5 of the City Council? Section 4. That the County election department is authorized to canvass the returns of the Special Municipal Election. The election shall be held in all respects as if there were only one election, and only one form of ballot shall be used. Section 5. That the Board of Supervisors is requested to issue instructions to the County election department to take any and all steps necessary for the holding of the consolidated election. Section 6. That the City of Lynwood recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for any costs. Section 7. That the City Clerk is hereby directed to file a certified copy of this resolution with the Board of Supervisors and the county election department of the County of Los Angeles. Section 8. Notice of the election is hereby given. Additionally, the City Clerk is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. Section 9. The City Clerk shall certify to the passage and adoption of this City Council Resolution and enter it into the book of original Resolutions. Section 10. That this Resolution shall take effect immediately upon its adoption. Section 11. That the City Clerk shall certify to the passage and adoption of this City Council Resolution and enter it into the books of original resolutions.
