AN ORDINANCE AMENDING ORDINANCE NO. 789-96, AND
SUBSECTION D OF SECTION 9 "PLANNING AND ZONING
COMIVIISSION" OF CHAPTER 13 "ADVISORY BOARDS" OF
THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS,
TEXAS, WHICH WAS AMENDED BY THE SAID ORDINANCE
789-96; PROVIDING FOR STAFF SUPPORT FOR THE
PLANNING AND ZONING COMMISSION; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Richland Hills City Council did on February 13, 1996, adopt
Ordinance No. 789-96, amending the provisions of the Richland Hills Code of
Ordinances governing the Richland Hills Planning and Zoning Commission; and
WHEREAS, Section I.C. of said Ordinance 789-96 made certain amendments to
the city staff support requirements for Planning and Zoning Commission meetings;
and
WHEREAS, the City Council of the City of Richland Hills, Texas, now finds and
determines that additional modifications to the city staffing provisions for the
Planning and Zoning Commission and its meetings are necessary.
• NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
Section 1
That Subsection I.C. of Ordinance 789-96, adopted by the Richland Hills City
Council on February 13, 1996, be and the same is hereby repealed and replaced with
the following language, to be added to the end of Subsection D "Officers" of Section
9 "Planning and Zoning Commission" of Chapter 13 "Advisory Boards" of the Code of
Ordinances, City of Richland Hills, Texas, as same existed immediately before the
adoption of Ordinance 789-96, to hereafter be and read as follows:
A staff representative shall be made available by the City to record
the minutes of all Planning and Zoning Commission meetings and
workshops, and additional staff members shall be made available to
assist the Planning and Zoning Commission as requested by its
chairman. The City Manager shall designate the city staff members
to be assigned to assist the Planning and Zoning Commission.
Section 2
Severability Clause. That it is Hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
• this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality

shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
Section 3
Saving Clause. That Chapter 13 of the Code of Ordinances, City of Richland
Hills, Texas, as amended, shall remain in full force and effect, save and except as
amended by this ordinance.
Section 4
Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Richland Hills City Charter and the
laws of the State of Texas.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting of
the Richland Hills City Council on the 25th day of June 1996, by a vote
of 5 ayes, 0 nays, and 0 abstentions.
