AWARDING BID FOR THE IMPROVEMENTS TO PETER J. SICA INDUSTRIAL HIGHWAY
AND MIDDLESEX AVENUE
WHEREAS, the Borough has publicly advertised for the receipt of bids for the Improvements to Peter J.
Sica Industrial Highway and Middlesex Avenue; and
WHEREAS, the Borough has solicited and received five (5) bid proposals for the Peter J. Sica Industrial
Highway and Middlesex Avenue Improvements Project as follows:
WHEREAS, Lucas Brothers, Inc., of Morganville, NJ has submitted the lowest bid for said contract as
evidenced by the response on file with the Borough's Purchasing Department and with the Borough
Engineer; and
WHEREAS, the Borough Engineer has reviewed the above bid proposals and has recommended the award
of a contract to Lucas Brothers, Inc„ in a total amount not to exceed $3,276,495.00, per attached award
letter; mid
WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose,

NOW THEREFORE BE IT RESOLVED by die Mayor and Council of the Borough of Carteret as
follows:
L That the appropriate Borough Officials are hereby authorized to enter into a contract
with Lucas Brothers, hie., of Morganville, N.J. for the Project for the sum of
$3,276,495.00 in accordance in all respects with the request for proposals and bid on
same.
2. That the aforementioned award of bid is contingent upon formal approval from the
New Jersey Department of Labor, Division of Wage and Hour Compliance,
3. That the aforementioned award be subject to review and approval by the Borough
Law Director mid NJDOT.
4. That a copy of this Resolution shall be forwarded to the Borough's Purchasing
Department, the Borough's Consulting Engineers CME Associates and the
Borough's Director of Engineering.

and certified as a true copy of the

Dear Mayor and Borough Council:
Enclosed herewith please find a summary of bids received on May 27, 2020, for the above
referenced project. A total of five (5) bids were submitted, ranging from an apparent low base bid of
$3,045,394.00 by Lucas Brothers, Inc„ to a high base bid of $3,725,729.70 by Black Rock
Enterprises, LLC. Please find enclosed a complete Summary of Bids for the Council's review.
Upon analysis of the base bid as well as base bid plus all additions items, Lucas Brothers, Inc. is the
low bidder. It should be noted that there was a mathematical error present in the base bids
submitted by Lucas Brothers and S. Brothers, Inc. We believe that the irregularities are minor in
nature and not a mandatory cause for rejection; therefore, the outcome of the bid is unaffected.
As a matter of procedure, our office has contacted Lucas Brothers, Inc. to discuss their bid. The
representatives we spoke to indicated they are comfortable with the bid as submitted and there is no
objection to completing the project based on the bid prices submitted and the contract time.
Based on this information, we recommend the following actions:
Award of the contract to the low bidder, Lucas Brothers, Inc. 80 Amboy Road, Morganville, NJ
07751 within 60 calendar days, on a unit price basis in the total amount of $3,276,495.00 for
Base Bid Items 1 through 94, inclusive, Addition Items A -1 through A -10, inclusive, Addition
Items B -1 through B -24, inclusive, and Addition Item C -1 as available funding permits. The

award should be subject to review and approval by the Borough Attorney and NJDOT Local Aid,
District III including concurrence to waive the minor irregularities, the review of the bid bond and
surety from the low bidder, and submission of the required bonds and Insurance certificates for
the project.
Bid and bid security of the second and third low bidder be retained and held open, pending
execution of the contract agreement by Lucas Brothers, Inc.
3. Return of bid securities to remaining bidders,
4. As the award exceeds $2,000,000, the contract must be reported to the NJ Office of the State
Comptroller within 20 days of award.
By copy of this letter, we are requesting the Borough Attorney prepare the necessary Resolution of
Award. Upon execution, please have four (4) signed and sealed copies of the resolution forwarded
to my office for further execution.
