HomeMy Public PortalAboutOrdinance No. 803-96 09-24-1996 ORDINANCE NO. 803-96 AN ORDINANCE AMENDING SECTION 10 "WATER RATES" OF CHAPTER 11 "UTILITIES" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS, INCREASING THE RATES CONTAINED THEREIN TO REFLECT INCREASES IN CHARGES TO THE CITY FOR WATER; PROVIDING A SEVERABILTTY CLAUSE; PROVIDING A SAVING CLAUSE AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, has heretofore set reasonable rates and charges for water service within the City of Richland Hills, Texas; and WHEREAS, since that time, the costs to the City for purchasing water have increased; and WHEREAS, the City Council of the City of Richland Hills, Texas, now finds it necessary to increase the rates charged for water within the City to reflect the increased costs to the City for purchase of water, and hereby finds that the rates set forth hereinbelow are fair and reasonable. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Subsection A "WATER RATES ENUMERATED" of Section 10 "WATER RATES" of Chapter 11 "UTILITIES" of the Code of Ordinances, City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: SECTION 10: WATER RATES A. WATER RATES ENUMERATED From and after the 1st day of October, 1996, (meter readings after such date) the following water rates and charges shall be in full force and effect within the city: (1) All customers with water service shall be charged the following, unless otherwise provided for: First 2,000 gallons $11.30 minimum 2,001 - 6,000 gallons $2.55 per 1,000 gallons 6,001 - 10,000 gallons $2.65 per 1,000 gallons 10,001 - 20,000 gallons $2.75 per 1,000 gallons All over 20,000 gallons $2.90 per 1,000 gallons ORDINANCE NO. PAGE 1 • (2) Charges for apartment houses shall be as follows: When two (2) or more residential living units are supplied with water from one (1) meter, a minimum water service charge of eleven dollars and thirty cents ($11.30) will be made each month for each unit, adjusted by an occupancy factor of ninety percent (90%). II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 11 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
