ORDINANCE NO. 806-96
AN ORDINANCE PROVIDING FOR THE CREATION OF AN
EQUIPMENT REPLACEMENT FUND FOR THE CITY OF
RICHLAND HILLS, TEXAS; PROVIDING CERTAIN FUNDS
FROM THE GENERAL AND ENTERPRISE FUNDS BE PLACED
THEREIN; PROVIDING THAT THE FUNDS BE UTILIZED FOR
THE REPLACEMENT OF EQUIPMENT AND VEHICLES;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Richland Hills, Texas,
heretofore has issued Public Property Financial Contractual Obligations in 1993,
1994, and 1996, to fund the acquisition of equipment and vehicles; and
WHEREAS, the City Council of the City of Richland Hills, Texas, nowt
desires to establish an Equipment Replacement Fund to set aside money to pay
for the purchase of vehicles and equipment for General and Enterprise Fund
• departments in future fiscal years;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF RICHLAND HILLS, TEXAS;
I.
That an Equipment Replacement Fund be created to receive revenues
from the General Fund and Enterprise Fund.
II.
That an Equipment Replacement Fund Expenditure line item be created
to allow expenditures from the Equipment Replacement Fund as designated by
• the City Council.
• III.
That a sum of $84,600 be transferred from the General Fund and a sum
of $33,050 be transferred from the Enterprise Fund to the Equipment
Replacement Fund to begin the first year of a five year plan.
IV.
That each succeeding fiscal year for the next four years a sum of $84,600
be transferred from the General Fund and a sum of $33,050 be transferred from
the Enterprise Fund to the Equipment Replacement Fund.
V.
• Severability Clause. That it is hereby declared to be the intention of the
City Council that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence, paragraph, or
section of this ordinance shall be declared invalid or unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same would
have been enacted by the City Council without the incorporation in this
ordinance of any such invalid or unconstitutional phrase, clause, sentence,
paragraph or section.
VI.
Effective Date. This ordinance shall be in full force and effect from and
after its passage and publication as provided by the Richland Hills City Charter
and the laws of the State of Texas.

meeting of the Richland Hills City Council on the 12th day of November, 1996,
by a vote of ayes, nays, and abstentions.
