HomeMy Public PortalAboutOrdinance No. 807-96 11-12-1996 ORDINANCE NO. 8 0 7- 9 6 AN ORDINANCE ADDING A NEW SECTION 25 "FEES FOR COMMUNITY FACILITIES RENTAL" TO CHAPTER 1 OF THE RICHLAND HILLS CODE OF ORDINANCES; ESTABLISHING FEES FOR RENTAL OF FACILITIES IN THE RICHLAND HILLS COMMUNITY CENTER AND KATE BAKER PARK BUILDING; PROVIDING A SEVERABILTTY CLAUSE; PROVIDING A SAVINGS CLAUSE AND AN EFFECTIVE DATE. WHEREAS, fees for rental of facilities within the Richland Hills Commuity Center and Kate Baker Park buildings have previously been set and, from time to time, adjusted by city policy; and WHEREAS, the City Council of the City of Richland Hills, Texas, after study, finds and determines that the interests of the public will be better served if said fees are set by the City Council and set forth in the Richland Hills Code of Ordinances; and WHEREAS, the Richland Hills City Council, after study, finds and determines that the following, revised fees will adequately compensate the city for the use of the city facilities as enumerated below. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: SECTION 1. That Chapter 1 "GENERAL PROVISIONS" of the Code of Ordinances of the City of Richland Hills, Texas, as amended, be hereby amended by the addition thereto of a new Section 25 "FEES FOR COMMUNITY FACILITIES RENTAL", which new section shall hereafter be and read as follows: A. There are two (2) rooms within the Richland Hills Community Center Building and one room in the Kate Baker Park Builing which are available for rental during certain times when other community programming is not scheduled. The procedure for reserving these rooms, scheduling functions and resolving conflicts among scheduled functions shall be as set forth in the "City of Richland Hills Facility Rental Policy", as same now exists or as same may be revised from time to time. A copy of the current Richland Hills Facility Rental Policy is available at the Community Center office, located at 3204 Diana Drive, Richland Hills, Texas. All persons or organizations wishing to utilitize these City facilities are encouraged to obtain a copy of the current policies governing use of these facilities well in advance of the scheduled date of the event. B. The four rental periods and rental rates for such periods are set forth below. The listed fees shall be charged for all or any part of the rental period used. • • Community Center and Kate Baker Building lam-loam loam-4pm 4pm-llpm All Day Large Room $20 $30 $50 $75 $10 (extra cost for non-residents of Richland Hills) $100 -Deposit for all rentals Community Center lam-loam loam-4pm 4pm-llpm All Day Meeting Room $15 $15 $20 $25 $10 (extra cost for non-residents of Richland Hills) $100 -Deposit for all rentals C. The deposit amount listed above shall be required, in advance, of all persons, groups or organizations renting facilities within the listed city buildings. Said deposit shall be refundable, fully or partially, under the terms and conditions stated in the City of Richland Hills Facility Rental Policy referred to hereinabove. SECTION 2 Severability Clause. That it is hereby declared to be the intention of the City • Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 3 Saving Clause. That Chapter 1 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 4 Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas; PROVIDED, however, that the new fees and deposit amount shall take effect for all rentals beginning on or after January 1, 1997.
