RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES CONTRACT
FOR ENGINEERING SERVICES WITH T &M ASSOCIATES
FERRY TERMINAL PERMITS AND APPROVALS
WHEREAS, the Borough of Carteret is in need of engineering services with regard 'to
additional services related to Tasks 1 -4 with regard to the Ferry Terminal Project; and
WHEREAS, the Borough's Consulting Engineers, T &M Associates, possess the
requisite skill and expertise for said services; and
WHEREAS, T &M Associates has submitted a proposal to provide said engineering
services at a total cost not to exceed $240,000.00; and
WHEREAS, the Mayor and Council have reviewed said proposal;
WHEREAS, the Chief Financial Officer has certified that funds are or will be available
for said purpose. Account # e -04 -16 -102 -201
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:
1. That the proposal from T &M Associates for engineering services
with regard to Tasks 1 -4 for the Ferry Terminal Project at a total
cost not to exceed $240,000.00 at the rate set forth in T &M's
existing contract with the Borough is hereby approved.
2. That annexed hereto is a copy of said proposal.
3. That this action is approved as an award of a professional services
contract pursuant to N.LS.A. 40A:11- 5(l)(a) in accordance with
the Borough's Fair and Open Process as authorized by law.
4. That a copy of this resolution be forwarded to the Borough's
Purchasing Department, T &M Associates and Borough Director of
Engineering.

May 18, 2020
In response to your May 4th email requesting a revised proposal, T &M Associates (T &M) has modified
both the form and the content of this proposal. This revised proposal captures the effort for the services
established in fall of 2019 for CED and project permitting. Upon your authorization, T &M will continue
with the project Counsel and the NJDOT team. We will advance applications by REVISING / UPDATING
preliminary plans and reports to current standards and any new or revised Borough's plans for this project.
BACKGROUND
T &M and our project team and staff are uniquely qualified to continue to advance the project to the benefit
of the Borough. The coordination by the current team and the successes we have had with nudti- permit
meetings and individual agency meetings will assure a smooth transition through this process.
T &M proposes to provide the following scope of services for the preparation and submission of the permit
applications related to the ferry terminal as specified in the details below. The intent of this proposal is to
address the regulatory requirements, thus providing a better understanding of the final design parameters.
Accordingly, this proposal does not include final design, construction administration and inspection
services and building design services. These services will be addressed at a future date.
TASK 1. SITE LAYOUT
Due to a significant change in existing conditions (Agrico Site), as well as the NJDEP and USACOE
regulations, the site layout will need to be redesigned. Specifically, the adjacent grading and the new
storrnwater rules will require significant analysis of the site layout and redesign. This effort includes
coordination with the Geosyntec (Agrico) site capping, review of the site elevations for impacts to the site
plan, drainage plans, permitted Riverwalk, viewing platform, ADA ramps, gangway layout, the addition of
a stairway from the viewing platform to loading platform and additional bulkheading surrounding the
viewing platform layout. T &M will review these features in comparison to the basemap obtained and
provided to T &M by the Borough for use in developing the required permit plans.

TASK 2. PRELIMINARY MARINE DESIGN (FOR PERMITTING TASK)
The US Bulkhead Line and US Pier Line restrict the ferry slip layout and its amenities. The concept plans
as prepared by T &M Associates in 2013 and revised in November 2019 will be used as the basis for the
site plan revisions. This configuration will permit installation of the wave screen system within the US Pier
Line limits and allow for future expansion if desired. In advance of the ferry operator selection the Borough
has selected to utilize a ferry vessel that is 80' long, carrying 149 passengers and has prepared specifications
in February 2020 for purchase of the vessel.
As pall of the revised marine design, we will refine the 2014 preliminary plan layout to accommodate the
actual site conditions noted in the revised field survey, site plan revisions and future vessel specifications
(freeboard and draft). Overall this effort includes coordination with the site elevation revisions and impacts
to the site plan, Riverwalk elevations, viewing platform, ADA ramps, gangway layout, the addition of a
stairway from the viewing platform to loading platform and additional bulkheading surrounding the viewing
platform layout. Secondary impacts include revisions to the dredging of the waterway, permitting, channel
location, wave screen, pile systems, fenders, ADA accessibility to the dock and boat (gangways and
intermediate platforms) and plans previously developed for the smaller vessel.
T &M will develop the permit plan submission for the marine facilities and coordinate review of S.T.
Hudson's performance specification for the wave attenuators where necessary to obtain the required
permits. T &M will prepare drawings and specifications to the extent necessary to apply for required
enviromnental permits. Furthermore, it is our understanding that an updated hydrographic survey, by others,
will be obtained within 6 months of the permit submission as required by NJDEP,
We anticipate interim design plans for the submission of all permit applications.
TASK 3. REQUIRED STATE, FEDERAL AND AGENCY APPROVALS
After recent meetings with the Borough and stakeholders we have identified the following approvals are
required.
NJDEP APPROVALS
NJDEP Waterfront Development Permit
The ferry terminal site is subject to the tidal flow of the Arthur Kill. Installation of the ferry terminal
at this site will require construction activities at and below the Mean High -Water Line (MHWL) of
the Arthur Kill. These activities include dredging, pile driving, bulkhead construction, and
associated improvements. A NJDEP Waterfront Development Permit is required to authorize these
activities. T &M will prepare the Waterfront Development Permit application in accordance with
the Rules on Coastal Zone Management (N.J.A.C. 7:7E -11 et seq.). The application will include
an executed LURP Form, Compliance Statement, site location maps and color photographs, public
notice documentation, and fifteen (15) sets of signed and sealed interim design plans. These plans
may require revisions based on the regulatory agency review.
As a portion of this task, we will coordinate with the NJDEP to confirm that the existing sediment
samples will be accepted given the duration of time between sampling and application submittal

and to confirm whether a new hydrographic survey will be required. If additional sampling or
survey are required, we assume the Borough will contract these services separately.
Tidelands Grant Modification
T &M has determined that a tidelands grant has been issued for the site currently identified as Block
5.02, Lot 1.01. T &M will prepare the necessary documents and coordinate with the Department's
Bureau of Tidelands Management in order to obtain a grant modification. The grant modification
will be designed to include the entire area of the ferry terminal.
Freshwater and/or Coastal Wetland Permit
The project area contains a very limited area of coastal wetlands in the southeastern portion of the
site. The remainder of the waterfront portion of the site is classified as State Open Water. These
areas have already been delineated and surveyed at the site. The wetlands are regulated by the
NJDEP under the Freshwater Wetland Protection Act since available mapping does not identify the
area as containing coastal wetlands. The current concept design may require installation of an
outfall structure and associated scour protection in order to convey storm water from the proposed
parking area. If necessary, T &M will prepare and submit a Freshwater Wetland General Permit
Number 11 (GP -11) to authorize grading and construction of the outfall structure. A Compliance
Statement demonstrating compliance to the regulatory criteria of GP - II will be prepared and
submitted with the Waterfront Development Permit.
The total wetland impact will be calculated by comparing the design to the completed delineation.
T &M will make every effort to minimize wetland impacts while still meeting the goals of the
project. If the freshwater wetland impacts exceed 0.25 acres, they have to be mitigated on a 2:1 to
3:1 ratio.
Intertidal / Subtidal Shallows Mitigation
The project will impact inter -tidal and sub -tidal shallows of the Arthur Kill. In accordance with
applicable USACOE/NJDEP regulations, mitigation for the impacts will be required on a 1:1 basis.
T &M will prepare a concept for completing the mitigation for review by the agencies. The concept
effort will include identification of potential mitigation sites, concept mitigation plan, consultation
with the agencies, and preparation of an assessment of potential mitigation alternatives.
The final design of the wetlands mitigation is subject to NJDEP approval of the concept plan. A
final design service for wetlands mitigation is not included in this scope of services. Once we
receive concept plan approval from the NJDEP and USACOE, we will provide a final design
proposal to the Borough for the wetlands mitigation.

FEDERAL APPROVALS
Army Corps of Engineers — Individual Permit Application
Preliminary conversations with the USACOE indicate that the proposed project does not qualify
for a Nationwide Permit. As such, T &M will prepare and submit the information required to apply
for an Individual Permit. This submission will include a full description specifying the need for the
project; identification of temporary and permanent impacts; and any applicable measures taken to
mitigate project impacts on sensitive areas.
Essential Fish Habitat Assessment
An Essential Fish Habitat Assessment will be prepared and submitted to the National Marine
Fisheries. The assessment will contain a detailed written and graphic presentation of all life stages
of marine and estuarine finfish that may potentially use the waters of the project area. The
assessment will also present a detailed analysis of how the project may impact the life stages of
these finfish and will include a list of mitigative measures that will eliminate and /or reduce the
project impacts.
US Coast Guard /NJ State Police/Honrcland Security Clearance
T &M will work with representatives from the US Coast Guard, State Police, and Homeland
Security in order to obtain all appropriate security approvals. It is anticipated that approvals will
be obtained by preparation of a Facility Security Plan in accordance with 33 CFR Part 105; the plan
will be submitted to the Coast Guard Captain of the Port for review and approval. The plans will
also incorporate the requirements of State, County, and local security regulations. The plan will
contain facility physical security systems and maintenance, access control, security plans,
personnel training, and other fequired topics
COUNTY APPROVALS
Soil Erosion Plans
We will review the final revised Dupont Corporation filling and grading plans and Maser Riverwalk
plans to determine any impacts to the previously developed soil erosion and sediment control
submittal and make any required revisions to the application documents. These revisions will
encompass the plans, details, notes and application forms.
TASK 4. CATEGORICAL EXCLUSION DOCUMENT (COORDINATION & SUPPORT)
The Interagency Review Committee (IRC) determined on March 22, 2018 that a Categorical
Exclusion Document would be accepted in place of the Environmental Assessment Process. The
CED is being led by NJDOT and McCormick Taylor with extensive support from T &M to satisfy
the NEPA process. As you are aware this process requires close coordination with the NJDOT and
their subconsultant McCormick Taylor including providing copies of the pertinent design studies
and plans developed since the inception of the project in 2011. Additional elements of work
required to secure the CED are weekly coordination meetings with the Borough, NJDOT and

McCormick Taylor, participation in Stakeholders meetings (USCG, Army Corps, NJ Transit,
Harbor Ops, etc.) and Public Information Centers, coordination with NJDEP, supplemental reports
and project documentation excluded from our original proposal.
CLARIFICATIONS
• Estimated fees for the permits outlined herein are anticipated to be a total of approximately $70,000.
These permit fees are the responsibility of the Borough and have not been included in our fee
proposal.
• This scope of services assumes all hazardous material remediation design services (specifications,
etc.) will be provided by others (Dupont, EXCEL and /or NJDEP).
This scope of services does not include set-vices to design, construct and /or monitor wetlands
mitigation.
This scope of services does not include services for additional assessments or impact analysis
tasks that may result from agency environmental reviews, including threatened & endangered
species studies, or cultural resource studies,
Hydrographic survey and sediment sampling, if required, will be directly paid / contracted by the
Borough of Carteret.
All expenses including miscellaneous expenses and /or any subcontractor fees will be paid directly
by the Borough of Carteret in accordance with our standard agreement with the Borough.
This proposal does not include final design plans, construction administration and inspection
services. A subsequent proposal will require approval for that effort.
• This proposal does not include building design or utility design for the ferry terminal facility or
extension/approval for offsite utilities for the facility or site activities.
FEE SUMMARY
To advance the Ferry Terminal project through the permitting process, T &M requests that the Borough
authorize a fee of $240,000. This fee will allow its to advance from the fall of 2019 forward and continue
the permit acquisition elements described herein utilizing the revised plans referenced above to advance the
project towards completion and prepare for subsequent phases and future final design.
Our proposal anticipates this phase of the project would be completed within twelve (12) months from
authorization as follows:
