• AN ORDINANCE REPEALING SECTION 13 "WASTEWATER
SYSTEM ADVISORY BOARD" OF CHAPTER 13 "ADVISORY
BOARDS" OF THE CODE OF ORDINANCES, CITY OF
RICHLAND HILLS, TEXAS; ABOLISHING THE WASTEWATER
SYSTEM ADVISORY BOARD WITHIN THE CITY; PROVIDING
A SAVING CLAUSE; PROVIDING A SEVERABILTTY CLAUSE;
AND AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Richland Hills, Texas, has heretofore
in August of 1995 created the Richland Hills Wastewater System Advisory Board; and
WHEREAS, the ordinances creating said Wastewater System Advisory Board are
contained in Section 13 "WASTEWATER SYSTEM ADVISORY BOARD" of Chapter 13
"ADVISORY BOARDS" of the Code of Ordinances of the City of Richland Hills,
Texas, as amended; and
WHEREAS, one of the provisions of said section is a sunset provision which
requires the City Council to review the functions of the Wastewater System Advisory
Board after it has been active for at least one (1) year, and to determine whether the
continued existence of said advisory board shall further the best interests of the
citizens of Richland Hills; and
WHEREAS, the City Council of the City of Richland Hills, acting pursuant to
the said provision, has reviewed the functions of the Richland Hills Wastewater
System Advisory Board, and has determined, based on that review, that the continued
• existence of said advisory board would not further the best interests of the citizens
of Richland Hills; and
WHEREAS, the provisions of said section further require, upon such finding, that
the continued existence of said Wastewater System Advisory Board should cease.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
I.
That Section 13 "WASTEWATER SYSTEM ADVISORY BOARD" of Chapter 13
"ADVISORY BOARDS" of the Code of Ordinances of the City of Richland Hills,
Texas, as amended, together with Ordinances Nos. 755-95, 757-95 and 781-96, which
created and amended said section, be and the same are hereby repealed in their
entirety.
II.
That the Wastewater System Advisory Board established by the ordinance
provisions and City code section described in paragraph I above be and the same is
hereby abolished.
III.
• That the City Council of the City of Richland Hills, Texas, hereby expresses its
appreciation for the efforts of the members of the Wastewater System Advisory
Board on behalf of the City of Richland Hills.

IV.
• Saving Clause. That Chapter 13 of the Code of Ordinances, City of Richland
Hills, Texas, as amended, shall remain in full force and effect, save and except as
amended by this ordinance.
V.
Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
VI.
Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Richland Hills City Charter and the
laws of the State of Texas.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting of
the Richland Hills City Council on the 8th day of Aril 1997, by a vote
of 4 ayes, ~ nays, and 0 abstentions.
