HomeMy Public PortalAboutOrdinance No. 816-97 04-08-1997 ORDINANCE NO. 816-97 AN ORDINANCE AMENDING SECTION 13 "C-2 GENERAL CONIlI~RCIAL DISTRICT" OF CHAPTER 12 "ZONING" OF THE CODE OF ORDINANCES OF THE CITY OF RICHLAND HILLS, TEXAS, AS AMENDED; ADDING A NEW SUBSECTION TO ALLOW LIVING QUARTERS FOR OVERNIGHT SECURITY GUARDS, BY SPECIAL USE PERMIT ONLY, IN CERTAIN SITUATIONS; PROVIDING A 5EVERABILTTY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, certain businesses located on property zoned C-2 "GENERAL COMMERCIAL" within the City of Richland Hills have expressed a need to maintain around-the-clock security guards on their premises and, in connection therewith, to provide rudimentary sleeping quarters for such guards on such premises; and WHEREAS, residential uses in general are not permitted as new uses in the C-2 General Commercial district; and WHEREAS, the City Council of the City of Richland Hills, Texas, finds and determines that in certain limited circumstances it may be desirable to allow a business located on property zoned C-2 General Commercial to provide rudimentary sleeping and living quarters for security personnel on such premises; and WHEREAS, the City Council further finds and determines that such use should be allowed only by special use permit under the terms and conditions provided in the zoning ordinance and to be imposed by the City Council with reference to a specific special use permit request. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Subsection B "Generally" of Section 13 "C-2 GENERAL COMMERCIAL DISTRICT" of Chapter 12 "ZONING" of the Code of Ordinances of the City of Richland Hills, Texas, as amended, be hereby amended by the addition thereto of a new paragraph 7, which new paragraph shall hereafter be and read as follows: (7) Security personnel to provide security overnight, on weekends or holidays, or around-the-clock continuously, and basic housing for such person or persons, may be provided for uses within this district, but all such housing shall be located within the main business structure on the property. Furthermore, such use will only be allowed by special use permit, if granted in the discretion of the City Council under other provisions of this Chapter. ORDINANCE NO. PAGE 1 II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 12 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
