HomeMy Public PortalAboutOrdinance No. 821-97 09-09-1997 ORDINANCE NO. 8 21- 9 ~ AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 800-96 AND THE FISCAL YEAR 1996-97 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; AS AMENDED BY ORDINANCE NO. 805-96; INCREASING CERTAIN FUND APPROPRIATIONS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 800-96 on September 24, 1996, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 1996-97; and WHEREAS, changed conditions resulted in the adoption of Ordinance No. 805-96 on November 12, 1996, amending the budget adopted by Ordinance No. 800-96; and • WHEREAS, changed conditions and circumstances, which could not have been foreseen through the use of reasonably diligent thought and attention, have necessitated a certain amendment to Ordinance No. 800-96 and the budget adopted thereby; and WHEREAS, a public hearing on the following amendment to the fiscal year 1996-97 budget contemplated hereby has been held as required by law. NOW, THEREfORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Section II of said Ordinance No. 800-96 as amended, be amended to increase the general fund appropriation from $3,300,431 to $3,320,541 with such increase allocated and appropriated as follows: $20,110, such sum the surplus from the 1996 Personal Property Finance Contractual Obligations issue, for transfer to the 1996 Contractual Obligations Interest and Sinking Fund as required by said issuance ordinance for repayment of debt. II. That Section XVI of Ordinance 800-96 as amended, be amended appropriating $30,000 out of the 1994 Contractual Obligations Acquisition Fund for the purchase of capital assets. III. That Section VI of Ordinance 800-96 as amended, be amended appropriating $76,500 out of the 1993 Interest and Sinking Fund for the payment of general long-term debt principal and interest. IV. • Ordinance 800-96, as amended, be amended to add a new section XVI11- 1, appropriating $84,600 out of the general fund and $33,050 out of the enterprise fund for placement into the Equipment Replacement Fund as required by Ordinance No. 806-96. V. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. • ' vl. Saving Clause. That Ordinance No. 800-96 as amended by Ordinance 805-96 of the City of Richland Hills, Texas, shall remain in full force and effect, save and except as amended by this ordinance. VII. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
