HomeMy Public PortalAboutOrdinance No. 822-97 09-09-1997 ORDINANCE NO. 8 2 2- 9 7 • AN ORDINANCE BY THE CITY OF RICHLAND HILLS ADOPTING A BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1997 AND ENDING SEPTEMBER 30, 1998, IN ACCORDANCE WITH TEXAS STATUTES AND THE CHARTER OF THE CITY OF RICHLAND HILLS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Manager of the City of Richland Hills has submitted a budget proposal to the City Council prior to the beginning of the fiscal year as required by the City Charter; and WHEREAS, said budget proposal sets forth the estimated revenues and expenditures for each fund for the current and proposed fiscal year; and WHEREAS, the City Council finds that all provisions pertaining to the adoption of a budget contained in the City Charter have been complied with; and • WHEREAS, the City Council has held a public hearing on said proposed budget; and WHEREAS, after full consideration, the City Council is of the opinion that the budget should be approved and adopted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS, THAT: I. The budget estimate of the Revenues of the City of Richland Hills and the estimate of the Expenses for the Fiscal Year beginning October 1, 1997, and ending September 30, 1998, attached hereto as Exhibit "A", (hereinafter called "the budget") is hereby adopted. • ORDINANCE NO. 8 2 2- 9 7 PAGE 1 • II. The sum of $3,437,911 is hereby appropriated out of the General Fund - $3,421,661 for the payment of Operating Expenses and Capital Outlays of the City Government, as set forth in detail in the budget; and $16,250 for transfer to the Police Station Repayment Fund to repay reserves for funds used in the construction of the new Police Station. III. The sum of $2,266,650 is hereby appropriated out of the Enterprise Fund for the following public purposes: 1. $1,754,891 for the Operating Expenses and Capital Outlays of the Water and Sewer Works as set forth in the budget. 2. $16,250 for transfer to the Police Station Repayment Fund. 3. $147, 850 for transfer to the 1993 Utility System Revenue Bond Interest and Sinking Fund for the repayment of principal and interest on long-term debt. • 4. $32,109 for transfer to the 1993 Utility System Revenue Bond Reserve Fund in accordance with the revenue bond issuance ordinance. 5. $315,550 for transfer to the 1997 EPA/Wastewater Improvement Project Interest and Sinking Fund for the repayment of principal and interest on long-term debt. IV. The sum of $49,650 is hereby appropriated out of the Parks and Beautification Fund for Operating Expenses and Capital Outlays for public parks, recreation and beautification facilities or programs as set for in the budget. • ORDINANCE NO. 8 2 2- 9 7 PAGE 2 • V. The sum of $147,850 is hereby appropriated out of the 1993 Utility System Revenue Bond Interest and Sinking Fund for the repayment of water and sewer works long-term debt principal and interest. VI. The sum of $315,550 is hereby appropriated out of the 1997 EPA/Wastewater Improvement Project Interest and Sinking Fund for the repayment of wastewater works long term debt principal and interest. VII. The sum of $23,465 is hereby appropriated out of the 1994 Contractual Obligations Interest and Sinking Fund for the repayment of general long-term debt principal and interest. VIII. • The sum of $88,504 is hereby appropriated out of the Enterprise Fund Capital Projects Fund for capital outlays in conjunction with the water and sewer systems. IX. The sum of $125,000 is hereby appropriated out of the 1993 Utility System Revenue Bond Improvement Fund for capital outlays in conjunction with the water and sewer systems. X. The sum of $1,126,000 is hereby appropriated out of the EPA/AO Wastewater Improvement Project Fund for capital improvements to the wastewater works. XI. The sum of $166,614 is hereby appropriated out of the Drainage Utility Fund for drainage system improvements in accordance with the City's drainage ordinance and state law. • ORDINANCE NO. 8 2 2- 9 7 PAGE 3 XII. • The sum of $887 483 is hereb a ro riated out of the Economic Develo ment 4B Sales Y PP P P Tax Fund for capital outlays in conjunction with economic development activities, street and water system improvements. XIII. The sum of $375,000 is hereby appropriated out of the Road and Street Improvement Fund for capital outlays in conjunction with street improvements. XIV. The sum of $4,700 is hereby appropriated out of the Municipal Court Building Security Fund for building security and bailiff costs. XV. The sum of $20,110 is hereby appropriated out of the 1996 Contractual Obligations • Acquisition Fund for the purchase of capital assets. XVI. The sum of $42,600 is hereby appropriated out of the 1996 Contractual Obligations Interest and Sinking Fund for the repayment of general long-term debt principal and interest. XVII. The sum of $224,200 is hereby appropriated out of the Equipment Replacement Fund for the purchase of Capital Assets. • ORDINANCE NO. 8 2 2- 9 7 PAGE 4 • XVIII. The City Manager is hereby authorized to make line-item and departmental budget adjustments during said fiscal year in order to avoid over-expenditures of particular line items. Said adjustments require no further Council action if the total appropriation for each fund as set forth herein is not exceeded. Expenditures in excess of the herein adopted appropriations for each fund require budget amendments in accordance with the Charter of the City of Richland Hills. XIX. The advertisement and bidding requirements contained in the Richland Hills City Charter for contracts of less than $5,000 are hereby waived, and the City Council hereby directs the City Manager to seek such contracts upon terms which are most advantageous to the City, considering price, quality, reputation of vendor and other appropriate factors, and all such contracts for which sums have been appropriated in the Budget attached hereto are hereby approved, and the City Manager is hereby authorized to execute said contracts on behalf of the City. XX. City staff is hereby authorized to seek proposals for such professional services as are • provided for in the budget. XXI. The City Manager is hereby authorized to approve, award, and execute contracts for professional and consulting services if the contract amount does not exceed $5,000. Any such contract for an amount in excess of $5,000 must be approved by the City Council. In no case shall any such contract be approved unless funds are available for fulfillment of same. XXII. The Fiscal Year 1997-1998 Capital Improvements Plan contained in the budget documents is hereby approved. • ORDINANCE NO. 8 2 2- 9 7 PAGE 5 XXIII. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. XXIV . Effective Date. This ordinance shall be in full force and effective from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas; provided, however, that the new municipal budget provided for in this ordinance shall take effect October 1, 1997.
