A RESOLUTION RESTRICTING RETAIL MARIJUANA OPERATIONS ON LAND
OWNED BY THE PUEBLO WEST METROPOLITAN DISTRICT
PUEBLO WEST METROPOLITAN DISTRICT
WHEREAS, the Board of Directors of the Pueblo West Metropolitan District has reviewed
the current number of retail marijuana facilities currently located within Pueblo West
Metropolitan District's boundaries; and
WHEREAS, the Board of Directors has reviewed the current number of marijuana
cultivation and infusion centers currently located within the Pueblo West Metropolitan
District's boundaries; and
WHEREAS, the Board of Directors has sought out input from concerned citizens of the
Pueblo West Metropolitan District; and
WHEREAS, the Board of Directors, by way of Resolution 2014-33, requested the Pueblo
County Commissioners not grant any additional licenses within the Pueblo West
Metropolitan District's boundaries for the sale or cultivation of retail marijuana; and
WHEREAS, it is not believed to be in the best interest of the Pueblo West Metropolitan
District to have a large concentration of retail marijuana outlets or marijuana cultivation
and infusion centers within the Pueblo West Metropolitan District's boundaries; and
WHEREAS, the Board of Directors, having heard the concerns and requests of citizens,
agrees that the number of licenses granted for retail marijuana outlets and retail marijuana
cultivation centers within the Pueblo West Metropolitan District's boundaries exceeds the
number of licenses that should be granted in this community; and
WHEREAS, the District currently owns 281 properties zoned as follows: A-3=19, R-1=9,
R-3=10, R-4=37, R-5=78, B-1=25, B-4=86, and 1-2=17.
WHEREAS, the Board of Directors believes it would be in the best interest of the district
to place restrictions, intended to run with the land, on District owned properties restricting
the sale, transfer, cultivation, infusion and manufacture of retail marijuana, cannabis, and
hemp products.
THEREFORE, BE IT RESOLVED by the Board of Directors of the Pueblo West
Metropolitan District that the Board of Directors does hereby direct staff to draft and record
deed restrictions on all Industrial and Business zoned District owned property, to run with
the land, restricting retail marijuana, cannabis, or hemp manufacture, growing, sales,
extraction, baking, transfer, distribution, transportation and infusion.
I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed
and adopted at a regularly held meeting of the Board of Directors of the Pueblo West
Metropolitan District on the 13 day of December, 2016, by the following vote:
AYES, and in favor thereof, Directors: Barbara Bernard, Mike French
Judy Leonard, Terry Zupan
NOES, Directors: Mark Carmel
