HomeMy Public PortalAboutOrdinance No. 831-98 02-10-1998 ORDINANCE NO. 831'98 AN ORDINANCE AMENDING THE TITLE AND SUBSECTIONS A AND B OF SECTION 6 "CLEAN CITY COMMISSION" OF CHAPTER 13 "ADVISORY BOARDS" OF THE CODE OF ORDINANCES OF THE CITY OF RICHLAND HILLS, TEXAS, TO CHANGE THE NAME OF SAID CLEAN CITY COMMISSION TO THE "KEEP RICHLAND HILLS BEAUTIFUL COMMISSION' ; PROVIDING A SEVERABILTTY CLAUSE; PROVIDING A SAVING CLAUSE; AND AN EFFECTIVE DATE. BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY RICHLAND HILLS, TEXAS: I. That Subsection A "CREATION: QUALIFICATION Ok' MEMBERS" and paragraph (1) of Subsection B "COMPOSITION, APPOINTMENTS AND TERMS OF MEMBERS" of Section 6 "CLEAN CITY COMMISSION", together with the title of said Section 6, of Chapter 13 "ADVISORY BOARDS" of the Code of Ordinances of the City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: SECTION 6: KEEP RICHLAND HILLS BEAUTIFUL COMMISSION • A. CREATION: QUALIFICATIONS OF MEMBERS There is hereby created the Keep Richland Hills Beautiful Commission. Members of the commission shall be registered voters within the city on the date of their appointment. No member may serve in any capacity on more than one other Richland Hills standing board, commission and committee, or any special committee exceeding six month's duration; or serve as city representative to a local, state or national organization. All members shall serve without compensation. No debts of any kind or character shall be made or incurred by the commission or by anyone acting in its behalf. B. (1) The Keep Richland Hills Beautiful Commission shall be composed of ten (10) members who shall hold designated places la, lb, 2a, 2b, 3a, 3b, 4a, 4b, Sa, and Sb. Each councilmember shall be entitled to nominate persons to serve on said commission in the numbered place corresponding to the numbered place on the City Council held by said councilmember. All nominations shall be approved unless rejected by the affirmative vote of four (4) councilmembers. Members' terms shall coincide with the term of the council place number of the councilmember appointing each member. II. Severability Clause. That it is hereby declared to be the intention of the City . Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality ORDINANCE NO. PAGE 1 shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 13 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
