AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING ARTICLE VI, OF THE CHARTER OF THE CITY OF JEFFERSON, SECTION 6.4 OF THE CHARTER OF THE CITY OF JEFFERSON PERTAINING TO FIREMEN'S PENSION FUND. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Article VI (Administrative Organization and Personnel System) of the Charter of the City of Jefferson shall be amended to read as follows: "Section 6.4. Firemen's Pension Fund. (a) Funcl. Nothing in this charter shall be construed as prohibiting the City Council from creating, more than one method for provide pension benefits to firefighters so long; as no vested rights are abridged without the consent of the employee or retiree. Section 2. The amendment as set forth in Section 1 shall be submitted to the qualified voters of the City of Jefferson, Missouri, for their approval, at the election to be held on the 5`11 day of April, 2005, at the places designated by the Election Authority for said election and the ballot shall be in substantially the following form: PROPOSITION Shall the Charter ol'the City ul'.1cl'16-smi be anlendeci by the repealing: of'Section 6.4(a) Fil-CI11C11'S Pension Fund, and the enacting; of new Section 6.4(a) Firemen's pension Fund, in lieu thercol'to expand explanation ofthcc.Council's ability to create more than one method flor providing pension benefits to lirclighters as provided in Ordinance No. 13832 passed and 1►pI I'ovecl by the ('ity COU11 it on.lanuary 18, 2005. The Mayor and City Clerk shall prepare and execute the form of the Notice of said Election and shall transmit the same to the Election Authority for the City of Jefferson, Missouri and request said election be conducted by law. Section 4. If a majority of the qualified voters voting at said election shall vote in favor of the approval of this ordinance, then the same shall be binding in full force and effect from and after such approval or May 1, 2005 whichever is later. Section 5. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, as such holdings shall not affect the validity of the remaining portion thereof. Section 6. This Ordinance shall be.in full force and effect from and after the date of its passage and approval.
