Charlotte Degen did not participate. Also participating remotely: Jon Idman, Town Planner, and Lynn St. Cyr, Senior Department Assistant. Pursuant to Chapter 20 of the Acts of 2021, this meeting will be conducted in person and via remote means, in accordance with applicable law. This means that members of the public body may access this meeting in person, or via virtual means. In person attendance will be at the meeting location listed above, and it is possible that any or all members of the public body may attend remotely. No in-person attendance of members of the public will be permitted, and public participation in any public hearing conducted during this meeting shall be by remote means only. The meeting will be broadcast live, in real time, via Live broadcast (Brewster Government TV Channel 18), Livestream (livestream.brewster-ma.pov), or Video recording (tv.brewster-ma.gov). The Planning Board packet can be found on the Planning Department page on the Town of Brewster website (www.brewster-ma.gov). Hillis -Dineen declared that a quorum of the Planning Board was present. 6:33 PM CITIZEN'S FORUM Glenn Casey, 288 Fletcher Lane, addressed the Planning Board regarding the proposed Millstone Road Affordable Housing Development. He stated that it is a myth that there is an urgent need for affordable housing in Brewster. Casey stated that for Serenity and Brewster Woods most of the housing applicants came from off Cape. He urged local boards to look at the project costs and ask the applicants to review the costs due to inflation and supply chain issues. 6:39 PM PUBLIC MEETING Approval Not Required, Case No. 2023-01: Applicants/Owners: Duane Doolittle and Cristian 0. Diaz Avalo through their I Donald T. Poole, P.L.S. of Outermost Land Survey, Inc., seek endorsement of an Approval Not Required Plan for property located at 8 White Oak Trail and 7 and 9 Thousand Oaks Drive and shown on Tax Map 107, Parcels 20 and 21 respectively, within the Residential Low Density (R -L) Zoning District. The plan is pursuant to MGL c. 41 §81L and §81P and §2904 of the Brewster Subdivision Rules and Regulations. Documents: • 01/20/23 Approval Not Required application including plans dated 09/20/22 • 01/31/23 Staff Report Don Poole participated remotely on behalf of the Applicants. Poole stated that the plan proposes an equal area land swap. He stated that the properties conform to zoning and have sufficient frontage. He requested endorsement of two plans as one will need to be filed with the Land Court and the other with the Registry of Deeds. Michaels asked whether the new lot lines would require the property owners to obtain variances for the existing sheds. He also stated that there are two sheds on the property to the east and one of the two sheds may need to be relocated to comply with setbacks. Bebrin stated that the point of the review is to determine if the lots have adequate frontage and both proposed lots do have adequate frontage. Motion by Taylor to Endorse Approval Not Required. Case No, 2023-01. Second by Bebrin. Roll call vote: Freitas -yes; Michaels -yes; Wentworth -yes; Taylor -yes; Bebrin-yes; and Hillis -Dineen -yes. Vote: 6-0-0. 6:45 PM PUBLIC MEETING CONTINUED Maior Stormwater Management Permit, Case No. 2023-01: Applicant/Owner: Lisa Mullin through her representative John M. O'Reilly, P.E., P.L.S. of J.M. O'Reilly & Associates, Inc., has submitted an application for property located at Tubman Road, Lot 3 on Plan Book 698, Page 11 and formerly shown as part of Tax Map 55, Parcel 142. The Applicant seeks a major stormwater management permit to construct a single-family dwelling and supporting improvements pursuant to Brewster Town Code Chapter 272 and its accompanying Regulations. Documents: • 01/26/23 Stormwater +0 i+ ermApplication including plans dated 01/24/23 • 01/27/23 Stormwater Management Report and Operations & Maintenance Manual including 01/24/23 HydroCAD Report • 01/31/23 Staff Report • 02/01/23 Letter from John O'Reilly John O'Reilly participated remotely on behalf of the Applicant Lisa Mullin. The Applicant was also present. O'Reilly stated that the Applicant is seeking a major stormwater management permit to construct a single-family dwelling. The building will be 1100 SF with 18000 SF of vacant land on Tubman Road being disturbed. The lot slopes toward Tubman Road from about the midpoint. A paved driveway will be constructed up to a graded area where the house will be built into the hillside. The roof runoff will be handled through gutters, downspouts, and a drywell sized for a 100 -year storm. The rest of the runoff will be captured through a grassed channel on the northside of the driveway and a solid catch basin with subsurface leaching facility. A waiver from the phosphorous requirement has been requested. Michaels asked what best management practices (BMP) would be used to address total phosphate. O'Reilly responded that phosphorous could be addressed through a vegetated swale or basin, retention pond, or constructed wetland. For the Applicant's property, it will be addressed somewhat by a deep sump catch basin which will have a hood for TSS reduction as well. Michaels asked if a bioswale was being used as a BMP. O'Reilly responded that no bioswale was proposed because the lot climbs quickly from the road and more disturbance would be needed to create a level area for a swale. O'Reilly further stated that water will run through the grass channel so there will be uptake of some nutrients and suspended solids. Motion by Michaels to Approve Maior Stormwater Management Permit, Case No. 2023-01 with Requested Waiver, subject to the Conditions Required by the Stormwater Management Regulations. Second by Bebrin. Roll call vote: Freitas -yes; Michaels -yes; Wentworth -yes; Taylor -yes; Bebrin-yes; and Hillis -Dineen -yes. Vote: 6-0-0. 6:54 PM FOR YOUR INFORMATION The Planning Board discussed information they received on upcoming workshops through the Lower Cape Housing Institute, public hearings on zoning amendments, and the Citizen Planner Training Collaborative conference. 6:56 PM COMMITTEE REPORTS Bebrin stated that the Vision Planning Committee is on a hiatus and will resume meeting after the Spring Town Meeting to work on the Local Comprehensive Plan to hopefully bring it to Fall Town Meeting. Taylor stated that the Community Preservation Committee voted to support three housing applications in Dennis, Wellfleet, and Orleans. Taylor stated that she wished Brewster would apply to other local towns for support with housing. Hillis -Dineen stated that there are several programs available to residents to help make home more affordable and urged people to contact the Housing PB Minutes 02/08/23 Page 2 of 3 Office for more information. Michaels stated that the Water Quality Review Committee has been reviewing a property off of Freeman's Way where remediation work is taking place in order to construct a solar array. Bebrin, a member of the Bay Parcel Planning Committee, announced that First Light Beach would be open beginning Memorial Day Weekend. The beach will be open on weekends until mid-June at which point it will be open 7 days per week. Work is also taking place on the pool to get it ready to open this summer hopefully right before July 4th weekend. The pool and the beach are expected to open at 7 am. Hillis -Dineen stated that the Brewster Affordable Housing trust recently held a meeting and discussed renovations to a house so that it may remain on the housing inventory and be sold. The Millstone Road Affordable Housing Development was also discussed. 7:04 PM FOR YOUR INFORMATION CONTINUED Hillis -Dineen announced that the Citizen Planner Training Collaborative's Annual Conference was on March 18th Motion by Bebrin to Adjourn.
