AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE
VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO, AND LYING SOUTH OF
THE PRESENT CITY LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED IN
SECTION 20 IN TOWNSHIP 44, RANGE 12 WEST IN THE COUNTY OF COLE, STATE OF
MISSOURI, AND AMENDING SECTION 1-17 OF THE CODE OF THE CITY OF JEFFERSON,
MISSOURI, DEFINING THE EXISTING CITY BOUNDARY BY ADDING ONE NEW SUB-SECTION
PERTAINING TO THE SAME SUBJECT.
WHEREAS, pursuant to Section 71.012.2 RSMo, 1994, the City Council of the City of Jefferson
desires to annex the unincorporated area of land described ill Section 1; and
WHEREAS, the owners of the property have submitted a petition to have their property included
within the corporate boundaries of the City of Jefferson; and
WHEREAS, the property is adjacent to the City and is located at the intersection of Rock Ridge
• Road and Route C; and
WHEREAS, a public hearing concerning the annexation was advertised on April 1, 2005 in the
Jefferson City Post Tribune; and
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The City Council intends to and shall proceed to annex, as provided by law,
the unincorporated area of land described as follows, containing approximately 84 82 acres, more
or less:

Section 2. The City Council finds and declares that the land described in Section 1 is contiguous to
the City boundary; that the annexation is reasonable and necessary to the proper development of the City;
and further, did determine the City has the ability to furnish normal municipal services to the area.
Section 3. A public hearing was held on April 1, 2005 as provided by law, concerning
the annexation of the unincorporated area described in Section 1.
Section 4. The land described in Section 1 shall be zoned RU Rural Use until such time
as the zoning may be changed in the manner provided for by State Statute and City Code.

Section 6. The annexed area shall be in Ward 4 of the City.
Section 7. The effective date of this Ordinance and the annexation of the area described
in Section 1 will be immediate upon passage provided that no written objections to the proposed
annexation are filed with the City Council. If sufficient objections are filed, this ordinance shall not
become effective until such time as the annexation issue has been resolved pursuant to the
provisions of Chapter 71 RSMo.

on April '14, 2005.
New Business — Public Hearings
Case No. P05015 - 8802 Rock Ridge Road; Voluntary Annexation by Petition of the
Landowner. Petition filed by property owners Cleo H. and Mildred M. Ehrhardt, Trustees, for
voluntary annexation of approximately 84 acres adjacent to and south of Covington Gardens
Subdivision, west of Rock Ridge Road and north of Route C Highwry. Zoning proposed is RU Rural
Use. The property is located in Section 20, Township 44 North, Range 12 West, Cale County
Missouri.
Ms. McMillan gave the Planning Division staff report and referred the Commission to the revised map
attached to their staff report. She explained that the subject property is located northwest of the
Route C and Rock Ridge Road intersection and contains approximately 82 acres according to the
revised calculation. She explained that the revision reflects the exclusion of three small properties
not owned by Mr. and Mrs. Ehrhardt. Ms. McMillan explained that this parcel was included as part of

the 2002 annexation attempt of the Southwest Area and is included in the City's 1996 Annexation
Plan. She stated that Covington Gardens Subdivision is located to the north and west. She stated
that the annexed property will be zoned RU, Rural Use, which permits agricultural and single family
residential uses.
Mr. Tom Winters, 4030 Vintage lane, inquired whether the subject properly could be expanded to
several houses or remain as is. Ms. McMillan explained that the property owners would have to
submit a request for rezoning and subdivide the property.
Mr. Brian Rodden, 4245 Vintage Court, asked to clarify information concerning infrastructure, whether
additional lots are proposed for this property. In response to Mr. Rodden's inquiry, Mr. Nathan
Nickolaus, City Counselor, explained that the voluntary annexation will accomplish bringing sanitary
sewers to the existing farm.
Mr. Rodden inquired whether existing residents in the area will be forced to hook up to the City's
sewer system and the cost. Mr. Nickolaus explained that residents cannot be forced to hook up to
the City's sewer system and also explained how the cost is determined.
Mr. Nunn moved and Mr. George seconded to recornmend approval of the proposed Ehrhardt
Voluntary Annexation and RU zoning to the City Council. The motion passed 6-0 with the following
votes:

Page 464 of the Cole County Recorder of Deeds lying north of the State Route C, and
west of Rock R.idLlc; Road, in the County of Cole, Missouri, more particularly described
as follows:
Beginning at the Southwest Corner of the Northeast quarter of the Northwest quarter of
Section 20, 'township 44 North, Range 12 West, said point being the true POINT OF
