HomeMy Public PortalAboutORD13712 BILL_ NO, 2004-1 SUBSTITUTE PASSED' SPONSORED BY COUNCILMAN Ferguson ORDINANCE NO.__. _l AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE PERSONNEL POLICY MANUAL FOR THE MUNICIPAL SERVICE OF JEFFERSON CITY, MISSOURI BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Section 3-3(h) Alcohol, Drug, and Controlled Abuse Policy of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: (h) Notice of Conviction. Any employee who is convicted of conduct in the workplace violating a criminal drug statute shall notify the City Administrator of the conviction within five calendar days after the conviction. Failure to report such convictions is a violation of this policy. All convictions of employees covered by the Federal Transit Authority(FTA) will be reported to the FTA upon notification to the Human Resources Department as required by the FTA. Section 2. Section 3-3(k) Alcohol, Drug, and Controlled Abuse Policy of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: (k) City's Right to Test. An individual shall not be hired to perform a safety sensitive function unless the individual passes a drug test of urine for evidence of marijuana, cocaine, opiates, phencyclidine (PCP), and amphetamines. All new hires and re-hires of full-time, part-time,or ternporary/seasonal employees may be required to take a urine or other medical test and to agree in writing to allow the results of those tests to be furnished to and used by the City. Those persons who do not pass such test(s) shall not be employed. An employee who is reasonably suspected of using alcohol or a prohibited drug, when a supervisor who is trained in the detection of alcohol and drug use can substantiate physical indicators of probable drug use, may be required to take a drug or alcohol test(s)or both. A supervisor's reasonable suspicion must be based on specific contemporaneous, articulated observations concerning the appearance, behavior, speech or body odors of the dttiver employee. Testing may also be performed just before or just after the work shift of the employee. Section 3. Pre-Employment/Pre-Transfer Test, The City will test job applicants for current drug use prior to offering successful applicants employment, promotions In a position with supervisory responsibilities,er transfers from one department to another, or those departments with promotional procedures adopted by ordinance requiring testing. Seasonal and part-time without benefits positions may be excluded from this type of testing. Section 4. Section 8-10. Salary Increase and Bonuses of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: Section 8-1. Merit and Career Development Section 5. Section 8-11(b). Pay Rate Adjustments of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: (b) Promotion. When an employee is promoted from a position in one class to a position in another class having a higher maximum salary, the City Administrator m iy approve a salary increase of 4 1096 as long as the new salary rate is within the new pay range. Section 8-12, Temporary Assignment To Higher Level Position of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: Section 8-12. Temporary assignment to hkjherrievei another position. Employees who are promoted temporarily to perform all of the duties of a supervisory position in a class with a higher maximum salary or supervisors who are assigned additional supervisory responsibilities for an extended period of at least six weeks due to the absence of another supervisor may tthatl have their existing salaries temporarily increased 4% to 105 at the discretion of the City Administrator. The City Administrator shall cause a report to be filed with the council following any increase pursuant to this section in excess of 10%. Section 7. Section 8-13(a). Overtime and Compensatory Time of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: (a) Supervisors shall develop methods and procedures to maximize productivity and reduce or avoid the need for overtime. It is the responsibility of each employee to work as efficiently as possible to accomplish job tasks during regularly scheduled work hours. All overtime or arrangements for overtime work shall be approved by the department director in advance. A determining factor in the approval of overtime work is whether the work could be accomplished through rescheduling of employee work hours and allowance of time off in the same work period. Tliose factors reduce the burden of overtime on employoes and avoid accrual of comp time and excessive overtime payments. Overtime is based on work hours in excess of 40 hours in a 168 hour period during seven consecutive 24-hour periods (standard work week). Under the provisions of the Fair Labor Standards Act (FLSA) work hours in excess of 80 hours in a 336 hour period during 14 consecutive 24-hour periods is adopted for commissioned police personnel and the work period for FLSA purposes in the fire department shall be work hours in excess of 204 in a 648 hour period during twenty- seven consecutive 24-hour periods. Hours worked in excess of a standard work week or duty tour by employees covered by the provisions of the Fair Labor Standards Act shall be compensated by payment at one and once-half(1'/z) times the straight hourly equivalent rate for the classification or by the award of compensatory time off equal to one and one-half times the overtime hours worked at the discretion of the department director. Hours worked shall include hours actually worked on the City's behalf plus minimum guarantees for call- back under Section 8.14 plus 8 hours for any holidays as provided in Section 11 (a) for certain employees and certain vacation leave as allowed in Section 12-1 (f). Exempt employees shall not accrue compensatory time nor be paid for overtime. Section 8. Section 8-15(a)(1). Stand-By/On-Call Status of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: (1) Pay. Any non-exompt employee who is required to carry a communications device after regular duty hours,on weekends, or holidays shall be reimbursed $7,09$8.00 per weekday or `x-00 $20.00 per day for weekends and holidays except for employees who are provided a communications device as a convenience in communications only and are not required to maintain a state of readiness for duly as is required of on-call status. Section 9. Section 12-1 . Vacation Leave of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: (F) Employees not covered by a work agreement may receive credit as time worked for scheduled vacation pay when called in or required to stay beyond their scheduled shift for unscheduled duties during the same work week the vacation is taken. For the purposes of this benefit only, scheduled vacation is defined as requested and approved In writing at least two weeks prior to the additional hours worked or scheduled vacation day, whichever is first. Only the amount of vacation leave which is equal to the amount of unscheduled additional hours worked beyond a regularly scheduled shift maybe credited for FLSA purposes as described in Section 8-13. As defined by the FLSA, any other use of vacation leave is not considered tittle work for time-and-on-half overtime pay purposes. Section 10. Section 13-2. Sick Leave of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: Sick leave will not be awarded to the extent that such leave, together with hours actually worked and holiday hours, would exceed a normal workweek. Section 11 . Section 15-1 . Health and Life Coverages of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: Full-time and regular part-time employees with benefits are eligible for basic group • Ihll 21Hi 1.1 I'd::� life and health coverage. The basic life insurance coverage is the employee's salary if an even thousand, or rounded to the next higher thousand. Employees may double.-their purchase additional life Insurance coverage by paying a. premium on the basis of age and salary. Current tax laws make any benefits above a certain amount taxable income to the employee. Optional life insurance at lower set coverages is available for dependents. Section 12. Section 16-3. Reduction in Force; Lay Off of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: A department director may separate any employee due to lack of funds or curtailment of work after giving proper notice. However, no regular full-time employee shall be separated from any department while 449ep there are introductory,part-time,or temporary employees serving in the same class of positions in that department. A department director may, with the approval of the City Administrator, appoint an employee who is to be laid off to any existing vacancy in a lower class for which he is qualified. All other factors being equal, employees shall be laid off in reverse order of their total service with the city. The city will provide two weeks notice or equivalent compensation to persons being laid off and holding positions which are non-exempt under FLSA. For persons laid off and holding FLSA exempt positions, excluding department directors and City Administrator,the City will provide four weeks notice or equivalent compensation. Section 13. Section 16-8. The City will contribute not more than $500 per employee towards the retirement of any employee who retires in good standing from the service of the City. This contribution may apply toward an award(plaque,gift, etc.)or toward the cost of a reception or similar event. When feasible, ceremonies will cover persons retiring within a similar time period. Sworn police officers or firefighters retiring in good standing with fifteen years of service or more may be awarded their helmet, badge, and/or gun in addition to the aforementioned$500 contribution. For employees with twenty or more years of serve, a Key to the City will be presented in addition to the above. Section 14. Article 19-3(b), Travel Expenses of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: Section 19-3. Reimbursable expenses. (b) Direct travel by personal vehicle at the established rate per mile or at an amount equal to common carrier fare, whichever is less, if approved by the department director. Employees choosing to drive when air travel Is less may be reimbursed for no more than the expenses which would have been Incurred if traveling by air. No reimbursement shall be made for tolls, lodging or meals for additional travel days required to drive to the destination. Sgction 15. Article 19-7. Travel Expenses of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: Section 19.7. Use of Personal vehicle for official business. Employees required to use their personal vehicle for official city business shall be compensated at the rate set out in Section 19•.9. All reimbursement shall be based on a direct route with departure and return from City Hall. When more than one(1)person travels In the same automobile,only the owner of the vehicle shall be allowed mileage. All departments are encouraged io promote the use of city vehicles whenever possible in lieu of use of personal vehicles for City travel purposes. Section 15. Article 19-9. Travel Expenses of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: And Section 19-9. Reimbursement rates and rules. The following expenses of employees shall be reimbursed according to actual costs when accompanied by receipts or other documentation as required and appropriate: (a) direct travel including air, bus. train and taxi fares; (b) overnight lodging; (c) other reasonable and related expenses; (d) meals and tips which are less than the allowed meal per diem. The following expenses of employees shall be reimbursed according to established allowances: (a) direct travel by personal vehicle at the established rate per mile or an amount equal to common carrier fare, whichever is less; (b) moats and tips,unless the amount spent on a meal falls below the allowed per diem and a receipt Is submitted. The following expenses of employees shall not be reimbursed: (a) costs incurred by a spouse or other relative accompanying an employee; (b)personal expenditures such as valet service,laundry and cleaning, entertainment or side trips; Employees wishing to combine private business with City business will be reimbursed for travel to the destination based upon the common carrier fare or the established rate per mile for personal vehicles,whichever is less. No expenses for lodging, meals or other expenses will be reimbursed for the additional travel days. Section 17. Article 19-10. Travel Expenses of the Personnel Policy Manual for the Ifill!p0l•I Pntie municipal service of Jefferson City, Missouri, is hereby amended as follows: 19.10. Use of personal credit card while traveling. Employees assigned a City Purchasing Card must use the purchasing card for any lodging or transportation charges Incurred while traveling on City business. The City purchasing card may not be used for personal expenditures, alcoholic beverages, meals covered by per diem, or gasoline or tolls when mileage Is being reimbursed. Sectii 18., Section 20-1 . Prohibitions and Penalties of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: Section 20-1. Participation in political activities. (f) Wearing a political button, cap, hat, shirt or other passive display during work hours or any other time If wearing a City uniform or any badge or other Insignia Indicating the person is a City employee,such as a nametag or T-shirt. No employee shall be required to participate In any election campaign, whether for or against a candidate, or for or against an issue. No employee shall be required to contribute money, time or other services to any election campaign or political organization. Lawful participation In political campaigns by an employee shall not result in any benefit nor any detriment to the person's employment. Section 19.
