AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY ANNEXATION OF 45 ACRES OF REAL PROPERTY CONTIGUOUS TO AND LYING WEST OF THE PRESENT CITY LIMITS INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED WEST OF SHAWN DRIVE AND NORTH OF SCHUMATE CHAPEL ROAD IN THE NORTHEAST QUARTER AND THE SOUTHEAST QUARTER OF SECTION 33, TOWNSHIP 45 NORTH, RANGE 12 WEST, IN COLE COUNTY, STATE OF MISSOURI, AND REPEALING SECTION 1-17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY AND ENACTING A NEW SECTION PERTAINING TO THE SAME SUBJECT. WHEREAS, pursuant to Section 71.012.2 RSMo, 1994, the City Council of the City of Jefferson was presented with a verified petition requesting that the city annex the unincorporated area of land described in Section 1: WHEREAS, the petition requesting said annexation was signed by all fee interests of record in all real property located within the area proposed to be annexed; and WHEREAS, a public hearing concerning the annexation was held on May 3, 2004 as advertised in the Jefferson City Post Tribune; and NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The area to be incorporated into the, City is described as follows, containing 45 acres, more or less: All of that part of the Northeast Quarter of the Southeast Quarter lying north of Schumate Chapel Road, all of the East Half of the Southeast Quarter of the Northeast Quarter lying north of Schumate Chapel Road, and all that part of the Northeast Quarter of the Northeast Quarter lying westerly of the center of Grays Greek, all situate in Section 33, -Township 45 North, Range 12 West, in the County of Colo. Missouri; being more particularly described as follows: BEGINNING at the northeast corner of the Northeast Quarter of the Southeast Quarter of said Section 33; thence S52"1 TW, along the northerly line of a tract as described in Book 304, Page 572, of the C010 County Recorder's Office, 444.4 feet, to the easterly line of Schumate Chapel Road; thence northwesterly along the easterly line of said Schumate Chapel Road, to the intersection of said easterly line with the west line of the,East Half of the East Half of the Northeast Quarter of said Section 33; thence north along the said west line, to the northwest corner of the Northeast Quarter of the Northeast Quarter of the Northeast Quarter of s�.,fld Section 33; thence east along the north line of said quarter quarter quarter section, said north line being the H111_1011.1 .1 Par'. The City Council finds and declares that the land described in Section 1 is contiguous to the City boundary; that the annexation is reasonable arid necessary to the proper development of the City; and further, did determine the City has the ability to furnish normal municipal services to the area. Section 3. The land described in Section 1 shall be zoned RU Rural Use District, in accordance with the City Code as no zoning plan was submitted concurrently with the petition for annexation, and until such timer as the zoning may be changed in the manner provided for by State Statute and City Code. Section 4. Section 1-17 of the Code of the City of Jefferson, Missouri is hereby repealed and a new Section 1-17 is hereby enacted, which shall read as follows; Sec. 1-17. City boundaries.
