WHEREAS it appears that the procedures set forth in the zoning code relating to zoning have in all matters been complied with; NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI AS FOLLOWS: Section 1 . The following described property is subject to the Preliminary and Final Planned Unit Development Plan described herein: Property addressed as 1711 East Elm Street; described as Lot 2 of Elm Executive Plaza, Section One, located in part of Outlot Nos. 74 and 75, in Township 44 North, Range 11 West in the City of Jefferson, Cole County, Missouri; containing 1 .24 acres. Section 2. Almost all items concerning Engineering Division review in accordance with Chapter 35 of the Zoning Code pertaining to site plan contents have been addressed on the latest submittal of the site plan. The following comments are regarding this i review; t Regarding infrastructure; i Existing street, storm sewer, and sanitary sewer infrastructure are in the vicinity of the proposed development. The proposed drive entrance to East Elm Street exceeds the maximum allowed throat width of forty (40) feet. The entrance will need to be adjusted to meet maximum allowed by the Standards of the City of Jefferson. Regarding traffic impact; East Elm Street is classified as a collector roadway from Clark Avenue to Eastland Drive(Classif cation is from the List of Functional Roadway Classification for Jefferson City, dated April 12, 2000). The speed limit for East Elm Street is 30 mph. ADT (average daily traffic) in('ormation available for Eastland Drive south of East Elm Street is 8456 vehicles per day. (Source is MoDOT Traffic Count Summary for Jefferson City, 2002). The proposed development is within an existing office/commercial area. Width of East Elm Street is approximately thirty-three (3 3) feet from curb to curb. Sight distance on East Elm Street is adequate in both the westerly and easterly direction. Parking is restricted on the south side of Fast Elm Street in this vicinity. Please refer to the Planning Division staffreport for estimated trip generation data for this development, ENGINEERING STAFF POSITION: Support, w/the following condition; 1. The proposed drive entrance to East Elm Street needs to be modified from it 45' drive entrance to a 40' drive entrance. A request filed by Elm Executive Plaza, L,L,C, Carey Bogg and Steve Albert,property owners, on behalf of ,ieffrey M. Chambers, (Central Missouri Professional Services, Consultant), for approval of a Preliminary and Iainal PUD Site Plan. The applicant proposes to construct a 1,718 square foot restaurant on a 1.24 acrc parcel, zoned PUD Planned Unit Development. The subject property is located on proposed Lot 2 of Elm Executive Plaza, Section One. Notification By letter,to adjacent and affected property owners within 185 feet,and by property sign posting,as required by the Zoning Ordinance. Correspondence Received None received Loeation/Surroundinu Toning_and Land Use The subject site is located in the 1700 block of East Elm Street, some 500 feet southeast of the intersection of East Elm Street with El Dorado Drive, and approximately 260 feet northwest of the intersection of East Elm Street with rhn Court. The property is zoned PUD,Planned Unit Development,and is bordered by RS-2 zoning to the east across Highway 50, RA-2 zoning to the southeast, with PUD zoning adjoining to the north, west, and south. Land to the north, west and south of the subject site are currently developed in various commercial office and office land uses. Lands to the cast across Highway 50 are developed with single-family residential land use. Current Proposal The applicant proposes to construct a 1,718 square drive-in restaurant with associated parking and orders area on the approximately 1.24 acre site. Park�t?g Parking requirements for drive in restaurants with no indoor seating is listed as 8 queuing spaces per window in the drive through plus one regular off street parking space per employee on the maximum shift. With one proposed order window and a maximum of 9 employees listed, the number of parking spaces required for the drive-in use would be 8 queuing spaces and 9 regular parking spaces. A loading space must also be provided. The current PUD Site Plan shows 25 order stall parking spaces (1 designated as a handicap accessible), 9 employee parking spaces, 13 queuing spaces for the drive through window use, and I loading space for a total of 47 off street parking and order spaces and I loading space. This parking configuration would Sleet the required off street parking requirements. Sign Area Sign details for the proposed pole signs and building mounted sign have been provided for this request. The proposed restaurant use complies with the land uses designated in the Comprehensive Plan. Develop,Lent Ingnict The traffic generation rate is estimated for fast food restaurant with drive-through window find no indoor seating'. Using these standards, in average of approximately 153.85 vehicle trip ends per weekday per 1,000 square feet of gross floor area is expected for the first Rood restaurant use. With 1,718 square feet of'gross floor area, the total combined traffic generation would be expected to be approximately 265 vehicle trips per weekday((1,718 square feet/ 1,000 square feet :z 1.72) ; 1.72 x 153.85 trip ends = 264.62 trip ends)). • Please refer to the ElIngineering Staff Report for further comment in regard to development impact. General Standards for Review Please refer to Section 35-74.0 of the Zoning Code for general standards for review of Planned District Site Plans (provided in handout). Adequate utilities are available to the site. Adequate ingress-egress is proposed. Allowable Uses/Design Standards (Section 35-70.A.6) Section 35-27.13 of the Zoning Code outlines permissible land uses in the PUD District which may be authorized within the PUD District at the discretion of the Council. Tile proposed use is typical Of some development in the area and conforms with the Comprehensive flan. Furthermore, the proposed use is allowable as it is a use specifically authorized within a district that implements the Development Plan Land Use Plan pursuant to the Ordinance. Staff Comments The current proposal is compatible with existing development in the area. Most ofthe Preliminary and Final PUD Site Plan information outlined in Section 35-74.0 of the Zoning Code appears to have been provided or addressed.
