Greetings:
In the name of the Commonwealth of Massachusetts you are hereby
directed to notify and warn the inhabitants of the Town of .Brewster
-� qualified to vote in Town affairs to meet in the 1"Eauset Regional Middle
School gymnasium on Monday, the thirteenth day of blay next at seven
o1clock in the evening, then and there to act on the following articles:
ARTICLE. 1. To act on the annual report of the Selectmen and other
Town Officers.
ARTICLE 2. To see if the Town will vote to authorize the To,-n
Treasurer, with the approval of the Selectmen, to borrow money from time
to time in anticipation of the revenue of the financial year beginning
July 1, 1974, in accordance with the provisions of General Lars,
Chapter 44, Section 4, and to issue a note or notes therefor, payable within
one year, and to renew any note or notes as may be given for a period of less
than one year in accordance with General Laws, Chapter 4.4, Section 17.
ARTICLE 3. To see if the Torr_ will appropriate a sum of money to the
Reserve Fund.
ARTICLE 4. To hear the report of any special Committee.
ARTICLE 5. To see if the Town will vote to fix the salary and conpen-
sation of all elective officers of the Town as provided by Section 108,
Chapter 41, General. Laws as amended, for the twelve month period beginning
July 1, 1974 to be effective July 1, 1974.
- ARTICLE 6. To see if the Town will vote to amend the Personnel Py-Law
Section XII, 1.3 by deleting Sections PS 2 through 6 and substituting the
following:

ARTICLE 8. To see if the Town will vote to amend the Personnel By-Law
Section XII, 1.3 by adding to PS classification the following positions with
salary and compensation:

ARTICLE 9. To see if the Town will vote to amend the Personnel By-Law
Section XII, 1.3 by deleting Sections PS 10, PS 11, and PS 12.
ARTICLE 10. To see if the Town will vote to amend the Personnel By-Law
XII, 1.3 by increasing the salary of the Wire Inspector Bl and Assistant
Wire Inspector B2 to $5.50 per inspection including transportation.
ARTICLE .11.. To see if the Town will vote to amend the Personnel By-Law
XII, 1.3 by deleting Section B5 Building Inspector, Regular part-time at
$6,000.00 (includes transportation) and substituting the following:

ARTICLE 13• To see if the Town will vote to amend the Personnel By-Law

ARTICLE _14. To see if the Town will vote to amend the Personnel By-Law,
Section XII, 1.2 by increasing the compensation for the Appointed Boards and
Commissions as follows:
Registrar of Voters $3.00 per hour
Election Tellers $3.00 per hour
Ydllsite Workers $3.00 per hour
.ARTICLE .15. To see if the Town will vote to amend the Personnel By-Law,
Section XII, 1.3 by adding to the PW Classification the positions of free
'Marden and Local Superintendent of Insect Pest Control with compensation as
follows:
PW6 $5.00 per hour (includes transportation)
Tree Warden, Regular part-time
PW7 $500.00 per year (includes transportation)
Local Superintendent of Insect Pest Control, Regular part-time
ARTICLE 16. To see if the Town will vote to amend the Personnel By-Law,
by adding to the Appendix the job description of the newly created positions
of Deputy Assessor, Fireman full-time, Tree Warden and Local Superintendent
of Insect Pest Control.
Deputy Assessor - He shall be responsible for the administrative and
technical work in tax assessment operations to be conducted under
general supervision of the Board of Assessors. He shall expend physical
effort in inspecting buildings and land, and place tentative values
on Real Estate and Personal Property subject to taxation, and submit
these recommendations to the Board of Assessors. He shall interview
people regarding their assessments and contractors regarding sub-
divisions. He shall maintain the Town mans and assessment records
relative to ownership of Real Estate property, review abatement appli-
cations and recommend action by the Board of Assessors. He should be
a high school graduate and have considerable experience in the valuation
of property for tax purposes in accordance with modern assessment
practices, or have the equivalent combination of education and experience.
Fireman, Full--time - Under direct supervision of the Fire Chief, he
shall perform general duty, fire-fighting work in combating and ex-
tinguishing fires, driving and operating equipment of heavy apparatus,
including ladder trucks, hose wagons, pumpers, rescue trucks and
similar fire fighting apparatus. He shall also have the responsibility
of washing, polishing, greasing, testing fire apparatus and equipment,
performing minor maintenance repairs and all other duties required of a
full-time fireman.
Tree Marden - Shall have the care and control of all public shade
trees in the Town, except those under the jurisdiction of the
State government. He shall enforce all the provisions of the Zoning
By--Law dealing with trees, and participate in all general measures
having to do with insect and disease control of the trees and shrubs
under his jurisdiction.
Local Superintendent of Insect Pest Control - Shall be qualified by
training and experience to direct the suppression of such public
nuisances as gypsy and brown: tail moths, tent caterpillars,
Japanese beetle, pine looper, Dutch elm: disease, woodticks, and
other such public nuisances as are enumerated in Chapter 132,
Section 11 of the General Laws.
ARTICLE 17. To see if the Town will vote to amend the Personnel
By-Law, by deleting Section 1, 1.1 and substituting the following:
Section 1, 1.1 Application - The provisions of this By-Law shall apply
to all Town departments and to all employees therein,
with the exception of the School Committee and Police
Department and employees under their control, and
emergency employment.
ARTICLE 18. To see if the Town will vote to amend the Personnel
By-Law, by deleting Section 11, 1.5 and substituting the following:
Section 11, 1.5 Emplovee - For the purpose of this By-Law an employee
is any person who works for wages, or salary in the
service of the Town, whether on a regular part-time,
regular full--tame, or temporary basis, or whether ap-
pointed or elected, other than members of the School
Committee or Police Department and positions under their
control and emergency employees.
ARTICLE 1.9. To see if the Town will vote to amend the Personnel
By--Law, by deleting Section IV, 2.2 and substituting the following:
Section TV, 2.2 Communication Personnel - For regular full-time com-
munication personnel the normal work week shall be
40 hours based upon five (5) eight-hour days, except
in the case of emergency or unforseen circumstances
when regular full-time members of this department shall
be subject to serve such additional periods of time as
may be required to meet said emergency and/or circum-
stances. Relief personnel shall serve upon the basis
of eight-hour shifts.
ARTICLE 20. To see if the Town will vote to raise and appropriate
such sumw of money as may be deemed necessary to defray Town charges
and expenses for the year July 1, 1974 -- June 30, 1975.
ARTICLE 21.. To see if the Town will vote to raise and appropriate
or transfer from unappropriated available ,funds in the Treasury, a sum of
money for Chapter 81, maintenance of highways.
ARTICLE 22, To see if the Town will vote to raise and appropriate
or transfer from available funds in the Treasury, the sum of Six Thousand
($6,000.00) Dollars which may be used for State Aid Construction in
conjunction with any available State and County funds and in addition,
to transfer from available funds in the Treasury, the sum of Twenty
Nine Thousand Four Hundred Thirty ?Nine ($29,439.00) Dollars to meet
the State's and County's share of the cost of this work, reimburse-
ment received therefrom to be returned to available funds.
ARTICLF 23. To see if the Town: will vote to transfer the sum of
Twenty Thousand One Hundred Thirty ($20,130.00) Dollars from the proceeds
received from the State under the provisions of Section 20, Chapter 1140,
Acts of 3973, for the construction of Route 39, Freeman's Way and any
other work permitted under the provisions of said act on such roads within
the Town as may be approved by the Board of Selectmen and the
Yzssachusetts Department of Public Works, and act fully thereon.
ARTICLE 24. To see if the Town will vote to transfer from unaUoroo-
riated available funds, the sum of Thirty Three Thousand rive Hundred
Fifty ($33,550.00) Dollars from the proceeds received from the State under
the provisions of Section 22, Chapter 1140, Acts of 1973, for the purpose
of reconstruction, maintenance, and repair of public highways and bridges,
the amount to be used for Route 39, Freeman's Way or any other street
approved by the Board of Selectmen.
ARTICLE 25. To see if the Town will vote to appropriate from the
Road Machinery General Fund, the sum of :oar Thousand Fight Hundred
($4,800.00) Dollars to be used for the purchase, maintenance and operation
of Road machinery.
ARTICLE 26. To see if the 'Town will vote to raise and appropriate
or transfer from available funds in the Treasury, a sum of money to
purchase a body type sander for the Department of Public Works.
ARTICLE 27. To see if the Town will vote to raise and appropriate
or transfer from available funds in the Treasury, a sum of money to
purchase a new pickup type truck for the Department of Public Works.
ARTICLE 28. To see if the Torn will assume liability in the manner
provided by Section 29 of Chapter 91 of the General Laws, as amended by
Chapter 516 and 524, Acts of 1950 for all damages that may be incurred by
work to be performed by the Department of Public Works of Massachusetts
for the improvement, development, maintenance and protection of tidal and
non-tidal rivers and streams, harbors, tide-waters, foreshores and shores
along a public beach outside Boston Harbor, including the Merrimack and
Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the
General Laws, and authorize the Selectmen to execute and deliver a bond
of indemnity therefor to the Commonwealth.
ARTICLE 29. To see if the Town will vote to raise and apprcpriate
as payment due, a sum of money for the year 1973, under the provisions
of Chapter 32, Section 59A of the General Laws, and authorize the Town
Treasurer to pay said appropriation to the Town of Arlington, Mass., said
chapter referring to the non-contributory pension payments made to
veterans.
ARTICLE .30. To see if the Town will vote to raise and appropriate
as payment due, a sum, of money for the year 1973, under the provisions
of Chapter 32, Section 59A of the General Laws and authorize the Town
Treasurer to pay said appropriation to the Commonwealth of Massachusetts,
said chapter referring to the non-contributory pension payments spade to
veterans.
ARTICLE _31. To see if the Town will vote to raise and appropriate
the sum of Twelve Hundred ($1.,200.00) Dollars for the period from
July 1, 1974 to June 30, 1975, under the provisions of Chapter 944,
Sections 1 and 2, Acts of 1971, an act providing that cities and towns
grant an annual pension to certain retired teachers and that the
Commonwealth reimburse said cities and towns for the amount of all such
Aensions.
ARTICLE 32. To see if the Town will authorize the Selectmen to es-
tablish travel reimbursement regulations for Town employees.
ARTICLE 33- To see if the Town will raise and appropriate the sum.
of Fourteen Thousand, Three Hundred and Ninety-one ($114,391.00) Dollars
to purchase and equip three new cruisers for the Police Department, and
to authorize the Board of Selectmen to trade in the two present 1973
Chevrolet cruisers as part of the purchase price.
ARTICLE 34. To see if the Town will raise and appropriate the sum
of Three Thousand, Four Hundred ($3,400.00) Dollars to purchase and in-
stall a gasoline storage tank and pump for supplying Tows-owned vehicles.
ARTICLE 35. To see if the Town will transfer the sum of Forty-six
Thousand, Five Hundred ($46,500.00) Dollars from available Federal
Revenue Sharing Funds, and raise and appropriate the sum of
Fifty-six Thousand, Seven Hundred and Twenty-nine ($56,729.00) Dollars
to provide interior furnishings, bituminous pavement, emergency genera-
ting system and other necessary items to complete the new fire and
rolice station.
ARTICLE 3.6. To see if the Town will vote to instruct the Select-
men to contract for one year for Ambulance Service with the Brewster,
Orleans, Eastham Ambulance Association, Inc. , and raise and appropriate
the sum of Six Thousand, Five Hundred ($6,500.00) Dollars for this
purpose.
ARTICLE 37, To see if the Town will vote to raise and appropriate
the sum of Four Thousand ($4,000.00) Dollars for the purchase of Pager
Type Tone Activated Radio Receivers, to be used by Fire Department and
Rescue Souad personnel.
ARTICLE 38. To see if the Tewin will vote tc amend the year--round
dog restraining order adopted at the annual town meeting on :arch 5, 1973,
by deleting "a fine of Five ($5.00) Dollars is paid to the Town of
Brewster" and substitute "a fine of Ten ($10.00) Dollars for an initial
offense, a fine of Fifteen ($15.00) Dollars for a second offense, and a
fine of Twenty-five ($25.00) Dollars for the third and subsequent of-
fenses, as provided in Chapter 140, Section 173A of the General Laws,
as amended in Chanter 627 of the Acts of 1973" so that it will read:
"To implement the year-round dog restraining order, all dogs
found at large shall be picked up by the Dog Officer and brought to the
dog pound. bone shall be released to the owners unless a fine of Ten
($10.00) Dollars is paid for an initial offense, a fine of Fifteen
($15.00) Dollars is paid for the second offense, and a fine of Twenty-
five ($25.00) Dollars is raid for the third and subsequent offenses, as
provided in. Chapter 14.0, Section 173A of the General Laws, as amended by
Chapter 62? of the Acts of 1973, and unlicensed dogs shall be licensed
before being released from the dog pound.
ARTICLE 39. To see if the Town will vote to enter into a contract
for one year with the Brewster Branch of the Arima.l Rescue League of
Boston to act as Dog Officer in enforcing all dog regulations, and to
raise and appropriate the sum of Forty-five Hundred ($4,500.00) Dollars
for this purpose.
APTTCLE CSO. To see if the Town will raise and appropriate a sum
sufficient to hire a full-time Dog Officer.
ARTICLE 41.. To see if the Town will vote to authorize and instruct
the Town Treasurer to pay the nog Tax returns from the assessments of
19?3 to the Brewster Ladies' Library Association in accordance with
Chapter 140, Section 72.
ARTICLE 42.: To see if the Town will vote to transfer from available
funds in the Treasury, funds received from the Commonwealth, the sum of
One Thousand ($1,000.00) Dollars to the Brewster Ladies' Library
Association.
ARTICLE 43- To see if the Town will vote to raise and au_-prouriate
the sun of Two Hundred Six and 80/100 ($206.80) Dollars under the pro-
visions of Chapter 388, Acts of 1954, amended by Chapter 433 of 1955,
Control of Greenhead Fly, and authorize the Town Treasurer to pay said
appropriation into the State Treasury.
ARTICLE 44. To see if the Tow-n will vote to raise and appropriate
the sum of One Thousand ($1,000.00) Dollars for advertising the advan-
tages and services of the Town in the form of the Brewster Guide and Map
published annually by the Brewster Board of Trade, such an appropriation
to be augmenting funding to those majority funds furnished privately by
the Brewster Board of Trade, said Town appropriation to be in accordance
with Chapter 4.75, Acts of 1969.
ARTICLE 45. To see if the Toum will vote to direct the Selectmen
to lay out Beach Flue Lane, and raise and appropriate a sum, of money
sufficient for engineering and lay-out costs. (By request)
ARTICLE 46. To see if the Town will vote to further amend the
Traffic Rules and Crders adopted by the Board of Selectmen on
August 1?, 1954, and subsequently amended, by adding a new Article VII
entitled:
One Way Streets, Section 1 -- Upon the following streets, or parts
of streets, vehicular traffic shall move only in the direction herein-
after indicated, providing that Official Traffic Signs are erected at
each exit, at each one-way street.
Brea'_�cwater Road - The westerly leg of Breakwater Road from Route 6A
northerly to Breakwater Road.
ARTICLE ,47. To see if the Town will vote to raise and appropriate
a sum of money for stone masonry work to be constructed at the Herring
Run and the Brewster Mill site. (By request)
ARTICLE 48. To see if the Town will vote to adopt an official
Town N:ap according to Section 817 of Chapter 41 of the Massachusetts
General Laws, and to raise and appropriate a sufficient sum for the
production of said Town YA—o.
ARTICLE tag. To see if the Town will raise and appropriate a suf-
ficient sum to provide furniture and equipment for the Planning Board
- Office.
ARTICLE
50. Betterment Assessment - To see if the Town will vat.,
to approve the use of the provisions of Chapter 80 of the General saws
of Massachusetts for assessing betterments to the abutters on any
private way which may be reconstructed by the Town to meet the require-
ments of the Rules and Regulations of the Brewster Planning Board, as
amended and approved, November 1573, said assessments to be made only
after the Town has voted to accept such ways, having followed the pro-
cedure for such acceptance as delineated in Chapter 82 of the General
Laws. Before the Town shall vote to accept any private way under the
Betterment Assessment Program, there shall have been filed with the
Selectmen a petition for such acceptance containing the signatures of
a majority of the owners of lots abutting said way; the Selectmen shall
refer the proposed layout to the Planning Board after first having pre-
pared an estimate of all costs to be levied against said abutters in-
eluding engineering, legal, construction, administration and interest;
the Planning Board shall hold a hearing on the petition after due
notice to the said abutters and shall inform said abutters of the
total estimated costs to be borne by them for said betterment; upon
receipt of the approval of the estimated cost, by a majority of the
abutters and approval of his share of the total by each member of the
said majority, and upon receipt of a written request by said majority
for an article to be inserted in the warrant, the Planning Board shall
forward its recommendation, as required under Section 81 I of Chapter a
of the General Laws, to the Selectmen, who, thereafter, shall cause said
article to be inserted in the warrant for the next Annual Town Meeting;
upon approval of said article by the voters at said Town keeti.ng, the
Selectmen shall advertise the construction for public bids, and within
six months after the construction has been completed, the total cost
shall be apportioned by the Selectmen to the owners of lots abutting the
way, and the time for payment, not exceeding twenty years shall be
specified; the total cost of the betterment assessment shall not exceed
the estimate; the Tax Collector shall bill the abutters according to
the apportionment on the next real estate tax bill and may accept
settlements in cash for the full amount of the apportioned share from
any abutter within 30 days, or shall bill each abuttor within 60 days
for his share of the total cost to be divided over a period of gears,
not exceeding twenty, with interest to be computed at the rate as set
forth in Chapter 80 of the Massachusetts General Laws; thereafter, the
annual amount of the Betterment Assessment shall appear on the annual
real estate tax bill of the abutters; the Selectmen shall act on all
private ways proposed to be accepted by the Town under the Betterment
Assessment Program strictly in accordance with the provisions of Chapter
41, 80, and 82 of the General Laws of the Commonwealth of Massachusetts.
ARTICLE 51. Funding Betterment Assessment - To see if the Town
will vote to raise and appropriate a sufficient sum of money to carry
out the provisions of Article 55, said money to be expended under the
supervision and direction of the Board of Selectmen.

kRTICLF 52. To see if the Town will vote to amend the Zoning By--
Laws, amended May 1973 and November 1973, of the Town of Brewster by
adding paragraph #4 to Section X-A.
"No multiple family dwelling or dwellings within the Town of
Brewster shall be hereafter erected, constructed or structurally al-
tered in any manner whatsoever, except whereby no change of a permitted
use is affected, for a period of twelve (12) months from the effective
date of this Zoning By-Law Amendment. Inasmuch as the Town of Brewster
is in the process of updating its Master Flan for its future development
and it is desired to protect said Town pending its final adoption, a
moratorium on the issuance of building permits for construction of
dwelling units in excess of two (2) families is hereby in effect for
said period of time.''
ARTICLE _53• To see if the Town will vote to raise and appropriate
a suff'ic'ient sum of money to finance an environmental and urban impact
study, showing the effect of building rates on the Town's resources, in-
cluding, but not limited to water, sewage, and pollution problems, as
related to the environmental and fiscal condition of the Town; and for
the updating of the Town Master Plan and Zoning By-Law.
ARTICLE 54. ZONING BY-LAW, Section W, paragraph 1, second sen-
tence. Eliminate the words "advice and recommendation" and substitute
"approval", so it will read: "A plan .for the development of the entire
tract shall be submitted to the Planning Board for approval.',
ARTICLE 55. ZONING BY-LAW, Section AK, paragraph 1, first sen-
tence. Ada the phrase "a minimum of which most be 75V buildable up-
lands as defined in the Zoning By-Law."
ARTICLE 56. ZONING BY-LAW, Section II, Definitions. Add between
"Board" and "Buildings" the following definition: "Buildable Uplands -
Land in the Town of Brewster which is not swamp, pond, bog, dry bog,
marsh., areas of exposed ground water, and which is not subject to
flooding from storms and mean high tides."
ARTICLE 57. ZONING BY-LAW, Section X-C, paragraph 7. Change
:dive" to "four", so the sentence mill. read, "The average density of
residences shall not exceed four per acre of land within the area which
is devoted to residential use, as defined in 6-b above. '
ARTICLE 58. ZONING BY-LAW, Section_ X-C, paragraph 5-1. Add
"providing the planned unit development contains 100 acres or more.''
ARTICLE 59. ZONING BY-LAW, Section X-C, paragraph 5-m. Change to
read "Restaurant with seating capacity of not more than 125 persons,
providing the planned unit development contains 100 acres or more."
ARTICLE '60. ZONING BY-IAW, Section V, Table 1 "Use Regulations -
Residential 04 - NUlti-family Dwelling", change "P" under CH to "S".
ARTICLE '61. ZONING BY-LAW, Section_ XI, J-1 Shall be changed to
read: "Applications: written application shall be made to the Board
for such permit containing a statement of the proposed use or uses, a
site plan showing the proposed site development and in the case of a
multi-family development, plans in accordance with Section X.A, and
such other related information concerning the proposed use of the
premises as the Board shall require. A fee of Fifty ($50.00) Dollars
for the first ten units and Ten ($10.00) Dollars per unit thereafter
will be payable with the application for all multi-famfly dwelling
developments. A fee of Thirty ($30.00) Dollars for all other Hearings
will be charged to cover the costs of advertisement and hearing.,'
ARTICLE 62. ZONING BY- AW, Section XI, J-3, Shal be changed to
read: "Conditions: Special Use Permits shall be granted only upon the
concurring vote of four or more members, and only after the following
considerations where applicable; written reports from the Building
Inspector and the Zoning Agent with regard to the specific site as an
appropriate location for the use or structure; written reports from the
Brewster Board of Health and where applicable, the Massachusetts Dept. of
Public Health with regard to the adequacy of public sewerage and water
facilities, or the suitability of soils for or.--lot sewerage and water
systems: written reports from the Planning Board with regard to any roads
or subdivision of land within any multi-family development; written re-
ports from the Police and Fire Departments with regard to the safety and
convenience of travel ori ways within and adjacent to any multi-family
development and with regard to any possible adverse effect on the
neighborhood; written reports from the Town Engineer with regard to the
proper construction of ways and drainage within any multi-family develop-
ment; written reports from the Architectural Advisory Coffmi..ttee with re-
gard to their findings relative to any multi--family development; and
after consideration that there are adequate and at facilities
to insure the proper operation of the proposed use,structure, condition
or development. The Board shall authorize such special permit only when
it finds that, in view of these considerations, and subject to the
Special Regulations stated in Section X, such exception is consistent
with the intent of this By Law and generally in conformity with the
Brewster Master Plan, as last revised."

Department to extend water mains not less than six inches (611) nor more
than sixteen (1611) inches in diameter in Governor Bradford Road, to
provide town water to approximately forty-three (43) residents now de-
siring the service, and to transfer a sum of money from the Water Fxpense
Account for the purpose.
ARTICLE 77. To see if the Town will authorize the Dater Commissioners
to use available Water Construction Expenses Account funds for extension_
of water mains in those areas where, in the judgement of the Commissioners,
the extension of the mains will serve the best interest of the Town in
improving reliability and quality of service.
ARTICLE 78. To see if the Town will vote to raise a-rid appropriate
the sum of Five Thousand ($5,000,00)Dollars for the extension of mains to
serve properties now within five hundred (504) feet or less from the
nearest existing fare hydrant.
ARTICLE 79. To see if the Town will vote to transfer all available
money from the Water Department Construction .ReVenue Account. to .the
Water Construction Expense Account.
ARTICLE -80. To see if the Town will vote to authorize the Board
of Water Commissioners to enter into an agreement with the Town of
Orleans, Irsater Department, regarding customers receiving Orleans Town
Water, but ;mho live an the Town of Brewster, in order to reduce the cost
of water service to these residents of Brewster.
ARTICLE 81, To see if the Town will vote to authorize the Board of
Water Commissioners to extend the dead end 6" (six inch) water main in
Fox IVeadow Drive about 750 feet, to connect to the existing 6=' water main
at the ;;unction of Fox Meadow Drive and blueberry Lane in order to complete
a loop, and to raise and appropriate the slam of $3400.00 (Thirty-four
hundred dollars) fcr the purpose.
ARTICLE 82. To see if the Town. -dill vote to raise and appropriate a
sum of money for purchase of an air cozrpressor and accessories for use of
the eater Department.
ARTICLE 83. To see if the Town will vote to raise and appropriate a
sum of money for the purchase of a small tractor and accessories for snow
plowing, grass mowing, etc. on Town. Property which is under the super-
vision of the eater Department.
ARTICLE 84. To see if the Town will vote to raise and appropriate
a sum of money for the purchase of a calculator for use of the Water
Department.

garding a By-Law for the removal of top soil and loan from the Town. of

1. No top soil, gravel, loam or stone in the Town may be re-
moved to be transported outside the Town of Brewster, ex-
cept from established pit, stockpile or surplus, unless
authorized by a special permit from the Board of Appeals.
2. No top soil, sub soil, gravel, loam, sand, stone or other
earth in the Town may be removed to be transported either
outside the Town or from place to place within the Town
of Brewster, nor may any land be filled, unless the entire
area of such removal or filling be graded and replanted
with soil-improving plants, with a permanent cover crop or
by reforestation so that any scars resulting from such re-
moval shah not remain unplanted for a period of longer
than six months, with the exception of the Town Disposal
Area.
3. The penalty for violation of the provisions of this By-
Law shall be as follows:
For the first offense, Fifty Dollars; for the second of-
fense, One Hundred Dollars; and for each subsequent of-
fense, Two Hundred dollars.

members shall be appointed for three (3) years, two (2)
members for two (2) years, and two (2) members for one
(1) year. Members may be appointed for concurrent terms.
Members shall serve without pay.
Section. 2. Whenever a vacancy shall occur in the membership of the
Council, by reason of death, resignation, inability to
act, or for any other reason, the vacancy shall be
filled by appointment by the Selectmen for the period of
the unexpired terry.
Section 3. The Council on Aging shall, as soon as possible after the
members are appointed, and annually thereafter, at its
first meeting after the Annual Town Meeting, elect from
its membershi-o a Chairman, a Vice-Chairman., a Secretary,
and. a Treasurer. Each officer shall hold office until
the next Annual Town Meeting. In the event that a vacancy
occurs in any of these offices, the Council shall elect

In accordance with the Warrant, the meeting was held in the Nauset
Regional Middle School Gymnasium, Monday evening, :May 13, 1974
The meeting was called to order at 9:00 p.m. by the Moderator, Stephen
Doyle, a quorum being present. The Tellers were Paul Sylver, Gladys Curtis,
Dorothy Grenier, Doris Powell and J. Ogden Tyl.dsley, Jr. The Pages were

ing at 9 P.I . The Annual Town Meeting was re-opened at 9:5C P.M.
ARTICLE 16. To see if the Town will'-vote to amend the Personnel By-Law,
by idding to the Appendix the job description of the newly created positions
of Deputy Assessor, Fireman full-time, Tree Marden and Local Superintendent
of insect pest Control.
DEPUTY ASSESSOR - He skull be responsible for the a.dmisistrative airia tech-
nical work in tax assessment operations to be conducted under general super-
vision of the Board of Assessors. He shall expend physical effort in inspect-
ing buildings and land, and place tentative values on Real Estate and Personal
Property subject to taxation, and submit these recommendations to the Board
of Assessors. He shall interview people regarding their assessments and
contractors regarding sub-divisions. He shall maintain the Town maps and
assessment records relative to ownership of Real Estate property, review
Abatement applications and recommend action by the Board of Assessors. He
should be a high school graduate and have considerable experience in the
valuation of property for tax purposes in accordance with modern assessment
practices, or have the equivalent combination of education and experience.

FIREW, FULL—TIME — Under direct supervision of the Fire Chief, he shall
perform general duty, fire-fighting work in combating and extinguishing fires,
driving and operating equipment of heavy apparatus, including ladder trucks,
hose wagons, pumpers, rescue trucks and similar fire fighting apparatus. He
shall also have the responsibility of washing, polishing, greasing, testing rLre
apparatus and equipment, performing minor maintenance repairs and all other duties
required of a full-time fireman.
TREE WARDEN - Shall have the care and control of all public shade trees in the
Town, except those under the jurisdiction of the State government. He shall
enforce all the provisions of the Zoning By-Law debling with trees, and
participate in all general measures having to do with insect and disease control
of the trees and shrubs under his Jurisdiction.
LOCAL SUPERINTENDENT OF INSECT PEST CONTROL - Shall be qualified by training
and experience to direct the suppression of such public nuisances as gypsy and
brown tail moths, tent caterpillars, Japanese beetle, pine looper, Dutch elm
disease, woodticks, and other such public nuisances as are enumerated in
Chapter 132, Section 11 of the General haws.

ARTICLE 17. To see if the Town will vote to .amend the Personnel By-Law, by
deleting Section 1, 1.1 and substituting the following:

ARTICLE 28. To see if the 'Town will assume liability in the manner pro—
vided by Section 29 of Chapter 91 of the General Laws, as amended by Chapter
516 and524, Acts of 1950 for all damages that may be incurred by work to be
performed by the Department of Public Works of Massachusetts for the improve—
ment, development, maintenance and protection of tidal and non—tidal rivers
and streams, harbors, tidewaters, foreshores and shores along a public beach
outside Boston Harbor, including the Merrimack and Connecticut Rivers, in
accordance with Section 11 of Chapter 91 of the General Laws, and authorize
the Selectmen to execute and deliver a bond of indemnity therefor to the
Commonwealth.
VOTED that the Town assume liability in the manner provided by Section 29
of Chapter 91 of the General Laws, as amended by Chapter 516 and 524, Acts of
1950 for all damages that may be incurred by work to be performed by the
Department of Public Works of Massachusetts for the improvement, development,
maintenance and protection of tidal and non—tidal rivers and streams, harbors,
tide—waters, foreshores and shores along a public beach outside Boston Harbor,
including the Merrimack and Connecticut Rivers, in accordance with Section 11
of Chapter 91 of the General Laws, and authorize the Selectmen_ to execute and
deliver a bond of indemnity therefor to the Commonwealth.

veterans.

said chapters referring to the non-contributory pension payments made to
veterans.
ARTICLE 31. To see if the Town will vote to raise and appropriate the sum
of Twelve Hundred ($1200.00) Dollars for the period from July 1, 1974 to
June 30, 1.975, under the provisions of Chapter 944, Sections 1 and 2, Acts
of 1971, an act providing that cities and towns grant an annual pension to
certain retired teachers and that the Commonwealth reimburse said cities and
towns for the amount of all such pensions.
VOTED that the Town raise and appropriate the sum of Twelve Hundred
($1200.00) Dollars for the period from July 1, 1974 to June 30, 1R73, under
the provisions of Chapter 944, Sections 1 and 2, Acts of 1971, an act pro-
viding that cities and towns grant an annual pension to certain retired
teachers and that the Commonwealth reimburse said cities and towns for the
amount of all such Densions.
ARTICLE 32. To see if the Town will authorize the Selectmen to establish
travel, reimbursement regulations for Town employees.

twelve cents per mile as travel reimbursement for Town employees.
ARTICLE 33. To see if the Town will raise and appropriate the sum of
Fourteen Thousand, Three hundred and ninety-one($14,391.00) Dollars to
purchase and equip three new cruisers for the Police Department, and to
authorize the Board of Selectmen to trade in the two present 1.973 Chevrolet
cruisers as part of the purchase price.
VOTED that the Town raise and appropriate the sum of Twelve Thousand,
Nine Hundred and Seventy-five ($12,975.00) Dollars to purchase and equip
three new cruisers for the Police Department, and to authorize the Board
of Selectmen to trade in the two present Chevrolet cruisers as part of the
purchase 'price.
It was voted yes 125, no 78 to adjorn the meeting at 10;40 p.m. until
7:00p.m. at the Nauset Middle School Gymnasium, on MaY 14, 1974.

Twenty—five ($25.00) Dollars for the third and subsequent offenses, as

ARTICLE 50. Betterment Assessment — To see if the Town will vote to
approve the use of the provisions of Chapter 80 of the General Laws of
Kassacha.setts for assessing betterments to the abutters on any private way
which may be re-constructed by the Town to meet the requirements of the
Rules and Regulations of the Brewster Planning Board, as amended and approved,
November 1973, said assessments to be made only after the Town, has voted to
accept such-ways, having followed the procedure for such acceptance as de-
lineated in Chapter 82 of the General Laws. Before the Town shall vote to
accept any private way under the Betterment Assessment Program there shall
have been filed with the Selectmen a petition for such acceptance con-
tz'ning the signatures of a majority of the owners of lots abutting said
way; the Selectmen shall refer the proposed layout to the Planning Board
after first having prepared an estimate of all costs to be levied agaist
said abutters including engineering, legal, construction, administration
and interest; the Planning Board shall hold a hearing on the petition after
due notice to the said abutters and shall inform said abutters of the total
estimated costs to be borne by them for said betterment; upon receipt of the
approval of the estimated cost by a majority of the abutters and approval of
his share of the total by each member of the said majority, and upon receipt
of a written request by said majority for an article to be inserted in the
warrant, the Planning, Board shall forward its recommendation, as required
under Section 81 1 of Chapter 41 of the General Laws, to the Selectmen, who
thereafter, shall cause said article to be inserted in the warrant for the
next Annual Town Sleeting; upon approval of said article by the voters at
said Town IYeeting, the Selectmen shall advertise the construction for public
bids, and within sig: months after the construction has been completed, the
total cost shall be apportioned by the Selectmen to the owners of lots
abutting the way, and the time for payment, not exceeding twenty years
shall be specified; the total cost of the betterment assessment shall not
exceed the estimate; the Tax Collector shall .bi.-1 the abutters according
to the apportionment on the next real estate tax bill and may accept
settlements in cash for the full amount of the apportioned share from any
abutter within 30 days, or shall bill each �:abuttor within 30 days for his
share of the total cost to be divided over a period of years, not exceeding
twenty, with interest to be computed at the rate as set forth in Chapter 80
of the Vassachusetts General Laws; thereafter, the annual amount of the
Betterment Assessment shall appear or the annual real estate tax bill of
the abutters; the Selectmen shall act on all private ways proposed to be
accepted by the Town under the Betterment Assessment Program str-icily in
accordance with the provisions of Chapter 41, 80 and 82 of the General Laws
of the Commonwealth of Massachusetts.

llarch 7, 1950, and vote to adopt the following By--Law regarding the re—
moval of top soil and loam:
SOIL REMOVAL
1. No top soil, gravel, loam or stone in the Town may be removed to be
transported outside the Town of Brewster, except from established pit,
stockpile or surplus, unless authorized by a special permit from the
Board of Appeals.
2. No top soil, sub soil, gravel, loam, sand, stone or other earth in the
Town may be removed to be transported either outside the Town or from
place to place within the Town of Brewster, nor may any land be filled,
unless the entire area of such removal or filling be graded ald', re—
planted with soil—improving plants, with a permanent cover crop or by
reforestation, so that any scans resulting from such removal shall not
remain unplanted for a period of longer than six months, with the excep—
tion of the Town Disposal Area.
3. The penalty for violation of the provisions of this By—Law shall be as
follows: For the first offense, Fifty Dollars; for the second offense,
One Hundred Dollars; and for each subsequent offense, Two Hundred Dollars.
An amendment to delete Section 2 of the Article was withdrawn.

The School Building; Committee was formed and held its first
meeting, January 23, 1974.
Three members from the School Committee:

Four members appointed by the Selectmen:
Mr. Kent Sanders, Mr. Paul Sullivan, Mr. VonHentschel,
Mr. Winston DuBois.
After interviewing a number of architects and visiting various
schools in the State, the architectual firm of Hill, Miller, Fried-
l.aender and Hollander Tnc_ was selected on March 5, 1974, to inveti-
gate the site for preliminary drawing, design, location on parcels
#16 - ##80 set aside by the Town for educational purpose.
On further investigation, it was found that the most feasible
access to the proposed site would be from the south from Underpass
Road across Parcel ##102 with an easement across the Penn Central
right-of-way and Parcel #103 on the Town of Brewster' s Assessors?
Map #26.
The properties concerned are owned by the Penn Central who
are in bankruptcy.

Greetings:
In the name of the Commonwealth of Massachusetts you are hereby
directed to notify and warn the inhabitants of the Town of Brewster
qualified to vote in Town affairs to meet in the Nauset Regional Middle
School Gymnasium on Monday, the twenty-fourth day of June next at
seven-thirty o'clock in the evening, then and there to act on the
following articles:
ARTICLE 1. To see if the Town will vote to raise and appropriate
or borrow a sufficient sum of money for the purpose of employing the
services of an architect or architects to design and prepare plans and
specifications and pay other expenses for an elementary school; said
plans and specifications to be prepared and said fund to be expended
by and under the direction of the School Building Committee, and to act
fully thereon.
ARTICLE 2. To see if the Town will raise and appropriate a sura of
money to pay for interest on notes or bond issued to the Town of Brewster
for the cost of architectural services for plans and specifications for
the construction of an elementary school.
ARTICLE 3. To see if the Town will vote that the warrant for the
arcual Town .Meeting be closed seventy-five (75) days before each annual
Town Meeting and be in the hands of the Finance Committee by forty-five
(45) days before each annual Town Meeting, commencing in 1975.
ARTICLE 4. To see if the Town will vote that the Finance Committee
By-Law enacted April 26, 1929 be amended by: deleting the word "nine"
and substituting the word "fifteen"; deleting the word "three" in four
(4) places and substituting the word "two" in three (3) places and "five"
"n'.one (l) place and inserting -the'wo-rds "Town Meeting to transmit a", so
the amended Finance Committee By-Law-shall read as follows:
-'There shall be a Finance Committee consisting of fifteen. (15)
members who shall hold no other town office. The Moderator of the Town
Meeting when this By-Law is adopted shall within thirty days after such
By-Law becomes effective, apYoint from the citizens of the town two
persons whose term of office shall expire at the adjournment of the
first annual Tower. Meeting following the time when this By-Law becomes
effective; two whose term of office shall expire at the adjournment of
the second annual meeting following the time when this By-Law becomes
effective and two whose term of office shall expire at the adjournment
of the third Annual Town Meeting follo-wing the time when this By-Law be-
comes effective. The Moderator of each Annual Town Meeting thereafter
shall appoint five (5) members for a term of three years.
It shall be the duty of this Committee to consider all matters of
business included within the articles of any warrant for a Town Meeting
and it shall be the duty of the Selectmen immediately -upon drawing up a
Warrant for Town Meeting to transmit a copy thereof to the Finance
Committee. The Committee shall report on each article to the Town
Meeting, in print or otherwise as it deems for the best interest of
the Town.
The Finance Committee shall have authority at any time to investi-
gate the books, accounts and management of any department of the Town,
and the books and accounts of the Town shall be open to the inspection
of the Committee or any person authorized to act for the Committee.
The members of the Finance Committee shall serve without pay for
their service but may be reimbursed for actual expenses incurred in dis-
charge of their duties thereunder.
Any vacancy which may occur in said Committee shall be filled by
the remaining members of the Committee.
All existing appointments shall rerain in effect until their
normal expiration date.
ARTICLE 5. Zoning By-Law, Section. X-C, paragraph 7. Change
"five" to "three" or "four" to "three" if the Attorney General has ap-
proved the By-Law change approved by the Town at the Annual Town Meeting
of May 1974, reducing the density from five to four, so that the sentence
will read, "The average density of residences shall not exceed three per
acre of land within the area which is devoted to residential use, as de-
fined in 6-b above."
ARTICLE' 6. To see if the Town will vote to transfer from available funds in
the_Treasury - , the sum of Fourteen Hundred ($1,400) Dollars, to be added
�o the Town Hall Expense Account, 1973.
ARTICLE 7. To see if the Town will vote to transfer from available funds in
the -Treasury , the sum of Twelve Hundred and forty ($1,240.00) Dollars,
to be added to the Law Department Expense Account, 1973.

ARTICLE 15. To see if the Town will vote to authorize the transfer
of the offices, garage, grounds and appurtenances on the parcel presently
housing the Brewster Police, Fire Department, and Dispatch Office, as shown
on Assessor's Map 24, Lot 18, to the authority and control of the Brewster
Department of Public Works, with the approval of the Board of Selectmen.
This transfer will take effect when the new Police and Fire Station has
been completed and is operational.

Road at Route 6A and instruct the Selectmen to proceed with the appraisal,

June 24, 1974
In accordance with the Warrant, the meeting was held in the Nauset
Regional Middle School Gymnasium, Monday evening, June 24, 1974.
The meeting was called to order by the Moderator, Stephen Doyle, at
7:30 p.m. , a auor.zsn being present. The Registrars were ,lean mage and
Jon :Howard. The Tellers were Paul Sylver, Gladys Curtis, Dorothy Grenier,
Doris Powell and Pichard Kingston. The Pages were Sylvia Eldredge and
"Melissa Hansen.
_ The Warrant was read by the Town Clerk, Ruth Eddy, with the exception
of the articles, which were read as they were being considered.
The invocation was offered by Willard Tibbetts. The pledge of Allegiance
to the Flag was lead by Melody Sears.
ARTICLE I. To see if the Town will vote to raise and appropriate or borrow
a sufficient sum of money for the purpose of employing the services of an
architect or architects to design and prepare plans and specifications and
pay other expenses for an elementary school; said plans and speoifioatior
to be prepared and said fund to be expended by and under the direction of
the Sch ool Building Committee, and to act fully thereon.
A motion for a secret ballot was defeated yes 144, no 192.
This article was defeated yes 205, no 122.
A motion to reconsider this article was passed.
A motion to raise and appropriate the money was withdrawn.
VOTED yes-221 , no 103 that the Town authorize the Treasurer, with the
approval of the Selectmen, to borrow the sum of One Hundred Seventy—Five
Thousand ($175,000.00) Dollars for the purpose of employing the ser rices
of an architect or architects to design and prepare puns and specifications
and pay other expenses for an elementary school, said plans and specific—
ations to be prepared and said fund to be expended by and under the
direction of the School Building Committee.
ARTICLE 2. To see if the mown will raise and appropriate a s-wn of money
to pay for interest on notes or bond issued to the gown of Brewster-for
the cost of architectural services for plans and specifications for the
construction of an elementary school.
VOTED that the Town raise and appropriate the sum of Eleven Thousand
($11 ,000.00) Dollars for the Purpose of paying interest on notes or bond
issued to the Town of Brewster for the cost of architectural services for
plans and specifications for the construction of an elementary school.
ARTICLE 3. To see if the Town will vote that the warrant for the annual
Town Meeting be closed seventy—five (75) days before each annual Town
seting and be in the hands of the Finance Committee by forty—five (45)
days before each annual Town T.Jeeting, commencing in "975.

place and inserting the words "Town Meeting to transmit ag', so the amended
Finance Co=mmittee 3y—Law shall read as follows:
There shall be a Finance Committee consisting of fifteen (15) members

when this By—Law is adopted shall within thirty days after such By.-Law
becomes effective, appoint from the citizens of the town two persons whose

shown on assessors' Map 24, Lot 18, to the authority and control of the
Department of Public Works, with the approval of the Board of Selectmen.
This transfer will take effect when the new Police and Fare Station has
been completed and is operational.

SPECIAL TOWN, MEETING WARRANT
October 29, 1974

Constable of the Town of Brewster
Greetings:
In the name of the Commonwealth of Massachusetts you are hereby directed
to notify and warn the inhabitants of the Town of Brewster qualified to vote
in Town affairs to meet in the Nauset Regional Middle School Gymnasium. on
Tuesday, the twenty-ninth day of October next at seven-thirty o1clock in the
evening, then and there to act on the following Articles:
ARTICLE 1. To see if the Tcwn will vote to join other Lower Cape towns in
creating a Lower Gape Health Facilities Distract and to take any action re-
lated thereto.
ARTICLE 2. To see if the Town will vote to transfer the sum of Two Thousand
Four Hundred Dollars ($2,400.00) from Available Funds to be added to the
balance of bower Cape Medical Facilities Deeds Account to fund the Town's
share of the cost of an in-depth study to determine the health needs of the
Y
ower Gape Towns.
ARTICLE 3. To see if the Town will vote to direct the Selectmen to order the
Town Clerk & Treasurer, Miss Ruth Eddy, to turn over to the Brewster Historical
Society the sum of Two Thousand Five Hundred Dollars ($2,500.00) said sum being
the amount of money given to the Town Clerk & Treasurer by the Bicentennial
Committee as snatching Funds for the restoration of the Brewster Historical
Society windmill.
ARTICLE 4. To see if the Town will vote that no person may sell second-hand
articles without first obtaining a license from the Selectmen to be exercised
in accordance with rules and regulations established by the Selectmen. Such
rules and regulations shall be designed to protect the public health and
safety and convenience and to restrict such sales to casual and/or occasional
occurence only in keeping with the character of the neighborhood, and with
the Zoning By-Laws of the Town. Notwithstanding any provision of this By-Law
any person may sell up to three second-hand articles without obtaining a
license from the Selectmen. The sale of antiques is not to be considered a
sale of second-hand articles under this By-Law. The penalty for a violation
of this By-Law is set forth in Section 55 of Chapter 140 of the General Laws.
ARTICLE 5. To see if the Town will vote to transfer from Available Funds the
sum of One Thousand Five Hundred Dollars ($1,500.00) to pay the Town of
Orleans for water service to Brewster residents now served from the Orleans
Water System., but to be billed in the future by the Brewster Water Department,
as voted by previous Town Meeting.
ARTICLE 6. To see if the Town will vote to authorize the Fater Commissioners
to exesaa from Water Construction Expense Account the sum. of Three Thousand
Seven Hundred ($3,700.00) for the purchase .of an underground boring tool for
the use of the Water Department.
ARTICLE 7. To see if the Town will vote to transfer from Available Funds the
sum. of Four Hundred Dollars ($400.00) for appraisal fees for land surrounding
the proven well-site #7.
ARTICLE S. To see if the Town will vote to amend the Personnel By-Law

title and interest by quitclaim deed to Robert Mongeau, of Slough Road,
Brewster, Massachusetts, in consideration of the sum of Ten Thousand Eight

ARTICLE 14. To see if the Town will vote to transfer from Federal
Revenue Sharing Funds the sum of Four Thousand Three Hundred Dollars
($4,300.00) for purchase of the .following requirements of the Fire
Department and Rescue Squad:

ARTICLE 15. To see if the Town will vote to amend the By-Law on Loud,
Excessive or Unusual Noises adopted on March 7, 1966 by deleting 'Twenty
Dollars ($20.00) and substituting Fifty Dollars ($50.00) so that it
reads as follows:
"It shall be unlawful for any person or persons being present in
or about any building, dwelling, premises, shelter, boat or con-
veyance or any part thereof, other than that section of any es-
tablishment licensed under Chapter 138 of the General Laws, who
shall cause or suffer or countenance any unnecessary loud, ex-
cessive or unusual noises, including any unnecessary loud, ex-
cessive or unusual noises in the operation of any radio, phono-
graph or other mechanical soundmaking device or instrument or
reproducing device or instrument or in the playing of any band,
orchestra, musician or group of musicians or the making of loud
outcries, exclamations or other loud or boisterous noises or
loud and boisterous singing by any person or group of persons or
in the use of any device to amplify the aforesaid noise where the
aforesaid noise is plainly audible at a distance of one hundred
and fifty feet from the building, dwelling, prem=ises, shelter,
boat or conveyance in which or from which it is produced. The
fact that the noise is plainly audible at a distance of one
hundred and fifty feet from the premises from which it originates
shall constitute primafacie evidence of a violation of this By-
Law. Any person shall be deemed in violation of this By-Law who
shall make or aid and abet or cause or suffer or countenance
or assist in making of the aforesaid and described improper noises,
disturbance, breach of the peace or a diversion tending to a breach
of the peace and the presence of any person or persons in or about
the building, dwelling, premises, shelter, boat or conveyance or
any part thereof during a violation of this By-Law shall constitute
primafacie evidence that they are a countenancer to such violation.
Any person violating this By-Law shall be punished by a fine of not
more than Fifty Dollars ($50.00) for each offense."
ARTICLE 16. To see if the Town will vote to amend the By-Law on Use of
Soap or Detergent on shores and ponds adopted on March 4, 1968 by deleting
Twenty Dollars ($20.00) and substituting Fifty .Dollars ($50.00) so that it
will read as follows:
"The use of soap or detergent of any type is prohibited in the waters
along the shore lines of all Tore. Landings on fresh water ponds. Any
violation of this By-Law shall be subject to a fine of not ire than Fifty
Dollars ($50.00) ."
ARTICLE 17. To see if the Town will vote to amend the Peeking or Spying,
Etc. By Law adopted on March 4, 1959 by deleting Twenty Dollars ($20.00)
and substituting Fifty Dollars ($50.00) so that it will read as follows:
"No person, except an officer of the law in performance of his
duties, shall enter upon or remain upon the premises of another with the
intent of peeking, spying or looking into the window, door or other
aperture of a house or another structure in any manner or upon any person
or persons therein. Any person found violating this By-Law shall be
subject to arrest without a warrant in accordance with Chapter 276,
Section 28 of the General Lags of Kassachusetts and any person convicted

of this offense shall be punished by a fine of not more than Fifty
Dollars ($50.00. )-"
ARTICLE. 18. To see if the Town will vote to amend the Alcoholic
Beverages By-.Law adopted on March 3, 1964 by deletLng 'Twenty Dollars
($20.00) and substituting Fifty Dollars ($50.00) so that it will read
as follows:
"It shall be unlawful for any person to consume alcoholic
beverages on Public Highways or in Public Parking places, including
vehicles thereon, within the Town of Brewster. 1h1hoever violates the
provision of this By-Law shall be fined in an amount not exceeding
Fifty Dollars ($50.00) for each offense."
ARTICLE 19. To see if the Town will vote to amend the Unregistered
and Dilapidated Motor Vehicle By-Law adopted on ?March 2, 1965 by de-
leting the words "if a written complaint has bean received by the
Selectmen or the Chief of Police. The Selectmen's judgement shall be
final as to whether or not a motor vehicle is junked or dilapidated."
and substituting "after official notification by the Police Department
has been made. Any person who violates this By-Law may be fined a
sum of Fifty Dollars ($50.00) for each offense. Each day or portion of
a day that the violation is allowed to continue after the four week
period shall constitute a separate offense." so that it reads as
follows:
"No unregistered and dilapidated motor vehicle and/or parts there-
of may be allowed to stand on the premises unlicensed under
Chapter 140, Section 5? of the General Laws; said unregistered
and dilapidated motor vehicle or vehicles and/or parts thereof
must be removed permanently within a four week period after
official notification by the Police Department has been made.
Any person who violates this By-Law may be fined a sum of Fifty
Dollars ($50.00) for each offense. Each day or portion of a day
that the violation is allowed to continue after the four week
period shall constitute a separate offense."
ARTICLE 20. To see if the Town will vote to transfer from Available
Federal Revenue Sharing Funds the sum of Seven Thousand Nine Hundred
Dollars ($7,900.00) to purchase and equip a four-,dneel drive police
vehicle.
ARTICLE 21. To see if the Town will vote to amend the Zoning By-Law,
Section X-C, by deleting the first paragraph which reads as follows:
"Land may be developed in a Planned Unit Development for uses including
among others, recreational, commercial, multifamily, single family and
institutional in the districts indicated in Table 2 if the development
complies with the following requirements." and substituting the
following:
"Planned Unit Developments. The Planned unit Development (PUD) is in-
tended to provide an alternate pattern of land development to the
pattern permitted in the RM and RL residential zones. Specifically,
it is intended to encourage the conservation of more significant common
open space than is normally the case in RM and RL zones, while at the
same time providing for a greater mixture of housing types at somewhat
greater dwelling unit densities than would be allowed in an RM or RL
district, without a significant increase in population density. This
is intended to be done by allowing the construction of appropriate
clusters of .dwelling units and commercial units which will not detract

rom the ecological and visual qualities of the environment.
A Planned Unit Development is intended to result in:
1. Conservation of significant tracts of open space;
2. Efficient allocation, distribution, and maintenance of
common open spaces;
3. Economic and efficient street, utility, and public
facility installation, construction, and :maintenance;
4. A variety of housing types and characteristics;
5. Housing and land development harmonious with natural
features.
in addition, the Planned Unit Development shall comply with the
following requirements:"

ARTICLE 22. To see if the Token, will vote to amend the Zoning By-Law,
Section X-C, Paragraph 4, by eliminating the second sentence which
reads as follows:
"This distribution system rust be connected to and served by the public
water supply system of the sown if available within 100 feet of the de-
velopment, or to a supply which has been approved by the Massachusetts
Department of Public Health and is shown to offer adequate quantity
to service the development."
and substituting the following:
"This distribution system must be connected to and served by the
public water supply system of the town."
so that paragraph 4 will read as follows:
114. The developer shall provide within the Planned Unit Development
a water distribution system which shall be approved by the Brewster
Department of Public Works and shall be of sufficient size and design
to supply potable water to each of the structures to be erected in
the development. Tf.is distribution system trust be connected to and
served by the public -water supply system of the tower.. The developer
shall also provide a fire hydrant within 500 feet of each structure.
ARTICLE 23. To see if the Town will vote to amend the Zoning By-Law,
Section X-C, Paragraph 6.a. by deleting the present paragraph 6.a. and
substituting the following:
"A minimum of 20% of the total area shall remain as open space. The
oner space may be used .for recreational purposes by residents of the PUD
'(or-for courts, gardens and household service activities such as clothes
drying) . No paved space such as streets or parking lots may be in-
cluded as open space, and no building may be erected on such open
space."
ARTICLE 24. To see if the town will vote to amendthe Zoning By-Law,
Section X-C, Paragraph 6.b. by deleting the present Paragraph 6.b, and
substituting the following:
"The remaining 80% of the total area of the PUD may be used for de-
velop-rent including roads and at least 75% of this 80/ shall be utilized
for residential purposes. In computing land to be considered as devoted
to residential use, no part of the 20% designated as open spaces in 6.a.
may be included."
ARTICLE 25. To see if the Town will vote to amend the Zoning By-Law,
Section X-C, Paragraph 7 by deleting the present Paragraph 7 and s,.zbsti-
tuting the following:
"The average density of residences shall not exceed three (3) dwelling
units per acre of land within the 80% of the total acreage which is
allocated for residential use. Land designated as open spaces in 6.a.
above shall not be used in computing the allowable density."
ARTICLE 26. To see if the Town will vote to amend the Zoning By-Law,
Section X-C, Paragraph 9 by adding the following:
"Commercial structures shall be located well within and screened from
the boundaries of the PUD in such a manner as not to create a commer-
cial zone along the fringes of the PU-D."
so that Paragraph 9 will read as follows:
119. The proposed location and arrangement of structures shaE not be
detrimental to existing or prospective adjacent structures or to
existing or prospective development of the neighborhood. Commercial
structures shall be located well within and screened from the
boundaries of the PUD in such a manner as not to create a Commercial.
Zone along the fringes of the PUD.:'

AFTICEE 27 . To see if the Town will vote to amend the Zoning By-Law,
Section X-C , Paragraph 11 by deleting the present Paragraph 11 and
substituting the following :
" The maximum permitted height of structures shall be 30 feet , or 2
stories . "
ARTICLE 28 . To see if the Town will vote to amend the Zoning By-Law ,
Definitions , Section II by deleting the present Planned Unit Develop-
ment definition and substituting the following :
" Planned Unit Development : A mixed use development on a plot of land
in single or consolidated ownership , in which a mixture of residen-
tial , open space , commercial , recreational and other uses and a
variety of building types , may be permitted subject to the provisions
of Section X-C . "
ARTICLE 29 . To see if the Town will vote to amend the Zoning ByLaw,
Section VI , Table 2 . Area Regulations . C-H , Multifamily Dwellings by
deleting the present area requirement of " 1 , 000 square feet per
dwelling unit " and substituting the following :
1110 , 000 square feet per dwelling unit . "
ARTICLE 30 . To see if the To,„m will vote to transfer Five Hundred
Thirty Dollars ( $530 . 00 ) from the Programs With Other Districts
Account to the School Committee Expense Account and Four Thousand
Five Hundred Forty-three Dollars ( $4 , 513 . 00 ) from the Programs With
Other Districts Account to the Elementary School Operation Account .
ARTICLE 31 . To see if the Town will vote to transfer from Available
Funds , or borrow the sum of Seventeen Thousand Two Hundred Dollars
( $17 , 200 . 00 ) , for the purpose of purchasing Lot No . 102 , on the Town
of Brewster Assessors ' Map No . 26 , ' and obtain an Easement across
Lot No . 103 on the Town of Brewster Assessors ' Rap No . 26 and the
Penn Central Right of Way to presently owned town property designated
as Lot No . 80 on the Town of Brewster Assessors ' Map No . 16 , for
educational , recreational or municipal purposes , said sum of money
to supplement a sum of money voted at the May , 1974 Annual Town
Meeting . —
ARTICLE 32 . To see if the Town will vote to transfer from Available
Funds the sum of Two Thousand . Five - Hundred Dollars ( $2 , 500 . 00 ) for
the purpose of correcting violations to the State ana -Town Buil-6ing
Codes in the •previous Fire Station. building .-

REPORT OF THE SPECIAL TOWN MEETING �
October 29, 1974
In accordance with the Warrant, the meeting was held in the Nauset
Regional Middle School Gymnasium, Tuesday evening, October 29, 1974.
The meeting was called to order by the Moderator, Stephen Doyle, at
7:30 p.m. , a quorum being present. The Registrars were Dorothea Dugan,
Jean Gage and Jon Howard. The Tellers were Paul Sylver, Dorothy Grenier,
Gladys Curtis, Doris Powell and J. Ogden Tyldsley, Jr. The Pages were
Jed Duffy and Sylvia Eldredge.
The Warrant was read by the Town Clerl�, Ruth Eddy, with the exception
of the articles, which were read as they were being considered.
The invocation was offered by Father Bedard. The Pledge of Allegiance
to the Flag was lead by Nina Lindstrom and Melody Sears,, and the Moderator
recognized their becoming First Class Scouts.
ARTICLE 1. To see if the Town, will vote to join other Lower Cape towns in
creating a Lower Cape Health Facilities District and to take any action
related thereto.
This motion was postponed indefinitely.
ARTICLE 2. To see if the Town will vote to transfer the sum of Two Thousand
Four Hundred Dollars ($2,400.00) from Available Funds to be added to the
balance of Lower Cape Medical Facilities Needs Account to fund the Town's
share of the cost of an in—depth study to determine the health needs of the
Lower Cape Towns.
VOTED that the Town transfer the sum of Two Thousand. Four Hundred Dollars
($2,400.00) from Available Funds to be added to the balance of Lower Cape
Medical Facilities Needs Account to Fund the Town's share of the cost of an

ARTICLE 3. To see if the Town will vote to direct the Selectmen to order
the Town. Clerk & Treasurer, Miss Ruth Eddy, to turn over to the Brewster
Historical Society the sum of Two Thousand Five Hundred Dollars ($2,500.00)
said sum being the amount of Money given to the Town Clerk & Treasurer by
the Bicentennial Committee as matching funds for the restoration of the
Brewster Historical Society windmill.
VOTED that the Town will direct the Selectmen to order the Town Cleric &
Treasurer, Miss Ruth Eddy, to turn over to the Brewster Historical Society
the sum of Two Thousand Five Hundred Dollars ($2,500.00) said sum being the
amount of money given to the Town. Clerk & Treasurer by the Bicentennial
Committee as matching funds for the restoration of the Brewster Historical
Society windmill.
ARTICLE 4. To see if the Town will vote that no person may sell second—
hand articles without first obtaining a license from the Selectmen to be
exercised in accordance with rules and regulations established by the
Selectmen. Such rules and regulations shall be designed to protect the
public health and safety and convenience and to restrict such sales to
casual and/or occasional occurence only in keeping with the character of
the neighborhood, and with the Zoning By—Laws of the Town. Notwithstanding
any provision of this By—Law any person may sell up to three second—hand
articles without obtaining a license from the Selectmen. The sale of
antiques is not to be considered a sale of second—hand articles under this
By—Law. The penalty for a violation of this By—Law is set forth in Section
55 of Chapter 140 of the General Laws.

Excessive or Unusual Noises adopted on March 7, 1950' by deleting Twenty

in or about any building, dwelling, premises, shelter, boat or
conveyance or any part thereof, other than that section of any

shall make or aid and abet or cause or suffer or countenance or assist
in making of the aforesaid and described improper noises, disturbance,
breach of the peace or a diversion tending to a breach of the peace and
the presence of any person or persons in or about the building, duelling,
premises, shelter, boat or conveyance or any part thereof during a violation of
this By—Law shall constitute primafacie evidence that they are a counte—
nancer to such violation. Any person violating this By—Law shall be
punished by a fine of not more than Fifty Dollars ($50.00) for each
offense."

beverages on Public Highways or in Public Parking Places, in—
cluding vehicles thereon., within the Town of Brewster. Whoever

ARTICLE 19. To see if the Town will vote to amend the Unregistered and
Dilapidated Motor Vehicle By—Law adopted on March 2, 1965, by deleting
the words "if a written complaint has been received by the Selectmen or
the Chief of Police. The Selectmen's judgement shall be final as to
whether or not a motor vehicle is junked or dilapidated." and substitu—
ting "after official notification by the Police Department has been
made. Any person who violates this By—Law may be fined a sum of Fifty
Dollars ($50.00) for each offense. Each day or portion of a day that
the violation is allowed to continue after the four week period shall
constitute a separate offense." so that it reacts as follows:
"No unregistered and dilapidated motor vehicle and/or parts
thereof may be allowed to stand on the premises unlicensed
under Chapter 140, Section. 57 of the General Laws; said un-
registered and dilapidated motor vehicle or vehicles and/or
parts thereof must be removed permanently within a four week
period after official notification by the Police Department
has been made. Any person who violates this By—Law may be
fined a sum of Fifty Dollars ($50.00) for each offense. Each
day or portion of a day that the violation is allowed to con—
tinue after the four week period shall constitute a separate
offense.11

Federal Revenue Sharing Funds the sum of Seven Thousand Nine Hundred

ARTICLE 21. To see if the Town will vote to amend the Zoning By—Law,
Section X—C, by deleting the first paragraph which reads as follows:
"Land may be developed in a Planned Unit Development for uses including
among others, recreational, commercial, multifamily, single family and
institutional in the districts indicated in Table 2 if the development
complies with the following requirements.', and substituting the following:
"Planned Unit Develoj'ments. The Planned Unit Development (PUD) is inten—
ded to provide an alternate pattern of land development to the pattern
permitted in the RigI and RL residential zones. Specifically, it is inten-
ded to encourage the conservation of more significant common open space
than is normally the case in R1 and RL zones, while at the same time pro—
viding for a greater mixture of housing types at somewhat greater dwelling
unit densities than would be allowed in an RM or RL district, without a
significant increase in population density. This is intended to be done
by allowing the construction of appropriate clusters of dwelling units and
commercial units which will not detract from the ecological and visual
qualities of the environment.
A Planned Unit Development is intended to result in:
1. Conservation of significant tracts of open space;
2. Efficient allocation, distribution, and maintenance of common
open spaces;
3. Economic and efficient street, utility, and public facility
installation, construction, and maintenance;
4. A variety of housing types and characteristics;
5. dousing and land development harmonious with natural
features.
In addition, the Planned Unit Development shall comply with the following
requirements:"

Section X—C, Paxagraph 4, by eliminating the second sentence which reads
as follows:
"This distribution system must be connected to and served by the public
water supply system of the town if available within 400 feet of the devel-
opment, or to a supply which has been approved by the Massachusetts
Department of Public Health and is shown to offer adequate quantity to
service the development." and substituting the following:
"This distribution system must be connected to and served by the public
water supply system of the town." so that Paragraph 4 will read as
follows:
n4. The developer shall provide within the Planned Unit Development a
water distribution system which shall be approved by the Brewster Depart—
ment of Public Works and shall be of sufficient size and design to supply
potable water to each of the structures to be erected in the development.
This distribution system must be connected to and served by the public
water supply system of the town. The developer shall also provide a fire
hydrant within 500 feet of each structure.,,

ARTICLE 23. To see if the Town will vote to amend the Zoning By:-Law,
Section X—C, Paragraph 6.a by deleting the present Paragraph b.a and sub—

ARTICLE 24• To see if the Town will vote to amend the Zoning By Law,
Section X-C, Paragraph 6.b by deleting the present Paragraph 6.b and sub-
stituting the following:
"The remaining 80% of the total area of the PUD may be used for develop-
ment:,including roads and at least 75% of this 80% shall be utilized for
residential purposes. In computing land to be considered as devoted to
residential use, no part of the 20% designated as open spaces in 6.a may
be included."

ARTICLE 25. To see if the Town will vote to amend the Zoning By-Law,
Section X--C, Paragraph 7 by deleting the present Paragraph 7 and substi-
tuting the following;
"The average density of residences shall not exceed three (3) dwelling
units per acre of land within the 80% of the total acreage which is allo-
cated for residential use. Land designated as open spaces in 6.a above
shall not be used in computing the allowable density."

ARTICLE 26. To see if the Town will vote to amend the Zoning By-Laura
Section X-C, Paragraph 9 by adding the following:
"Commercial structures shall be located well within and screened from the

so that Paragraph 9 will read as follows:
119. The proposed location and arrangement of structures shall not be
detrimental to existing or prospective adjacent structures or to existing
or prospective development of the neighborhood. Commercial structures

in such a manner as not to create a Commercial Zone along the fringes of
the PUD."

November 5, 1974
The State Election was held on November 5, 1974 in accordance with the
Warrant, at the Brewster Town Hall. Polls were open from 10:00 A. M. to
8:00 F. M. The return of the Warrant was read by the gown Clerk, Ruth Eddy.
The following Election officers were sworn in: Paul Sylver, 'Karden, Dorothy
Grenier, Deputy Warden, Gladys Curtis, Doris Powell, Dick Kingston, J. Ogden
Tyldsiey, Jr., Katherine Meyer and Alice Fitsch. The counters who came in at
6:00 and 5:00 P. M. were:Robert Clark, Boy Jones, June Gallant, Jean Feldbauer,
Eleanor ,,illiams and Margaret Macauley. The police officers on the ballot box
were Richard Barbour and William Knee.
- There were 1706 votes cast. The results were as follows:

CLERKS RECORD OF PERAMBULATION OF BOUNDARY (COMMON) TO DENNIS AND HARWICH
The Board of Selectmen. of Harwich, all members present, met with the
Executive Secretary of Dennis, who stated be was authorized to act on be—
half of the Selectmen and together with the Dennis 'Town Engineer did under—
take to view the bounds.

=A. Starting at the tri-town boundary of Brewster, Dennis and Harwich, in
the northwest corner of Harwich, the bound was found and marked. The next
mark to the southward on Old Chatham Road was found and some discussion fol-
lowed as -to its purpose. The engineers generally agreed that the bound was
not precisely on the line, but may be a witness mark, or- offset, due to
topography. The third mark was located in the woods on an old woods road to
the north of Great Western Road. The fourth bound was located further
southward on the south side of Great Western Road laying on the ground. The
fifth bound was found at the intersection'af Depot Street and Centre Street.
The sixth bound was located on Depot Street between Telegraph Road and
Division Street and was generally agreed to be accurate. The seventh mark
was found at the intersection of Route 2$ and Division Street, and was
agreed to be nearly on the mark. The eighth bound was located at the inter-
section of Division Street and Lower County Road. The ninth mark was found
off Belmont Road and Chase Street. The tenth bound was found westerly of
the right of way from the Belmont Hotel southerly.
It was generally agreed that the system of bounds was in some disagree-
ment with the material relating to the survey currently being used. Refer-
ence was made to an Act of the legislature which could explain those differ-
ences. The Acts of 19+7 Chapter 372 enclosed spell out the redefinition of
those bounds and marks.
E It was also agreed that a petition to the County Commissioners to set
and certify ,those bounds and witness marks according to the Acts of 19+7
so as to make them conform.
The Board would like to thank the Engineers of both towns for the
preparation work relating to the day's work.
