In accordance with the Warrant, the meeting was held in the Nauset Regional
Middle School gymnasium, Monday evening, lay 10, 1976.
The meeting was called to order by the Moderator, Stephen Doyle, at 7:00 p.m. ,
a quorum of 127 being present. The Registrars were Dorothea Dugan, .lean Gage
and Jon Howard. The Tellers were maul Sylver, Dorothy Grenier, Gladys Curtis
oris Powell, and J. Ogden Tyldsley, Jr. The pages were Ellen, and Robbie Hooper.
The invocation was given by Father Bedard.
The `arrant was read by the Town Clerk, Muth Eddy, with the exception of
the articles, which were read as they were being considered.
A motion to adjourn was defeated.
ART'ICLE 1 . To see if the Town will accept the Annual Report of the Selectmen
and other Town Officers as submitted.

ARTICLE 2. To see if the Town will hear the report of any special committee.
VOTED that the Town hear the report of:
1 . Committee to Study the Future Use of the Present Brewster Elementary
School..
2. Brewster Elementary School Building Committee.
-kRTICILH 3. To see if the Town will vote to authorize the Town Treasurer, with
the approval of the Selectmen, to borrow money from time to time in anticipation
of the revenue of the financial year beginning July 11, 1976, in accordance with
the provisions of the General Laws, Chapter 44, Section 4, and to issue a note
or notes therefore, payable within one year, and to renew any note or notes as
may be given for a period of less than one (1) year in accordance with General
Laws, Chapter 44, Section 17.

ARTICLE 4. To see if the Town will vote to raise and appropriate as payment
due, the su:'n of Two Hundred Forty—two and 43/100 ($242-43) Dollars for the year
1975, under the provisions of Chapter 32, Section 59A of the General Laws, and
authorize the Town Treasurer to pay said appropriation to the Town of Arlington,
'lass. , said Chapter referring to the non—contributory pension payments made to
veterans.

ARTICLE 5. To see if the Town wall vote to raise and appropriate, as payment
due, the sum of Five Hundred Nineteen and 10100 ($519.10) Dollars for the year
1975, under the provisions of Chapter 32, Section 59A of the General Laws and
authorize the Town Treasurer to pay said appropriation to the Commonwealth of

Massachusetts, said Chapter referring to the non—contributory pension payments
made to veterans.

ARTICLE 6. To see if the Town will vote to raise and appropriate the sum of
Twelve Hundred ($1 ,200.00) Dollars for the period from July 1 , 1976 to June 30,
1977, under the provisions of Chapter 944, Sections 1 and 2, Acts of 1971 , an
Act providing that cities and towns grant an manual pension to certain retired
teachers and that the Commonwealth reimburse said cities and towns for the
amount of all such pensions.

ARTIOLE 7. To see if the Town will vote to transfer from Federal Revenue
Sharing Funds the sura of Thirty Thousand ($30,000.00) Dollars to pay the principal
due December 1 , 1976 on the Municipal Purpose Bond (Fire -- Police Station
and Land for the :Municipal Disposal. Area).

ARTICLE 8. To- see if the Town will vote to assume liability in the manner
provided by Chapters 516 and 5249 Acts of 1950 for all damages that may be in—
curred by work to be performed by the Department of Public Works of Xassachusetts
for the improvement, development, maintenance and protection of tidal and non—
tidal, rivers and streams, harbors, tide—waters, foreshores and shores along
P- public beach outside Boston Harbor, including the Merrimack and Connecticut
Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and
authorize the Selectmen to execute and deliver a bond of indemnity therefore

to the Commonwealth.

LRTICLS 9. To see if the Town will vote to authorize and instruct the Town
Treasurer to pay the Bog Tax returns from the assessments of 1975,. to the
Brewster Ladies= Library Association in accordance with Chapter 14.0,

ARTIGT,E 10. To see if the Town will vote to transfer from Available Fronds
in the Treasury, funds received from the Commonwealth, the sura of One
Thousand ($1 ,000.00) Dollars to the Brewster Ladies' Library Association.

ARTICLE 11. To see if the Town will vote to raise and appropriate the sum
of Five Hundred ($500.00) Dollars to be added to the Conservation Fund.

ARTICLE 12. To see if the Town will vote to raise and appropriate the sum
of Two Hundred Six and 80/100 ($206.80) Dollars under the provisions of
Chapter 388, Acts of 1954, amended by Chapter 433 of 1955, Control of Green—
head Fly and authorize the Town Treasurer to pay said appropriation into
the State Treasury.

ARTICLE 13. To see if the Town will vote to raise and appropriate the sum
of One Hundred Fifty—five ($155.00) Dollars for membership dues of the Town
in the Massachusetts League of Cities and Towns for Fiscal year ending
June 30: 1977.

ARTICM- 14. To see if the Town will vote to adopt the following By—Law:
No person shall fire or discharge any firearms or explosives of any kind
within the limits of any highway, parka or other public property, except
with the written permission of the Board of Selectmen or on any private
property, except with the written consent of the owner or legal occupant
thereof; provided, however, that this By—Law shall not apply to the lawful
defense of life or property nor to any law enforcement officer acting in
the discharge of his duties. Any person violating this By—Law shall be
punished by a fine of not more than Two Hundred ($200.00) Dollars for each
offense.

A_MICLE 15. To see if the Town will vote an expression of opinion in the
form of a Resolution regarding the Old King's Highway Regional Historic
District Act as established by Chapter 470 of the Acts of 1973 and amended
by Chapters 298 and 845 of the Acts of 1975 as follows:
Whereas the Act allows by Section 2 the inclusion of more than 95io of
the land area. of Brewster and all but twelve of the more than four hundred
roads in Brewster.
Whereas the Act by Section 3 governs the exterior architectural feature
of all buildings and structures visible from all public places and all but
twelve -ways within the Tows.
im'hereas the Act by its entirety does not allow for any areas within
the district to be considered in a different manner than any other regard—
less of locations vrithin the Town or their proximity to buildings, areas,
or landmarks compatible with the historic, cultural, literary, and aesthetic
tradition of Brewster, as it existed in the early days of Cape Cod.
Therefore, be it resolved that the Chairman of the Brewster Old King's
Highway Regional Historic District Committee as a member of the Old King's
Highway Regional Historic District Commission as established by Section 4
of the Act be instructed to inform the Commission:
1 . That the Town of Brewster shall for the purpose of this Act be
divided into three (3) zones consisting of Zone A, the area visible
from streets which have been determined to be of historic arid:
scenic value to the Town, including residential, commercial, munic—
ipal, State and Federal, Government owned areas; Zone B, the area
abutting Zone Z providing buffer areas between Zone A and Zone C,
areas bordering arterial streets or roads into the Town,, undeveloped
subdivisions and sub—divisions teach all buildings to date have

had Certificates of Appropriateness issued, including residential,
commercial, municipal, State and Federal Government ot-med areas;
?one C, the areas of Nickerson Park not visible from Zone A, disposal

State and Federal Government owned areas.
2. That the Brewster Old King's Highway Regional Historic District
Committee shall_ in their deliberations consider each zone inde-
pendent of each other zone but each building and/or structure
within a zone in the same manner, always keeping in mind the best
interests of the Tom, of Brewster.
3. That the Brewster Old King's uighway Regional. Historic District
Committee shall continue to maintain the purpose of the .Act as
stated in Section I.

The Annual Town Dleeting was adjourned at 9:08 p.m. and the Special Town
Meeting convened.
The Annual Town meeting reconvened May 13, 1976 at 7:00 p.m. with a quorum
present. The tellers were Paul Sylver, Dorothy Grenier, Gladys Curtis, Boris
Powell and Richard Kingston. The pages were Leslie'iOringer and Julie Grenier
The Registrars were the same.
ARTICLE 16. To see if the Town will vote an expression of opinion in the form
of a Resolution regarding the Old King's Highway Regional Historic District
Commission as follows:
Whereas the Act establishing the Old King's Highway Regional Historic
District (Chapter 470 of Acts of 1973 and amended by Chapters 298 and 845 of
the Acts of 1975) allows in Section 14 an apportionment of expenses among the
member towns comprising the district.
`'Whereas the Act does not regulate the manner in which and for which funds
may be expesided.
Whereas the Act does not specify what shall be done with surplus funds
in the Commission Treasury at the end of the fiscal years.
Whereas the Act does not require any financial accountability by the
Commission.
Therefore, be it resolved that the Chairman of the Brewster Old King's
Highway Regional Historic District Committee as the member of the Old King's
Highway Regional Historic District Commission as established by Section 4 of
the Act be instructed to request that the Commission:
1 . Supply each member town with a financial statement quarterly.
2. Return to each of the nine town treasurers their share of any monies
surplus at the end of the fiscal year or decrease each toum's
appropriation for the next fiscal year by their share of surplus
funds.
3. Not contract for any professional services without negotiation and
and advertising. (Including executi,,re secretary and/or planners.)

A motion was wade by Selectman Robert Sawtelle and seconded to spread on the
record of this Town Meeting the sincere gratitude of the people of the Towm
of Brewster to Mr. Richard Moulton for his tireless efforts in his service
on our behalf during the years he has served the Town as a member of the
Planning Board - and most recently as Chairman of the Planning Board.
Mr. Moulton submitted his resignation to the Board of Selectmen this morning,
and it took effect immediately.
To dr. Richard Moulton I request a standing round of applause as a gesture of
our appreciation.
ARTICLE 53• To see if the Town will vote to amend the Zoning By-Lair, S
Section II, DEFINITIONS, by eliminating existing definitions for "Trailer
and by adding the following definitions to be inserted in proper alphabetical
order:
TRAVEL A vehicular, portable structure built on a chassis and
TRAILER designed to be used for temporary occupancy for travels
recreation or vacation use and when equipped for the road,
it shall have a body width not exceeding eight (8) feet,
and a body length not exceeding thirty-two (32) feet.
MOBIL Any vehicle or object on wheels which is so designed or
CAMPING constructed or reconstructed or added:to be means of
VEHICLE accessories, to permit the vehicle to travel over the
highways and to be used for camping purposes' whether
resting on wheels, jacks or other foundation. This
definition includes self powered camping units, expand-
able camping units, track mounted campers, vans equipped
for camping and similar camping devices.
