ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI,ACCEPTING AND APPROVING THE
FINAL PLAT OF POWELL SUBDIVISION, A SUBDIVISION OF THE CITY OF JEFFERSON,
MISSOURI.
WHEREAS, Arlene S. Powell, owner of the real estate hereinafter described, having submitted to the
City Council a plat of said real estate,being located in Jefferson City, Cole County, Missouri,and more
particularly described as follows:
Part of the Southeast Quarter of the Southeast Quarter of Section 27, Township 45
North, Range 12 West, in the City of Jefferson, Cole County, Missouri, more
particularly described as follows: From the southeast corner of the aforesaid Section
27;thence S84 0 24'39"W, along the section line,252.40 feet to a point intersecting the
southerly boundary line of a tract described by deed of record in Book 367, page 200,
Cole County Recorder's Office and said line being the northerly line of a public street
right-of-way known as Boonville Road; thence,along the northerly line of said Boonville
Road right-of-way,the following courses: N57 037'00"W, along the southerly boundary
line of the aforesaid tract described in Book 367, page 200 and continuing along the
southerly boundary line of other tracts described by deed of record in Book 308, page
386, Book 192, page 539 and Book 337, page 913, Cole County Recorder's Office,
359.62 feet;thence continuing Westerly,along the southerly boundary line of said tract
described in Book 337, page 913 and along the southerly boundary line of another
tract described by deed of record in Book 261, page 314, Cole County Recorder's
Office, on a curve to the left, having a radius of 1457.69 feet, an arc distance of 120.5
feet, (the chord of said curve being N59 59'05"W, 120.47 feet) to the southwesterly
corner thereof; thence N7°41'00"W, along the westerly boundary line of said tract
described in Book 261, page 314, 7.15 feet to the southeasterly corner of a tract
described by deed of record in Book 314, page 271, Cole County Recorder's Office
and the POINT OF BEGINNING for this description; thence along the boundary line
of said tract described in Book 314, page 271, the following courses: N67°35'53"W,
along the northerly line of the aforesaid Boonville Road right-of-way, 299.45 feet to a
point intersecting the easterly boundary line of a tract described by deed of record in
Book 352, page 583, Cole County Recorder's Office; thence leaving the northerly line
of the aforesaid Boonville Road right-of-way, N22'52'28"E,along the easterly boundary
line of said tract described in Book 352, page 583, and along the northerly extension
thereof, 197.93 feet to a point intersecting the southerly line of the 100 foot wide,
Missouri Pacific Railroad right-of-way;thence Easterly,along said Railroad right-of-way
line, on a curve to the right, having a radius of 13,714.09 feet, an arc distance of
293.16 feet, (the chord of said curve being S61`42'17"E, 293.16 feet) to the
northwesterly corner of the aforesaid tract described in Book 261, page 314; thence
S20`1 7'00"W, along the westerly boundary line of said tract described in Book 261,
page 314, 167.94 feet to the POINT OF BEGINNING. Containing 1.24 acres.
WHEREAS, it appearing that said plat has been fully and properly signed and accepted by the owner
of said subdivision, known and referred to as the Plat of Powell Subdivision, that all taxes have been
paid, and that in all respects the requirements of Chapter 445, RSMo, entitled "Plats" have been fully
complied with by the owner of said subdivision, and that in all respects the requirements of the
Planning and Zoning Commission of the City of Jefferson, Missouri, relating to plats and subdivisions
have been complied with.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1.That the plat of Powell Subdivision, lying,being and situated within the corporate
limits of the City of Jefferson, Missouri, as shown by the said plat attached hereto and made a part
of this ordinance, is hereby approved and accepted by the City Council of the City of Jefferson,
Missouri.
SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of
Jefferson.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

COMM EN'rs:
The Engineering Division has done a techniccll review of the final minor subdivision plat as
submitted by Central Missouri Professional Services, Inc. Almost all items concerning
Engineering Division review in Section 33-8. of the Subdivision Code pertaining to final plat
contents have been addressed on the latest submittal oftlic final plat. The !bIlowing comments
are regarding this review;
Regarding infrastructure;
Existing street, storm sewer, and smitary sewer infrastructure ilrc in the vicinity of the
proposed development.
Sidewalk has been proposed along the ti-ontagc of the Subdivision along Boonville Road,
This will have to be proposed as Give (5) feet sidewalk though, ns Boonville Road is
considered as n collector roadway.
Regarding traffic impact;
Boonville Road is classified is a collector roadway from MO Route 179 to West Main
Street (Classification is from the List Of l"unetional Roadway Classification for Jefferson
City, dated April 12, 2000).
The speed limit for Boonville Road. is '10 mph.

The proposed development is within an existing residential area. Only one (1) new lot
will be creilted With this development, two (2) existing hon-ics arc already COJIStrUcted.

Support, with the following condition,
1. Either a Sidewalk casement needs to be added to the plat at the southwest corlier of the
site, as it appears that the sidewalk will slightly encroach onto the proposed lot, or
additional right-of way be dedicated on the frontage of tlic proposed lot 3 of the
subdivision.

of the Final plat ol'I'owcll Subdivision. The illlnor Subdivision prolmses three (3) lots Up011 1.24 acres, and
is zoned RS-2 Single-Family Residential. The subject property is located in part of'the Northwest Quarter
of Section 27, 'Township 45 North, Ranee 12 West.
Background
The subject property is located approximately 570 feet cast of 1•lighway 179/Rock Hill Road and consists
of a single parcel containing 1.24 acres. Two single family homes arc located upon the parcel as it currently
exists. Three lots arc proposed in this minor subdivision which would create separate lots for each of the
two existing,dwellings, and one new lot. The subdivision would have the result that the two lots on which
dwellings are located could be sold to individual owners, as could the newly created vacant lot.
The Cole County Assessor's records indicate that the home addressed as 1048 13ocnrville ftoacl,and located
upon proposed Lot I, was constructed in 1963; this proposal lot contain one accessory building. "I'lie home
addressed as 1052 Boonville Road,and located upon proposed Lot 2 was constructed in 1920;this proposed
lot also contains two accessory buildings, noted as a detached garage and a shed. Proposed Lot 3 is vacant,
Zoning is RS-2 Single family Residential, which requires a minimum lot size of 10,000 square feet per lot,
and minimum width of 80 feet.
Section 33-8 of the Subdivision Code, Regarding Final plats
All items required by Section 33-8 Final Plat Contents have been addressed. No improvement plans were
required as the major infrastructure is existim,'.
Section 33-9 of the Subdivision Code, Construction of'Sidewalks
Sidewalks are shown along the 1lorlh side of the Boonville Road right-of-way, Boonville Road is classified
as a collector street, the sidewalk should be ;l minimum of five (5) feet in \Vidtll.
Recommendation: Approve, subject to:
1. Shoving sidewalk width as five (5) feet;
2. Recommendations of the 1-1nginecring Division,
