HomeMy Public PortalAboutORD13731 BILL NO. 2004-22 SPONSORED BY COUNCILMAN Councilman Kevin Brown ORDINANCE NO. _L 1 i� AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY ANNEXATION OF 87.20 ACRES OF REAL PROPERTY ADJACENT TO AND CONTIGUOUS WITH THE CITY BOUNDARY AND LYING IN SECTIONS 16 AND 17, TOWNSHIP 44 NORTH, RANGE 12 WEST, IN COLE COUNTY, STATE OF MISSOURI, AND REPEALING SECTION 1-17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY AND ENACTING A NEW SECTION PERTAINING TO THE SAME SUBJECT. WHEREAS, pursuant to Section 71.012.2 RSMo, 1994, the City Council of the City of Jefferson was presented with a verified petition requesting that the city annex the unincorporated area of land described in Section 1; WHEREAS, the petition requesting said annexation was signed by all fee interests of record in all real property located within the area proposed to be annexed; and WHEREAS, a public hearing concerning the annexation was held,as advertised in the Jefferson City Post Tribune; and NOW THEREFORE, BE IT ENACTED BY 'THE CITY COUNCIL OF THE CITY OF.JEFFERSON, MISSOURI, AS FOLLOWS: Section 'I. The area to be incorporated into the City is described as follows: All of the Southwest Quarter of the Northwest Quarter of Section 16 and all of the Southeast Quarter of the Northeast Quarter of Section 17,all in Township 44 North, Range 12 West, in the County of Cole, Missouri; being more particularly described as follows: BEGINNING at the southeast corner of the Southeast Quarter of the Northeast Quarter of said Section 17, said corner being also known as the west quarter corner of said Section 16 and the east quarter corner of said Section 17; thence S85 003'23"W, along the quarter section line, 1358.26 feet, to the southwest corner of the Southeast Quarter of the Northeast Quarter of said Section 17; thence N05'56'38"W, along the west line of said quarter quarter section, 1373.97 feet, to the northwest corner of said quarter quarter section;thence N85004'49"E, along the north line of said quarter quarter section, 1354.49 feet, to the northeast corner of said quarter quarter section, said corner also being the northwest corner of the Southwest Quarter of the Northwest Quarter of said Section 16; thence N83050'1 3"E, along the north line of said quarter quarter section, 1407.11 feet, to the northeast corner of the Southwest Quarter of the Northwest Quarter of said Section16; thence S06'13'09"E, along the east line of said quarter quarter section, 1375.04 feet, to the southeast corner of said quarter quarter section; thence ©III 2004.22 Pogo t S83°54'01"W, along the south line of said quarter quarter section, the quarter section line, 1409.92 feet, to the southeast corner of said quarter quarter section and the POINT OF BEGINNING for this description. The City Council finds and declares that the land described in Section 1 is contiguous to the City boundary; that the annexation is reasonable and necessary to the proper development of the City; and further, did determine the City has the ability to furnish normal municipal services to the area. Section 3. The land described in Section 1 shall be zoned RU, Rural Use, in accordance with the City Code as no zoning plan was submitted concurrently with the petition for annexation, and until such time as the zoning may be changed in the manner provided for by State Statute and City Code. Section 4. Section 1-17 of the Code of the City of Jefferson, Missouri is hereby repealed and a new Section 1-17 is hereby enacted, which shall read as follows: Sec. 1-17. City boundaries.
