A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD,
AUTHORIZING THE CITY MANAGER TO APPROPRIATE $45,000 FROM THE
UNAPPROPRIATED TRANSPORTATION DEVELOPMENT ACT, ARTICLE 3
FUNDS TO THE SIDEWALK IMPROVEMENT PROJECT, PROJECT NO.
4011.68.022 AND APPROVING CONTRACT CHANGE ORDER NO. 1, IN AN
AMOUNT NOT TO EXCEED $45,000 BETWEEN THE CITY AND KALBAN INC.
AND AUTHORIZING THE MAYOR TO EXECUTE THE CONTRACT CHANGE
ORDER
WHEREAS, the Transportation Development Act, (TDA) Article 3,
provides that 2% of each county's total local Transportation Fund be annually set
aside and used to fund the development of pedestrian and bicycle facilities; and
WHEREAS, the Transportation Development Act (TDA) funds allocation of
the City of Lynwood for FY 2016 -17 is $45,000; and
WHEREAS, staff has identified various locations citywide where
reconstruction of sidewalk is needed; and
WHEREAS, the Lynwood City Council desires to continue providing safe
pedestrian facilities to its residents; and
WHEREAS, on April 25, 2016, the City awarded a construction contract to
the apparent low bidder, Kalban Inc. for its base bid price of $148,281, through
informal bidding process for the Sidewalk Improvement Project, Project No.
4011.68.022; and
WHEREAS, per Lynwood Municipal Code section 6 -3.15 "Change Order",
any amount that exceeds 25 percent of the contract price or $50,000, whichever
is less, requires City Council approval; and
WHEREAS, the cost of the additional sidewalk improvements are in the
amount of $45,000 which exceeds the change order provisions of the LMC, staff
is recommending approval of the proposed contract change order, in an amount
not to exceed $45,000; and
WHEREAS, MTA has approved a transfer of funds from TDA Article funds
to the sidewalk improvement project in the amount of $45,000.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD
DOES HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS:
Section 1. That the City Manager or his designee is hereby authorized to
make the following funds transfer and appropriations:

Section 2. That the City Council hereby approves contract change order
No. 1 in the amount not to exceed $45,000 to Kalban Inc., and authorizes the
Mayor to execute the contract change order.
Section 3. That this Resolution shall take effect immediately upon its
adoption.
Section 4. The City Clerk shall certify as to the adoption of this City
Council Resolution.
